1、整理版协议书(抵工程款用)甲方:有限公司乙方:甲、乙双方在平等、自愿的基础上经充分协商,达成本协议以共同遵守:第一条、物业信息乙方自愿购买甲方开发的_ 项目 _ 楼_ 单元 _ 室住宅及其附属储藏室。其中:(1)_ 住宅建筑面积为平方米,购买单价为元/平方米,购房金额为人民币(小写)_ 元,(大写)_ 元整(最终面积以房管局实测面积为准,多退少补);(2)_ 附属储藏室编号,面积 _ 平方米,金额元;以上两项合计房款总金额_ 元,(大写)_ 元整。第二条、合同签订及抵账方式因乙方在甲方开发的“_”项目负责工程施工/提供施工材料,故就该以该房总价款抵顶乙方工程款/材料款事宜,双方同意按以下约定处

10、支付给乙方,具体金额以双方互开收据确认金额为准。4、在工程款/材料款未达到抵账房相关价值前,乙方要求提前签署正式商品房买卖合同的,双方同意按以下第_ 种方式处理(1)乙方应将剩余房款一次性支付给甲方,甲方按工程相关合同协议的约定,按时向乙 方支付剩余工程款/材料款。(2)向甲方出具还款承诺函,承诺“如工程款/材料款最终决算值低于该抵账房价值,在收到甲方决算结果之日起7 日内付清房款差额,逾期按日承担千分之三的违约责任,直至付清为止”)。不愿出具承诺函的,甲方不办理签正式合同手续。5、乙方指定 _(身份证号:_)作为购房人,代表乙方与甲方签订商品房预售合同,并按甲方要求办理产权登记、按揭贷款等手

18、A3Z6 HY3J1S5C7X4 ZU4H3H3U9I4文档编码:CQ8T9P2A3Z6 HY3J1S5C7X4 ZU4H3H3U9I4整理版按以下第 _ 种方式处理:(1)实售价值高于本协议约定抵押值的,其超额部分归乙方所有。甲方在收到第三方全部房款之日起3 日内,将超额部分打到乙方账户。(2)实售价值低于本协议约定抵押值的,其差额部分由乙方承担。乙方在房屋出售之日向甲方出具差额部分的(工程款/材料款的)收款收据。3、如第三方以按揭方式购房,甲方配合乙方及第三方办理按揭贷款相关手续。按揭款到甲方帐户后,甲方按工程相关协议的约定与乙方进行结算。4、乙方将抵账房转让给第三方时,须明确告知第三方应

19、按第二条第5 款的约定承担相应责任和税费,经第三方同意后方可办理房产转让手续。乙方在转让事宜上如与第三方产生纠纷,与甲方无关,乙方须自行解决并承担由此给甲方造成的所有损失。第五条、最终房管局认定的实测面积与本协议面积有差异的,甲、乙双方按本协议约定单价多退少补(与此房子的产权无关)。乙方已将该抵账房转让给第三方的,因面积变动产生的差价,由乙方负责与购房者协调处理,甲方给予相应配合。第六条、本协议未尽事宜,双方协商解决,协商不成的,依法提交潍坊仲裁委员会仲裁。第七条、本协议一式四份,甲方两份(财务、工程部门各一份),乙方一份,具有相同法律效力。甲方:乙 方:代表人:代 表 人:(身份证号):精品
