5、al or confirmation, the project owner may, when submitting the feasibility study report or project application report, file the application for funds, without having to separately submit an application report for funds; or it may also, after the project is approved or confirmed, separately submit th
6、e application report for funds in light of the relevant requirements of the state policies on investment subsidies and interest discount.Article 10 An application for a national hi-tech project shall meet the following basic conditions:第十条申请国家高技 术项目应具备以下基本条 件：（一）符合国家发展改革委 项目公告或通知的要求；(1) It meets the
7、 requirements of the NDRCs project announcement or notice.（二）符合国家产业政策和 节能、降耗、环保、安全等 要求，项目方案合理可行， 具有较好的社会经济效益；(2) It conforms to the state industrial policies and meets the requirements on energy conservation, low consumption, environmental protection, and safety, among others, with the project progr
8、am being reasonable and feasible, and has good social and economic benefits.（三）应具有我国自主知识 产权，知识产权归属明晰；(3) The project owner shall have independent intellectual property rights (“IPRs)of China, and the ownership of the IPRs is clear.（四）项目单位必须具有较 强的技术开发、资金筹措、 项目实施能力，以及较好的 资信等级，资产负债率在合 理范围内，项目已基本具备 实施条件
9、，项目所需资金已(4) The project owner must have strong capacities of technological development, fund raising, and project implementation, and has good credit rating, and its asset-liability ratio is within a reasonable scope. The project has basically met the conditions for implementation, and the funds nee
10、ded in the project have been readily available.10落实;落实;（五）建设项目应按本办法 第九条完成审批、核准或备 案，已基本具备开工建设条 件，或已经开工建设但审 批、核准或备案未超过两 年，已通过项目用地预审或 用地已经依法批准，具有环 保以及其他许可文件。(5) The construction project shall have undergone the approval, confirmation or recordation formalities in accordance with Article 9 of these Meas
11、ures, and have basically met the conditions for starting the construction, or the construction has been started but two years have not lapsed since the approval, confirmation or recordation, and the project owner has obtained the environmental protection permit and other permission documents after t
12、he project has passed the pre-examination of land use or the land used for the project has been legally approved.Article 11 An application for a national hi-tech project shall also meet the following conditions:第H一条申请国家高 技术项目还应具备以下条 件：（一）产业化项目采用的科 技成果（包括自主知识产 权、消化吸收创新、国内外 联合开发的技术等）应具有 先进性和良好的推广应用价 值
13、、有关成果鉴定、权威机(1) The scientific and technological achievements adopted in the industrialization project (including independent IPRs, digestion, absorption and innovation, and the technologies jointly developed by both domestic and foreign developers) shall be advanced and have good value for populariz

15、ant achievement appraisal and authoritative institutions, the necessary verification and production permits; and the project owner shall have strong capacities of organizing and managing engineering construction, and have the qualifications for production and operation of relevant industrialization
16、projects.（二）研制开发项目的研制 开发方案先进、可行，目标 明确；项目单位应具有较强 的技术创新和装备研制能 力，具有前期相关领域的研 发基础和研发队伍；重大技 术装备研制项目应结合依托 工程。(2) The research and development program for the research and development project is advanced and feasible, and the objective is clear; the project owner shall have strong technological innovation a
17、nd equipment research and development capacities, and have preparatory research and development bases in the relevant fields and the research and development team; and the major technological equipment research and development project shall be combined with the supporting projects.（三）工程实验室项目和工 程中心项目
18、的项目单位须为 已经国家发展改革委批准组 建，并完成相关组建工作的 国家工程实验室的依托单位 或国家工程研究中心；项目 建设内容符合该工程实验室 或工程研究中心的发展方向 和任务，建设方案合理。（四）技术中心项目的项目 单位须为国家认定企业技术 中心所在企业，且该国家认 定企业技术中心在最近年度 国家认定企业技术中心评价 中得分70分以上；项目应能 够支撑企业关键、核心技术 的开发。(3) The owner of an engineering laboratory project or engineering center project must be a supporting entit
19、y of a national engineering laboratory or be a national engineering research center, which has been formed upon approval by the NDRC and has accomplished the relevant formation work; and the content of project construction shall conform to the development direction and tasks of the engineering labor
