1、混凝土地面工程施工合同【实用文档】doc文档可直接使用可编辑,欢迎下载混凝土地面工程承包合同发包方(下称甲方):李建民承包方(下称乙方):朱利方 张宴振根据中华人民共和国建筑法以及其他相关法律法规规定,本着公平、公正、公开的原则,经甲乙双方协商,具体事宜如下:第一条 工程项目概况1、工程名称:大李庄开发区B栋、C栋楼2、工程地址:施工现场内3、承包方式:乙方包清工;甲方提供工具及材料。4、工程范围与内容:(1)乙方负责混凝土地面的基层处理工作:灰土拌合及夯实碾压、找坡找平;负责C20混凝土地面施工:定位放线、支侧模、混凝土摊铺、振捣、提浆、磨光、割缝等相关混凝土地面所有工序的施工。(2)使用所
2、有机械设备及辅助材料均由乙方自带。(3)混凝土地面质量标准:国家混凝土标准地面施工方案。(4)乙方严格按照国家混凝土标准地面施工方案施工。第二条 工程量及工期1、暂定工程量:混凝土地面2000度平方米,最后按实结算(所施工面长*宽)。2、工期:2021年4月20日开工,2021年12月15日竣工。如遇雨天及不可抗力等因素影响工期顺延。3、甲方负责提供施工图纸。第三条 工程质量标准乙方按照国家现行规范施工,达到混凝土地面验收优良标准(且地面无积水现象)。第四条 合同价款1、合同价款计算:基础:每平方米22.50元;正负零向上:每平方米18.50元。2、工程量按实际结算。第五条 工程款支付1、正负
3、零向上6层一拨款,正负零一下基础到一层拨款。2、保证金10万元,有三次拨款保证金返回.3、正负零向上拨80%,押20。第六条 双方职责1、甲方职责(1)甲方派驻现场施工管理人员,负责处理、协调、执行甲方对于工程质量、安全生产、工程进度、文明施工的监督、检查、控制与管理,行使奖罚,具有工程质量、安全生产、文明施工的决定权与否决权。乙方必须服从甲方有关安全、质量、进度、文明施工规章制度和管理办法要求。确保无安全、质量事故发生,否则一切经济责任后果由乙方负责.(2)甲方提供电源二级箱以上电源,按时提供施工工作面给乙方使用.(3)负责协调配合管理施工现场。(4)工程竣工未交付甲方之前,乙方负责已完工程
4、的保护.2、乙方职责(1)乙方派驻现场施工管理人员。乙方必须服从甲方指定人员管理,按照甲方管理制度施工。(2)施工现场内做到工完场料清,做的文明施工.第七条 安全施工乙方应遵守建设工程安全生产有关规定,严格按照安全标准组织施工,采取必要的安全防护措施、消除事故隐患,由于乙方安全措施不力造成事故的责任和因此发生的费用,由乙方自行承担.第八条 关于工期延误以下原因造成工期延误,经过甲方确认,工期相应顺延。(1)甲方未按约定日期提供施工场面、甲供材料及相关开工条件。(2)不可抗力:自然灾害等。第十条 违约合同双方任何一方不履行合同义务或不按照合同约定履行义务的其他情况,均属违约。由违约方承担违约责任
5、,赔偿另一方因其违约造成的损失,并支付合同价款的10%作为违约金。第十一条 合同争议解决方式本合同履行过程中所发生的争议及本合同未尽事宜,由甲乙双方协调解决.第十二条 合同生效与终止1、本合同经甲乙双方法人代表或其委托代理人签字加盖公章后生效.2、本工程按照甲乙双方按照合同约定,甲方付清全部工程款之日,此合同自动终止。第十三条 合同份数本合同一式三份,甲乙双方各执一份,备案一份,具有同等法律效力.如有本合同未尽事宜处,甲乙双方共同协商签订补充协议,补充协议是本合同的组成部分,与本合同发生冲突部分以补充协议为准。发包方(签章) 承包方(签章)联系 : 联系 :身份证: 身份证:合同签订时间:20

41、opment. 第二部分 通用条款 一、词语定义及合同文件 1,词语定义 下列词语除专用条款另有约定外,应具有本条所赋予的定义, 1。1 通用条款, 是根据法律、行政法规规定及建设工程施工的需要订立,通用于建设工程施工的条款. 1.2 专用条款, 是发包人与承包人根据法律、行政法规规定,结合具体工程实际,经协商达成一致意见的条款,是对通用条款的具体化、补充或修改。 1。3 发包人, 指在协议书中约定,具有工程发包主体资格和支付工程价款能力的当事人以及取得该当事人资格的合法继承人。 1.4 承包人, 指在协议书中约定,被发包人接受的具有工程施工承包主体资格的当事人以及取得该当事人资格的合法继承人
