2、Article2Thiscontractmustbesignedorsealedbytheemployerslegalrepresentativeortheprincipalresponsibleperson(PartyA)andtheemployee(PartyB),andaffixtheofficialsealoftheemployer(orthespecialsealofthelaborcontract).Article3Theemptycolumninthiscontract,shouldbefilledinbytwopartiesthroughnegotiation,andshall
3、notviolatelaws,provisions,andrelevantregulations;emptycolumnnotneedtobefilledin,mark“/.Article4Workinghourssystemisdividedintostandardworkinghours,non-fixworkinghours,andcomprehensivecalculationworkinghours.Theirregularworkinghours,andcomprehensivecalculationworkinghours,shouldbeapprovedbylaboradmin

12、low:1.Standardworkinghourssystem.PartyBshallworkforhoursaday,andhoursaweek.PartyAshallguaranteethatPartyBhasatleastonedayoffinaweek.2.Non-scheduleworkinghoursystem.ThepositionofPartyBpracticesnon-scheduleworkinghoursystemaftertheapprovalofthelaboradministrationauthority.3.Systemofcomprehensivecalcul
13、ationofworkinghour.ThepositionofPartyBpracticessystemofcomprehensivecalculationofworkinghouraftertheapprovalofthelaboradministrationauthority;calculationcircle;totalworkinghours.B.PartyAmayextendworkinghoursduetotherequirementofitsproductionorbusinessafterconsultationwiththeTradeUnionandthePartyB,bu
14、t,withtheexceptionofthecircumstancesstipulatedinArticle42ofthePRCLaborLaw,theextendedhoursforadayshallgenerallynotexceedonehour;ifsuchextensioniscalledforduetospecialreasons,theextendedworkinghoursshallnotexceedthreehoursadayundertheconditionthatthehealthofthePartyBisguaranteed.However,thetotalexten
15、sioninamonthshallnotexceed36hours.C.PartyAshallprovidethePartyAwithlegalholidays,annualleave,marriageleave,funeralleave,homeleave,maternityleave,nursingleave,etc.inaccordancewithrelevantregulationsandpayvacationwagesaccordingtothewagestandardprovidedbythiscontract.Article4LaborRemunerationA.Thewageo
16、fPartyBfornormalworkinghoursshallbepaidpursuanttomodebelowandmaynotlessthantheminimumwagerateintheplacewherethePartyAislocated.1.Hourlywage:(1)ThewagesofthePartyBfornormalworkinghoursshallbepaidpursuantto;thebeginningwageamountisasRMB/monthorRMB/hour.(2)ThewagesofthePartyBisasRMB/monthintheprobation
17、aryperiod(theprobationalsalaryshallnotbelessthantheminimumwageofsamepostand80percentofappointedsalaryinthecontract,notlessthantheminimumwagestandardinwherePartyAislocated.);2.Pieceworkwage:(1)Unitprice:/;(2)Laborquotas:/(Thelaborquotasdeterminedgenerallyshallbetheamountofworkthatover70%employeesinth

21、AarrangesPartyBtoworkovertime,itshallpayPartyBovertimepayinaccordancewiththePRCLaborLawandProvisionsofGuangdongProvinceonWagePayment,exceptthatPartyBisarrangedforcompensatorytime-offafterhe/shehasbeenarrangedtoworkovertimeonnon-businessday.Article5SocialInsuranceandFringeBenefitsA.Duringthecontractp
22、eriod,PartyA,inaccordancewiththerelevantregulationsofnation,provinceanddistrict,shallpaythepension,medical,unemployment,workinjuryandmaternityinsuranceproceduresforPartyB,andshallpaysocialinsurancefundbasedonpaymentbaseandpaymentratiobyrule.PartyBshallundertakehisownpartofsocialinsurancefund,thepaya
23、bleamountshallbewithheldbyPartyAfromthePartyBsmonthlywages.PartyAshalltruthfullyinformthesituationofhandlingsocialinsuranceproceduresandwithholdingsocialinsurancepremiumstoPartyB.B.IncasePartyBsufferssicknessornon-work-relatedinjury,PartyAshallofferPartyBaperiodofmedicaltreatmentandsick-leavetreatme
