2、icle2Thiscontractmustbesignedorsealedbytheemployerslegalrepresentativeortheprincipalresponsibleperson(PartyA)andtheemployee(PartyB),andaffixtheofficialsealoftheemployer(orthespecialsealofthelaborcontract).Article3Theemptycolumninthiscontract,shouldbefilledinbytwopartiesthroughnegotiation,andshallnot

3、violatelaws,provisions,andrelevantregulations;emptycolumnnotneedtobefilledin,mark“/.Article4Workinghourssystemisdividedintostandardworkinghours,non-fixworkinghours,andcomprehensivecalculationworkinghours.Theirregularworkinghours,andcomprehensivecalculationworkinghours,shouldbeapprovedbylaboradminist

4、rationauthorities.Article5Theunfinishedmattersofthiscontract,maysignasupplementaryagreement,astheattachmentofthiscontract,andbeperformedwiththecontracttogether.Article6Thiscontractmustfillinseriously,writelegibly,textbeconciseandaccurate,andshallnotalterarbitrarily.Article7Afterthesigningofthiscontr

12、rtyBshallworkforhoursaday,andhoursaweek.PartyAshallguaranteethatPartyBhasatleastonedayoffinaweek.2.Non-scheduleworkinghoursystem.ThepositionofPartyBpracticesnon-scheduleworkinghoursystemaftertheapprovalofthelaboradministrationauthority.3.Systemofcomprehensivecalculationofworkinghour.ThepositionofPar

13、tyBpracticessystemofcomprehensivecalculationofworkinghouraftertheapprovalofthelaboradministrationauthority;calculationcircle;totalworkinghours.B.PartyAmayextendworkinghoursduetotherequirementofitsproductionorbusinessafterconsultationwiththeTradeUnionandthePartyB,but,withtheexceptionofthecircumstance

14、sstipulatedinArticle42ofthePRCLaborLaw,theextendedhoursforadayshallgenerallynotexceedonehour;ifsuchextensioniscalledforduetospecialreasons,theextendedworkinghoursshallnotexceedthreehoursadayundertheconditionthatthehealthofthePartyBisguaranteed.However,thetotalextensioninamonthshallnotexceed36hours.C

15、.PartyAshallprovidethePartyAwithlegalholidays,annualleave,marriageleave,funeralleave,homeleave,maternityleave,nursingleave,etc.inaccordancewithrelevantregulations4andpayvacationwagesaccordingtothewagestandardprovidedbythiscontract.Article4LaborRemunerationA.ThewageofPartyBfornormalworkinghoursshallb

16、epaidpursuanttomodebelowandmaynotlessthantheminimumwagerateintheplacewherethePartyAislocated.1.Hourlywage:(1)ThewagesofthePartyBfornormalworkinghoursshallbepaidpursuantto;thebeginningwageamountisasRMB/monthorRMB/hour.(2)ThewagesofthePartyBisasRMB/monthintheprobationaryperiod(theprobationalsalaryshal

17、lnotbelessthantheminimumwageofsamepostand80percentofappointedsalaryinthecontract,notlessthantheminimumwagestandardinwherePartyAislocated.);2.Pieceworkwage:(1)Unitprice:/;(2)Laborquotas:/(Thelaborquotasdeterminedgenerallyshallbetheamountofworkthatover70%employeesinthesamepositionofthePartyAcanfinishw

21、allpayPartyBovertimepayinaccordance5withthePRCLaborLawandProvisionsofGuangdongProvinceonWagePayment,exceptthatPartyBisarrangedforcompensatorytime-offafterhe/shehasbeenarrangedtoworkovertimeonnon-businessday.Article5SocialInsuranceandFringeBenefitsA.Duringthecontractperiod,PartyA,inaccordancewithther

22、elevantregulationsofnation,provinceanddistrict,shallpaythepension,medical,unemployment,workinjuryandmaternityinsuranceproceduresforPartyB,andshallpaysocialinsurancefundbasedonpaymentbaseandpaymentratiobyrule.PartyBshallundertakehisownpartofsocialinsurancefund,thepayableamountshallbewithheldbyPartyAf

23、romthePartyBsmonthlywages.PartyAshalltruthfullyinformthesituationofhandlingsocialinsuranceproceduresandwithholdingsocialinsurancepremiumstoPartyB.B.IncasePartyBsufferssicknessornon-work-relatedinjury,PartyAshallofferPartyBaperiodofmedicaltreatmentandsick-leavetreatmentstipulatedbynationalandlocalreg