20、atory or the engineering research center, and the construction program is reasonable.(4) The owner of a technology center project must be an enterprise to which the state-accredited enterprise technical center is subordinate, and the state-accredited enterprise technical center is scored 70 or above
21、 in the evaluation of state- accredited enterprise technical centers in the latest year; and the project shall be able to support the development of the enterprises key and core technologies.（五）升级调整项目应符合 产业结构调整指导目录；项 目单位具有良好的现代企业 运行机制和较好的经营业 绩；具有开展相关产品生产 的资格，项目必须具有合理(5) An upgrading and adjustment p
22、roject shall conform to the Catalogue for Guiding Industry Restructuring; and the project owner shall have a good modern enterprise operation mechanism and good business performance, and have the qualification for producing the relevant products, and the project must have a reasonable economic12scal
23、e, with the products meeting the relevant national and international standards.的经济规模，产品符合国家 和国际有关标准。Article 12 A project owner shall prepare the application report for project funds in accordance with the relevant provisions of Articles 10 and 11.第十二条 项目单位应 根据第十条和第十一条的相 关规定，编制项目资金申请 报告。The specific
24、requirements for an application report for project funds shall be set forth in the project announcement or notice, which shall include the following main matters:项目资金申请报告的具体要 求由项目公告或通知具体规 定，应包括以下主要内容：(1) The project owners basic information and financial conditions.（一）项目单位的基本情况 和财务状况；(2) The basic i
25、nformation on the project, including the background of the project, the content of project construction (research and development), total investments and fund sources, techniques, and fulfillment of all construction (research and development) conditions, among others.（二）项目的基本情况，包 括项目背景、项目建设（研 发）内容、总
26、投资及资金来 源、技术工艺、各项建设（研发）条件落实情况等；(3) The main reason and the policy basis for applying for national subsidy funds.（三）申请国家补贴资金的 主要理由和政策依据；(4) The content of invitation for bid for the project (applicable to the investment project under application for national subsidy funds amounting to 5 million yuan o
27、r more).（四）项目招标内容（适用 于申请国家补贴资金500万 元及以上的投资项目）；(5) Other matters required in the NDRCs project announcement or notice.（五）国家发展改革委项目 公告或通知要求提供的其他 内容。13项目资金申请报告可根据具 体情况附以下相关文件：（一）政府投资项目的可行 性研究报告批准文件或企业 投资项目的核准或备案的批 准文件；（三）城市规划部门出具的 城市规划选址意见（适用于 城市规划区域内的投资项 目）；（四）国土资源部门出具的 项目用地预审意见；（五）环保部门出具的环境 影响评价文件的审批
28、意见；（六）金融机构出具的贷款 承诺，申请贴息的项目还须 出具项目单位与有关金融机 构签订的贷款协议或合同；（七）项目单位对项目资金 申请报告内容和附属文件真 实性负责的声明；The following relevant documents may be attached to an application report for project funds according to specific circumstances:(1) The approval document on the feasibility study report of a government investment
29、 project or the approval document on the confirmation or recordation of an enterprise investment project.(2) Technical sources and the relevant documents (二)技术来源及技术先进 proving that technologies are advanced.性的有关证 明 文件；The opinions issued by the urban planning department on the site selection under th
30、e urban planning (applicable to the investment project within the urban planning area).(3) The opinions issued by the department of land and resources on pre-examination of the land used for the project.(4) The opinions issued by the environmental protection department on approval of the environment
31、al impact evaluation documentsThe loan commitments issued by the financial institution, and the loan agreement or contract concluded between the project owner and the financial institution in the case of a project involving interest discount application.(5) The statement of the project owner on bein

33、三条项目主管部 门应根据第十条至第十二条 的相关规定审查项目单位提 出的项目资金申请报告，对 审查合格的项目资金申请报Article 13 The department in charge of a project shall, in accordance with the relevant provisions of Articles 10 through 12, examine the application report for project funds which is filed by the project owner, and submit the application re