24、ntstipulatedbynationalandlocalregulations,paymedicalinsuranceandothermedicalpaymentrelatingtorelevantregulations,andpaysicknesspayordiseasereliefduringspecifiedmedicalperiod,theamountmaybeRMBpermonth(nolessthan80%ofthelocalminimumwagestandard).Article6LaborProtection,WorkingConditionandProtectionAga
25、instOccupationalHazardsA.PartyAshallprovideworkingplaceconformedtothenationallaborhealthstandard,inaccordancewithlaborprotectionregulationsofthenationandprovince,andeffectivelyprotectthesafetyandhealthofPartyBduringworkingproduction.IfPartyBmaysufferoccupationalhazardduringproductionprocedures,Party
26、AshalltruthfullyinformPartyB,andprotectthehealthandrelatedrightsofPartyBstipulatedby“LawofOccupationalDiseasePrevention.B.AccordingtothepositionofthePartyB,PartyAshallprovidePartyBwithlaborsafetyandhygieneconditionsinconformitywiththerelevantlawsandregulations,andprovidefreephysicalexaminationforPar
27、tyBevery(year/season/month)inaccordancewithlaborprotectionprovisions.C.PartyAmustcarryoutrelevantprovisionsformulatedbythenation,provinceanddistrictforthelaborprotectionandhealth-careworkoffemaleworker.D.PartyBshallhavetherighttorefusetocarryoutanydangerousoperationforceduponhim/herbyPartyA.ForParty
28、AsoritsmanagersbehaviorwhichisindifferenttothesafetyandhealthofPartyB,PartyBmayhavetherighttoinformandreporttotherelevantgovernmentdepartments.E.IfPartyBsufferoccupationaldisease,work-relatedinjuryordeathduetowork,PartyAshallhandleitinaccordancewith“workinjuryinsuranceregulations.Article7Modificatio
29、noftheEmploymentContractA.EitherofthePartiesmaymodifyrelevanttermsoftheEmploymentContractwithwrittennoticetoothers.B.PartyAchangethename,legalrepresentative,principalresponsiblepersonorinvestor,dosenotaffecttheperformanceofthecontract.C.IfPartyAoccurtheeventofmergerordivision,thecontractsremaininfor
30、ce,andshallcontinuouslyperformbytheunitsucceededPartyAsrightsandobligations.D.Thetwopartiesmayalterthelaborcontractthroughmutualconsultationandagreement,andhandlechangeproceduresinwriting.Afterthechangeoflaborcontract,eachpartyholdsone.Article8CancellationandTerminationoftheEmploymentContractA.Cance
31、llation1.Thepartiesmayterminatethelaborcontractthroughmutualconsultationandagreement.IfPartyAproposestoterminatethiscontract,shallpaytheeconomiccompensationtoPartyBbyrule.2.PartyAmayterminatetheemploymentcontractunderanyofthefollowingcircumstancesinvolvingPartyB:(1)PartyBbeenproventobeincompetentfor
32、theemployingrequirementduringprobationalperiod.(2)PartyBseriouslybreachlabordisciplinesorregulationsstipulatedbyPartyA.(3)PartyBneglectshisdutyandengagesinmalpracticesforselfishends,thuscausingsignificantharmtotheinterestsofthePartyA.(4)PartyBbuildlaborrelationshipswithotherunits,tocauseaseriouslyim
33、pactonthecompletionofthetaskofPartyA,orrefusetocorrecttherulesmadebyPartyA.(5)WherePartyBhasconcludedormodifiedthelaborcontractagainstthetrueintentionsofPartyAthroughtheuseoffraud,coercionorexploitationoftheunfavorablepositionofPartyA,asaresultofwhichthisagreementisdeemednullandvoid;(6)PartyBisfoundguiltyaccordingtothelawsofP.R.C.(7)PartyBisillorinjuredduetonon-workrelation,afterthecompletionofmedical,stillisincompetentforhisoriginalwork,oralternativejobsarrangedbyPartyA.(8)PartyBisincompetentforworkaftertrainingoradjustmentofjobs.
