2、eprincipalresponsibleperson(PartyA)andtheemployee(PartyB),andaffixtheofficialsealoftheemployer(orthespecialsealofthelaborcontract).Article3Theemptycolumninthiscontract,shouldbefilledinbytwopartiesthroughnegotiation,andshallnotviolatelaws,provisions,andrelevantregulations;emptycolumnnotneedtobefilled
3、in,mark“/.Article4Workinghourssystemisdividedintostandardworkinghours,non-fixworkinghours,andcomprehensivecalculationworkinghours.Theirregularworkinghours,andcomprehensivecalculationworkinghours,shouldbeapprovedbylaboradministrationauthorities.Article5Theunfinishedmattersofthiscontract,maysignasuppl

12、tleastonedayoffinaweek.2.Non-scheduleworkinghoursystem.ThepositionofPartyBpracticesnon-scheduleworkinghoursystemaftertheapprovalofthelaboradministrationauthority.3.Systemofcomprehensivecalculationofworkinghour.ThepositionofPartyBpracticessystemofcomprehensivecalculationofworkinghouraftertheapprovalo
13、fthelaboradministrationauthority;calculationcircle;totalworkinghours.B.PartyAmayextendworkinghoursduetotherequirementofitsproductionorbusinessafterconsultationwiththeTradeUnionandthePartyB,but,withtheexceptionofthecircumstancesstipulatedinArticle42ofthePRCLaborLaw,theextendedhoursforadayshallgeneral
14、lynotexceedonehour;ifsuchextensioniscalledforduetospecialreasons,theextendedworkinghoursshallnotexceedthreehoursadayundertheconditionthatthehealthofthePartyBisguaranteed.However,thetotalextensioninamonthshallnotexceed36hours.C.PartyAshallprovidethePartyAwithlegalholidays,annualleave,marriageleave,fu
15、neralleave,homeleave,maternityleave,nursingleave,etc.inaccordancewithrelevantregulations4andpayvacationwagesaccordingtothewagestandardprovidedbythiscontract.Article4LaborRemunerationA.ThewageofPartyBfornormalworkinghoursshallbepaidpursuanttomodebelowandmaynotlessthantheminimumwagerateintheplacewhere
16、thePartyAislocated.1.Hourlywage:(1)ThewagesofthePartyBfornormalworkinghoursshallbepaidpursuantto;thebeginningwageamountisasRMB/monthorRMB/hour.(2)ThewagesofthePartyBisasRMB/monthintheprobationaryperiod(theprobationalsalaryshallnotbelessthantheminimumwageofsamepostand80percentofappointedsalaryintheco

21、dongProvinceonWagePayment,exceptthatPartyBisarrangedforcompensatorytime-offafterhe/shehasbeenarrangedtoworkovertimeonnon-businessday.Article5SocialInsuranceandFringeBenefitsA.Duringthecontractperiod,PartyA,inaccordancewiththerelevantregulationsofnation,provinceanddistrict,shallpaythepension,medical,
22、unemployment,workinjuryandmaternityinsuranceproceduresforPartyB,andshallpaysocialinsurancefundbasedonpaymentbaseandpaymentratiobyrule.PartyBshallundertakehisownpartofsocialinsurancefund,thepayableamountshallbewithheldbyPartyAfromthePartyBsmonthlywages.PartyAshalltruthfullyinformthesituationofhandlin
23、gsocialinsuranceproceduresandwithholdingsocialinsurancepremiumstoPartyB.B.IncasePartyBsufferssicknessornon-work-relatedinjury,PartyAshallofferPartyBaperiodofmedicaltreatmentandsick-leavetreatmentstipulatedbynationalandlocalregulations,paymedicalinsuranceandothermedicalpaymentrelatingtorelevantregula
24、tions,andpaysicknesspayordiseasereliefduringspecifiedmedicalperiod,theamountmaybeRMBpermonth(nolessthan80%ofthelocalminimumwagestandard).Article6LaborProtection,WorkingConditionandProtectionAgainstOccupationalHazardsA.PartyAshallprovideworkingplaceconformedtothenationallaborhealthstandard,inaccordan
