9、0G10Q6 ZO10K2X4O1Y2图 8-2 劳动关系专员职责第二节劳动关系管理制度一、企业劳动合同管理办法制度名称劳动合同管理办法编号执行部门第 1 章总则第 1 条目的为了明确公司与员工的权利与义务,维护双方的共同利益,根据中华人民共和国劳动法、中华人民共和国劳动合同法及其他相关规定,并结合公司的实际情况,制定本办法。第 2 条适用范围本制度适用于公司除高级管理人员之外的所有正式员工。第 3 条原则公司和全体员工在平等自愿、协商一致、不违反国家的有关法律和行政法规的原则下,由公司的法定代表人或者其书面委托的代理人代表公司与员工签订劳动合同。劳动合同依法订立,具有法律效力,公司职责1 代

18、。7除前款规定的必备条款外,当事人和公司可以协商约定其他内容(如附件一:“公司保密和竞业禁止协议”)。第 6 条公司与员工签订的劳动合同一式两份,公司和员工各执一份。第 7 条在签订劳动合同的过程中,员工可以了解公司的规章制度、劳动条件、劳动报酬等与提供劳动有关的情况;公司在招聘员工时,可以了解员工健康状况、学历、专业知识和工作技能等与应聘工作有关的情况,双方应当如实说明。第 8 条本公司劳动合同期限为一至五年,根据不同岗位和任职资格协商确定,劳动合同届满经双方协商一致可以续签。第 3 章劳动合同的履行和变更第 9 条公司每月日之前以货币形式支付员工工资,员工工资不低于市最低工资标准。第 10

27、件的行为时,可随时解除劳动合同。第 15 条公司可以因员工过失(严重违规违纪、严重失职等情况)、员工非过失原因及国家相关法律规定的可以解除劳动合同的情形,与员工解除劳动合同。第 16 条员工被提前解除劳动合同时,符合相关规定应支付经济补偿金的,公司应按国家及地方有关规定进行经济补偿。第 17 条对于合同到期后公司不再聘任的员工,人力资源部应在合同到期日及时与其结清工资、办理离职交接手续。第 18 条劳动合同期满、劳动合同主体资格丧失或在客观上已无法履行合同的情况下,劳动合同可以终止。第 5 章违约责任第 19 条违反服务期约定和泄露商业秘密的员工,应当承担违约责任。公司将以违约金的方式追究违约

37、 条公司应对现有劳动关系形式进行分析,预见可能发生的劳动纠纷问题,及时加以了解和解决。第 3 章劳动争议协商第 6 条劳动争议或纠纷发生后,双方当事人可在合法及兼顾双方利益的前提下进行协商。第 7 条协商有利于自愿达成协议、解决争议、消除隔阂、加强团结,防止事态进一步恶化。第 8 条任何一方不能强迫对方进行协商,一方不愿协商或协商不成的,可以申请调解。调解不成的,可以向劳动争议仲裁委员会申请仲裁。当事人也可以直接向劳动争议仲裁委员会申请仲裁;对仲裁裁决不服的,可以向人民法院起诉。第 4 章劳动争议调解第 9 条在劳资纠纷双方协商无效的情况下,进入劳动纠纷调解程序。第 10 条企业设立劳动争议调
38、解委员会,负责调解本企业发生的劳动争议。第 11 条调解委员会调解劳动争议,应当自当事人申请调解之日起30 日内结束;到期未结束的,视为调解不成。第 12 条调解委员会接到调解申请后,对其进行审查,确定是否受理。第 13 条经审查决定受理的人事争议,调解委员会以书面通知双方当事人,说明调解的时间、地点。如不受理,应向当事人说明原因。第 14 条向劳动纠纷的双方当事人(方)调查,听取双方当事人(方)的意见和要求,搜集有关证据。第 15 条召开调解委员会委员全体会议,对调查取证材料进行分析整理,讨论确定调解方案和调解意见。第 16 条企业调解委员会在查明事实、分清责任的基础上,根据争议的轻重程度等