24、ulations,paymedicalinsuranceandothermedicalpaymentrelatingtorelevantregulations,andpaysicknesspayordiseasereliefduringspecifiedmedicalperiod,theamountmaybeRMBpermonth(nolessthan80%ofthelocalminimumwagestandard).Article6LaborProtection,WorkingConditionandProtectionAgainstOccupationalHazardsA.PartyAsh

25、allprovideworkingplaceconformedtothenationallaborhealthstandard,inaccordancewithlaborprotectionregulationsofthenationandprovince,andeffectivelyprotectthesafetyandhealthofPartyBduringworkingproduction.IfPartyBmaysufferoccupationalhazardduringproductionprocedures,PartyAshalltruthfullyinformPartyB,andp

26、rotectthehealthandrelatedrightsofPartyBstipulatedby“LawofOccupationalDiseasePrevention.B.AccordingtothepositionofthePartyB,PartyAshallprovidePartyBwithlaborsafetyandhygieneconditionsinconformitywiththerelevantlawsandregulations,andprovidefreephysicalexaminationforPartyBevery(year/season/month)inacco

27、rdancewithlaborprotectionprovisions.C.PartyAmustcarryoutrelevantprovisionsformulatedbythenation,provinceanddistrictforthelaborprotectionandhealth-careworkoffemaleworker.D.PartyBshallhavetherighttorefusetocarryoutanydangerousoperationforceduponhim/herbyPartyA.ForPartyAsoritsmanagersbehaviorwhichisind

28、ifferenttothesafetyand6healthofPartyB,PartyBmayhavetherighttoinformandreporttotherelevantgovernmentdepartments.E.IfPartyBsufferoccupationaldisease,work-relatedinjuryordeathduetowork,PartyAshallhandleitinaccordancewith“workinjuryinsuranceregulations.Article7ModificationoftheEmploymentContractA.Either

29、ofthePartiesmaymodifyrelevanttermsoftheEmploymentContractwithwrittennoticetoothers.B.PartyAchangethename,legalrepresentative,principalresponsiblepersonorinvestor,dosenotaffecttheperformanceofthecontract.C.IfPartyAoccurtheeventofmergerordivision,thecontractsremaininforce,andshallcontinuouslyperformby

30、theunitsucceededPartyAsrightsandobligations.D.Thetwopartiesmayalterthelaborcontractthroughmutualconsultationandagreement,andhandlechangeproceduresinwriting.Afterthechangeoflaborcontract,eachpartyholdsone.Article8CancellationandTerminationoftheEmploymentContractA.Cancellation1.Thepartiesmayterminatet

31、helaborcontractthroughmutualconsultationandagreement.IfPartyAproposestoterminatethiscontract,shallpaytheeconomiccompensationtoPartyBbyrule.2.PartyAmayterminatetheemploymentcontractunderanyofthefollowingcircumstancesinvolvingPartyB:(1)PartyBbeenproventobeincompetentfortheemployingrequirementduringpro

32、bationalperiod.(2)PartyBseriouslybreachlabordisciplinesorregulationsstipulatedbyPartyA.(3)PartyBneglectshisdutyandengagesinmalpracticesforselfishends,thuscausingsignificantharmtotheinterestsofthePartyA.(4)PartyBbuildlaborrelationshipswithotherunits,tocauseaseriouslyimpactonthecompletionofthetaskofPa

33、rtyA,orrefusetocorrecttherulesmadebyPartyA.(5)WherePartyBhasconcludedormodifiedthelaborcontractagainstthetrueintentionsof7PartyAthroughtheuseoffraud,coercionorexploitationoftheunfavorablepositionofPartyA,asaresultofwhichthisagreementisdeemednullandvoid;(6)PartyBisfoundguiltyaccordingtothelawsofP.R.C

34、.(7)PartyBisillorinjuredduetonon-workrelation,afterthecompletionofmedical,stillisincompetentforhisoriginalwork,oralternativejobsarrangedbyPartyA.(8)PartyBisincompetentforworkaftertrainingoradjustmentofjobs.(9)Iftheobjectivesituationchangessignificantlythiscontractbasedon,toresultthecontractunabletop

35、erform,andmutualconsentcannotbereachedinchargeofthislaborcontracts.PartyAterminatethiscontractaccordingtoitem(7),(8)and(9),shouldnoticePartyBinwritingbefore30days(orextrapayamonthwagetoPartyB),andpayeconomiccompensationtoPartyBsubjecttoregulations.IfPartyAterminatethiscontractaccordingtoitem(7),also

36、shallpaymedicaltreatmentallowancestoPartyBconformingtorelevantregulations.3.Underanyofthefollowingcircumstances,PartyAcanmakeredundanciesstipulatedbyregulationsandprocedures,andpayeconomiccompensationtoPartyBbyrule:(1)PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw;(2)Productionandbusinessope