25、cewithlaborprotectionregulationsofthenationandprovince,andeffectivelyprotectthesafetyandhealthofPartyBduringworkingproduction.IfPartyBmaysufferoccupationalhazardduringproductionprocedures,PartyAshalltruthfullyinformPartyB,andprotectthehealthandrelatedrightsofPartyBstipulatedby“LawofOccupationalDisea
26、sePrevention.B.AccordingtothepositionofthePartyB,PartyAshallprovidePartyBwithlaborsafetyandhygieneconditionsinconformitywiththerelevantlawsandregulations,andprovidefreephysicalexaminationforPartyBevery(year/season/month)inaccordancewithlaborprotectionprovisions.C.PartyAmustcarryoutrelevantprovisions
27、formulatedbythenation,provinceanddistrictforthelaborprotectionandhealth-careworkoffemaleworker.D.PartyBshallhavetherighttorefusetocarryoutanydangerousoperationforceduponhim/herbyPartyA.ForPartyAsoritsmanagersbehaviorwhichisindifferenttothesafetyand6healthofPartyB,PartyBmayhavetherighttoinformandrepo
28、rttotherelevantgovernmentdepartments.E.IfPartyBsufferoccupationaldisease,work-relatedinjuryordeathduetowork,PartyAshallhandleitinaccordancewith“workinjuryinsuranceregulations.Article7ModificationoftheEmploymentContractA.EitherofthePartiesmaymodifyrelevanttermsoftheEmploymentContractwithwrittennotice
29、toothers.B.PartyAchangethename,legalrepresentative,principalresponsiblepersonorinvestor,dosenotaffecttheperformanceofthecontract.C.IfPartyAoccurtheeventofmergerordivision,thecontractsremaininforce,andshallcontinuouslyperformbytheunitsucceededPartyAsrightsandobligations.D.Thetwopartiesmayalterthelabo
30、rcontractthroughmutualconsultationandagreement,andhandlechangeproceduresinwriting.Afterthechangeoflaborcontract,eachpartyholdsone.Article8CancellationandTerminationoftheEmploymentContractA.Cancellation1.Thepartiesmayterminatethelaborcontractthroughmutualconsultationandagreement.IfPartyAproposestoter
31、minatethiscontract,shallpaytheeconomiccompensationtoPartyBbyrule.2.PartyAmayterminatetheemploymentcontractunderanyofthefollowingcircumstancesinvolvingPartyB:(1)PartyBbeenproventobeincompetentfortheemployingrequirementduringprobationalperiod.(2)PartyBseriouslybreachlabordisciplinesorregulationsstipul
32、atedbyPartyA.(3)PartyBneglectshisdutyandengagesinmalpracticesforselfishends,thuscausingsignificantharmtotheinterestsofthePartyA.(4)PartyBbuildlaborrelationshipswithotherunits,tocauseaseriouslyimpactonthecompletionofthetaskofPartyA,orrefusetocorrecttherulesmadebyPartyA.(5)WherePartyBhasconcludedormod
33、ifiedthelaborcontractagainstthetrueintentionsof7PartyAthroughtheuseoffraud,coercionorexploitationoftheunfavorablepositionofPartyA,asaresultofwhichthisagreementisdeemednullandvoid;(6)PartyBisfoundguiltyaccordingtothelawsofP.R.C.(7)PartyBisillorinjuredduetonon-workrelation,afterthecompletionofmedical,
34、stillisincompetentforhisoriginalwork,oralternativejobsarrangedbyPartyA.(8)PartyBisincompetentforworkaftertrainingoradjustmentofjobs.(9)Iftheobjectivesituationchangessignificantlythiscontractbasedon,toresultthecontractunabletoperform,andmutualconsentcannotbereachedinchargeofthislaborcontracts.PartyAt
35、erminatethiscontractaccordingtoitem(7),(8)and(9),shouldnoticePartyBinwritingbefore30days(orextrapayamonthwagetoPartyB),andpayeconomiccompensationtoPartyBsubjecttoregulations.IfPartyAterminatethiscontractaccordingtoitem(7),alsoshallpaymedicaltreatmentallowancestoPartyBconformingtorelevantregulations.