34、port告报送国家发展改革委。其 中，对于工作职能属于省级 经济（贸易）委员会的项 目，由省级经济（贸易）委 员会作为项目主管部门，并 由省级经济（贸易）委员会 商省级发展和改革委员会 后，由省级发展和改革委员 会会同省级经济（贸易）委 员会联合报送国家发展改革 委。告报送国家发展改革委。其 中，对于工作职能属于省级 经济（贸易）委员会的项 目，由省级经济（贸易）委 员会作为项目主管部门，并 由省级经济（贸易）委员会 商省级发展和改革委员会 后，由省级发展和改革委员 会会同省级经济（贸易）委 员会联合报送国家发展改革 委。for project funds which passes the e
35、xamination to the NDRC. For a project on which the work functions remain with the provincial economic (trade) commission, the provincial economic (trade) commission shall be the department in charge of the project. After consultation between the provincial economic (trade) commission and the provinc
36、ial development and reform commission, the provincial development and reform commission shall submit the application report to the NDRC jointly with the provincial economic (trade) commission.对申报材料不完备的资金申 请报告，国家发展改革委及 时通知项目主管部门在要求 的时限内补充相关材料。With respect to the application report for funds to which
37、incomplete application materials are attached, the NDRC shall notify in a timely manner the department in charge of the project to supplement the relevant materials during a specified period.第十四条对项目主管 部门报送的项目资金申请报 告，国家发展改革委组织专Article 14 With respect to an application report for project funds submitt
38、ed by the department in charge of the project, the NDRC shall organize a15panel to make expert appraisal or entrust a consulting institution with an assessment, and may, when necessary, request comments from the relevant department of the State Council or the local government.家组进行专家评审或委托咨 询机构进行评估，必要

41、riving the optimization and upgrading of relevant industries.（二）项目对相关产业的优 化升级具有的带动作用；(3) The project owners business capacity and technical development capacity.（三）项目单位的经营能力 和技术开发能力； The market prospect and economic benefits of (四)项目的市场前景和经the project.济效益；(5) The feasibility of the project implement
42、ation (五)项目实施方案的可行 program.性；(6) Other requirements of the NDRCs project announcement or notice.（六）国家发展改革委项目 公告或通知的其他要求。16第十五条国家发展改 革委按照科学、公平、择优 的原则，根据专家评审意见 或咨询机构的评估意见，综 合考虑国务院有关部门和地 方政府的意见，审查批复项 目资金申请报告，并将项目 的评审评估意见和审批结果 以适当的方式告知项目主管 部门。项目资金申请报告的 批复文件是下达国家补贴资 金的依据，应包括项目实施 的总体目标、国家补贴资金 额度和资金使用方向。批复
43、 文件可单独办理，也可集中 办理。The NDRC shall examine an application report for project funds mainly from the following aspects:国家发展改革委主要从以下 方面对项目资金申请报告进 行审查：(1) Whether it complies with the direction of use of the central budgetary funds.（一）符合中央预算内资金 的使用方向；(2) Whether it complies with the relevant requirements o
44、f the project announcement or notice.（二）符合项目公告或通知 的有关要求；(3) Whether it complies with the principles on arrangement of the national subsidy funds.（三）符合国家补贴资金的 安排原则；(4) Whether the relevant documents submitted are (四)提交的相关文件齐complete and valid.备、有效；17The NDRC shall, under the principles of being scien
45、tific and fair and selecting the best, and according to the experts* appraisal opinions or the consulting institutions assessment opinions, comprehensively consider the comments of the relevant departments of the State Council and the local governments, examine and give official replies on the appli
46、cation reports for project funds, and inform the departments in charge of projects of the project appraisal or assessment opinions and approval results in proper manners. The approval documents on the application reports for project funds are the basis for distributing national subsidy funds, and sh
47、all include the overall objectives for implementing the projects, the quota of national subsidy funds and the directions of use of the funds. The approval documents may either be issued separately or in a centralized manner.(5) Whether the main construction (research and development) conditions of t
48、he project are fulfilled.(6) Whether it meets other conditions required by the NDRC.Article 16 The funds arranged by the NDRC to a single national hi-tech project shall be generally capped at 200 million yuan.The funds arranged by the NDRC to a single national hi-tech project invested by a local government, in the amount of 30 million yuan or less, shall be managed as investment subsidies or interest subsidies, and only the application report for fu