37、rationofPartyAmetseriousdifficulties;(3)Production,technologicalinnovationorbusinessmethodofPartyAadjusted;(4)Ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform.4.PartyBmayterminatethelaborcontractwith30dayspriorwrittennoticetoPartyA;duringtheprobati

38、onaryperiodwith3dayspriorwrittennoticetoPartyA.PartyBmayterminatehisemploymentcontractunderanyofthefollowingcircumstancesinvolvingPartyA.PartyAshallpaytheeconomiccompensationtoPartyBbyrule:(1)PartyAhasfailedtoprovidelaborprotectionorworkingconditionsasstipulatedinthelaborcontract;(2)PartAhasfailedto

39、payremunerationontimeorinfull;(3)PartyAhasfailedtocontributesocialinsurancefundonbehalfofPartyBinaccordancewiththelaw;(4)PartyAspoliciesviolatelawsorregulations,therebyinfringinguponPartyBsrightsandinterests;(5)PartyAhasconcludedormodifiedthelaborcontractagainstthetrueintentionsofPartyBthroughtheuse

40、offraud,coercionortakingadvantageofPartyBsunfavorableposition,asaresultofwhichthiscontractorthechangingagreementisdeemednullandvoid;(6)PartyAisexemptedfromitslegalliabilityandPartyBsrights,asaresultofwhichthiscontractisdeemednullandvoid;8 (7)PartyAviolatesobligatoryprovisioninlawsandregulations,asar

41、esultofwhichthiscontractisdeemednullandvoid;(8)IfPartyAusesviolence,intimidation,oranunlawfulrestraintofindividualfreedomtocompelPartyBtowork,orifPartyAinstructsPartyBtoviolatethelaworengageinhazardousworkthatendangershispersonalsafety.(9)OthercircumstancesforterminationbyPartyBasspecifiedunderlawsa

42、ndregulations.Ifthesituationofitem(8)occurs,PartyBhastherighttoterminatethecontractimmediatelywithoutnoticePartyAinadvance.5.Oftheanyofthefollowingcircumstances,PartyAcannotterminatethelaborcontractonthebasisofarticle40and41ofthe“LaborContractLaws;(1)PartyBthatconductsoperationsexposinghim/hertooccu

43、pationaldiseasehazardshasnotgonethroughanoccupationalhealthexaminationbeforeleavinghispost,orissuspectedofhavinganoccupationaldiseaseandisunderdiagnosisormedicalobservation.(2)Injuredduetotheoccupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.(3)Illnes

44、sornonwork-relatedinjurywithintheprescribedperiodofmedicaltreatment.(4)Womenworkersinpregnancy,childbirth,breastfeeding.(5)Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageinthisunit.(6)Othercircumstancesstipulatedbylawsadministrativeregulations.B.Termination1.Oncethecont

45、ractexpiredorstatutoryterminationconditionoccurs,thecontractshallbeterminated.2.Thecontractterminateduetooneofthefollowingcircumstance,PartyAshouldpayeconomiccompensationtoPartyBstipulatedbyregulations.(1)InadditiontothePartyAmaintainorimprovetheconditionofthelaborcontracttorenewthelaborcontract,Par

46、tyBdisagreetonewalease,thelaborcontractexpires;(2)PartyAwasdeclaredbankruptbycourt.(3)BusinesslicenseofPartyAwasrevoked,ordertoclose,cancellationorearlydissolutionof.(4)Othercircumstancesstipulatedbylawsadministrativeregulations.3.WhenPartyBhasthecircumstancesofthefirstparagraph(5)ofarticle8,thecont

47、act9expired,PartyAshallrenewthecontractuntilthecorrespondingcircumstancedisappeared.ButifPartyBsuffersfromoccupationaldiseaseorwork-relatedinjuryandisconfirmedtohavetotallyorpartiallylosttheabilityofwork,PartyAshallexecuteaccordingtoworkinjuryinsuranceregulationsformulatedbynationandprovince.C.IfPar

48、tyAillegallydissolvesorterminatesthecontract,PartyBrequeststocarryonthiscontract,PartyAshallcontinuetoperform;PartyBdoesnotrequiretocarryonthecontractorthecontractcannotcontinuetobeperformed,PartyAshallpaydoublecompensationforPartyBaccordingtoeconomiccompensationstandard.D.ProceduresofthedissolutionorterminationofthecontractWhenrelievingorterminatingthiscontract,PartyAshallshowthecertificateofrelievingorterminatinglaborcontact,andhandletransferformalitiesoffilesandsocialinsuranceforPartyBwithin15days.Article9ConciliationandArbitrationIfanydisputearisesbetweenthiscontract