36、3.Underanyofthefollowingcircumstances,PartyAcanmakeredundanciesstipulatedbyregulationsandprocedures,andpayeconomiccompensationtoPartyBbyrule:(1)PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw;(2)ProductionandbusinessoperationofPartyAmetseriousdifficulties;(3)Production,technologicalinnovation
37、orbusinessmethodofPartyAadjusted;(4)Ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform.4.PartyBmayterminatethelaborcontractwith30dayspriorwrittennoticetoPartyA;duringtheprobationaryperiodwith3dayspriorwrittennoticetoPartyA.PartyBmayterminatehisemploy
38、mentcontractunderanyofthefollowingcircumstancesinvolvingPartyA.PartyAshallpaytheeconomiccompensationtoPartyBbyrule:(1)PartyAhasfailedtoprovidelaborprotectionorworkingconditionsasstipulatedinthelaborcontract;(2)PartAhasfailedtopayremunerationontimeorinfull;(3)PartyAhasfailedtocontributesocialinsuranc
39、efundonbehalfofPartyBinaccordancewiththelaw;(4)PartyAspoliciesviolatelawsorregulations,therebyinfringinguponPartyBsrightsandinterests;(5)PartyAhasconcludedormodifiedthelaborcontractagainstthetrueintentionsofPartyBthroughtheuseoffraud,coercionortakingadvantageofPartyBsunfavorableposition,asaresultofw
40、hichthiscontractorthechangingagreementisdeemednullandvoid;(6)PartyAisexemptedfromitslegalliabilityandPartyBsrights,asaresultofwhichthiscontractisdeemednullandvoid;8 (7)PartyAviolatesobligatoryprovisioninlawsandregulations,asaresultofwhichthiscontractisdeemednullandvoid;(8)IfPartyAusesviolence,intimi
41、dation,oranunlawfulrestraintofindividualfreedomtocompelPartyBtowork,orifPartyAinstructsPartyBtoviolatethelaworengageinhazardousworkthatendangershispersonalsafety.(9)OthercircumstancesforterminationbyPartyBasspecifiedunderlawsandregulations.Ifthesituationofitem(8)occurs,PartyBhastherighttoterminateth
42、econtractimmediatelywithoutnoticePartyAinadvance.5.Oftheanyofthefollowingcircumstances,PartyAcannotterminatethelaborcontractonthebasisofarticle40and41ofthe“LaborContractLaws;(1)PartyBthatconductsoperationsexposinghim/hertooccupationaldiseasehazardshasnotgonethroughanoccupationalhealthexaminationbefo
43、releavinghispost,orissuspectedofhavinganoccupationaldiseaseandisunderdiagnosisormedicalobservation.(2)Injuredduetotheoccupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.(3)Illnessornonwork-relatedinjurywithintheprescribedperiodofmedicaltreatment.(4)Wom
44、enworkersinpregnancy,childbirth,breastfeeding.(5)Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageinthisunit.(6)Othercircumstancesstipulatedbylawsadministrativeregulations.B.Termination1.Oncethecontractexpiredorstatutoryterminationconditionoccurs,thecontractshallbetermina
45、ted.2.Thecontractterminateduetooneofthefollowingcircumstance,PartyAshouldpayeconomiccompensationtoPartyBstipulatedbyregulations.(1)InadditiontothePartyAmaintainorimprovetheconditionofthelaborcontracttorenewthelaborcontract,PartyBdisagreetonewalease,thelaborcontractexpires;(2)PartyAwasdeclaredbankrup
46、tbycourt.(3)BusinesslicenseofPartyAwasrevoked,ordertoclose,cancellationorearlydissolutionof.(4)Othercircumstancesstipulatedbylawsadministrativeregulations.3.WhenPartyBhasthecircumstancesofthefirstparagraph(5)ofarticle8,thecontact9expired,PartyAshallrenewthecontractuntilthecorrespondingcircumstancedi
47、sappeared.ButifPartyBsuffersfromoccupationaldiseaseorwork-relatedinjuryandisconfirmedtohavetotallyorpartiallylosttheabilityofwork,PartyAshallexecuteaccordingtoworkinjuryinsuranceregulationsformulatedbynationandprovince.C.IfPartyAillegallydissolvesorterminatesthecontract,PartyBrequeststocarryonthisco
48、ntract,PartyAshallcontinuetoperform;PartyBdoesnotrequiretocarryonthecontractorthecontractcannotcontinuetobeperformed,PartyAshallpaydoublecompensationforPartyBaccordingtoeconomiccompensationstandard.D.ProceduresofthedissolutionorterminationofthecontractWhenrelievingorterminatingthiscontract,PartyAshallshowthecertificateofrelievingorterminatinglaborcontact,andhandletransferformalitiesoffilesandsocialinsuranceforPartyBwithin15days.Article9ConciliationandArbitrationIfanydisputearisesbetweenthiscontract,itshallbesettledthroughnegotiation;ifthepartiesareunwillingtonegotiateorthenegoti
