Compassionate Ground-refers to incidence of death of an immediate mem
12、ber of the seafarers family which includes his parents, spouse and children if the seafarer is married or his parents if the seafarers is single.7.体恤事件-指海员直系亲属死亡事件，直系亲属对已婚海员是指其父母、配偶和子女；对未婚海员是指其父母。8. Principal-any person, partnership or corporation hiring seafarers to work on board vessel.8.雇主-指任何雇佣海
13、员上船为其服务的人、合伙人或公司。SECTION 1. DUTIES第一部分 职责A .Duties of the Employer/agency/masterA.雇主、代理人、船长的职责1.To faithfully comply with the stipulated terms and conditions of this contract, particularly the prompt payment of wages, remittance of allotment and expeditious of valid claim of the seafarer.1.如实地履行本合同所
14、订立条款，尤其是及时支付船员工资，汇款的分配和迅速有效处理海员的索赔。2.To extend coverage to the seafarer under PRC Social Security System.2.按照中华人民共和国社保体系规定实现对船员的社保覆盖。3.To make operational on board the vessel the grievance machinery provided in this contract and ensure its free access at all times by the seafarer.3.使申诉机制在船有效运作，并确保在任
15、何时候船员免费提供服务。4.To provide a seaworthy vessel for the seafarer and take all reasonable precautions to prevent accident and injury to the crew including provision of safety equipment, fire prevention, safe and proper navigation of the vessel and such other precautions necessary to avoid accident, injur
16、y or sickness to seafarer.4.为船员提供适航船舶，采取各种合理预防措施来防止事故和对船员形成伤害，这些合理措施包括：指定安全设备指引、防火、船舶安全妥当航行和其他防止事故或船员伤病的必要防御措施。5.To observe the Code of Ethics for Seafarers and conduct himself in the traditional decorum of a master.5.遵守船员职业道德操守并按传统船长礼仪行事。6.Urge the ships owner to provide a workplace conducive for t
17、he promotion and protection of the health of the seafarers in accordance with the standards and guidelines in Title 4 of the ILO Maritime Labour Convention,2006.6.敦促船东根据国际劳工组织2006海事劳工公约第4章标准和指引要求为船员提供有益于船员健康和发展的工作场所。B. Duties of the SeafarerB.船员职责1.To faithfully comply with and observe the terms and
18、 conditions of this contract.1.诚实地遵守和履行本合同所订立条款。2.To be obedient to lawful commands of the Master or any person who shall lawfully succeed him and to comply with company policy including safety policy and procedures and any instructions given in connection therewith.2.遵守船长及船长合法接班人的合法指令，遵从公司政策包括公司安全政
19、策以及为这些政策而推出的配套规则。3.To abide by the duty in “Seafarer Regulations of The Peoples Republic Of China” and the Code of Ethics for Seafarer.3.遵守中华人民共和国船员管理条例中所规定的船员职责和船员职业道德操守。4.To be diligent in his duties relating to the vessel, its shores and cargo, whether on board, in boats or ashore; and4.不分在船、在岸和其
20、它场所，尽职于本人职务，都要做所对应的对船、对岸和对货事务，并5.To conduct himself in an orderly and respectful manner towards operator，port authorities and other persons on official business with the ship.5.有理有节的行事准则来接待码头的操作人员、港口当局官员和其他与船舶正常营运有关的人士。SECTION 2. COMMENCEMENT/DURATION OF CONTRACT第二部分 合同期及合同那个起始A. The employment cont
21、ract between the employer and the seafarer shall commence upon actual departure of the seafarer from the international airport in the point of hire or actual boarding the vessel designated by the employer whichever is earlier. It shall be effective until the seafarers date of arrival at the point of
22、 hire upon termination of his employment pursuant to Section 15 of this Contract.A.该份合同从船员实际离开雇佣地国际机场或船员实际上到雇主所指定的船舶中较早一个时间开始生效，该合同终止于根据该合同第15部分规定船员到达雇佣地时。B. The period of employment shall be for a period mutually agreed upon by the seafarer and the employer but not to exceed 12 months. Any extensio

FREE PASSAGE FORM THE POINT OF HIRE TO THE PORT OF EMBARKATION第三部分 从雇佣地到上船港的免费行程The seafarer shall join the vessel or be available for duty at the date/time specified by
24、 the employer. The seafarer shall travel by air or as otherwise directed at the expense or the employer.船员应该在雇主规定时间上船任职。船员乘飞机或其他交通方式上船所产生的费用应由雇主承担。SECTION 4. BAGGAGE ALLOWANCE第四部分 行李额度The seafarer travelling by air to join a vessel or on repatriation shall be entitled to the normal free baggage allo
25、wance offered by airlines.Generally,30kg for international passage with size limitation by airlines or 20kg for domestic passage with limitation by airlines. The cost of the excess baggage shall be for the account of the seafarer.船员乘飞机或公休可以享受航空公司所提供的正常免费行李额度。通常情况下，国际航段是按航空公司行李尺寸限制下的30公斤或国内航段是按航空公司行李
26、尺寸限制下的20公斤。超过正常行李额度部分应由船员本人承担费用。SECTION 5. HYGIENE AND VACCINATION第五部分 卫生和预防接种A. The seafarer shall keep his quarters and other living spaces-such as mess rooms, toilet, bathrooms, alleyways and recreation rooms in clean and tidy condition to the satisfaction of the master. The work is to be perform
27、ed outside the seafarers regular working hours and for which no overtime pay shall be claimed.A.船员应该使自己起居的处所和其他居住场所保持到船长满意的干净和整洁的程度，这些场所包括餐、厕所、浴室、走廊和休息室等。对这些场所进行的清洁工作应该在船员正常工作时间以外进行，该部分时间不得记作加班时间。B. The seafarer shall submit to the order of the master or to the laws of any country within the territo

WAGES第六部分 工资A. The seafarer shall be paid his monthly wages not later than 20 da
29、ys of succeeding month from the date of the contract until the date of arrival at point of hire upon termination of his employment pursuant to section 15 of this Contract.A. 根据本合同第15部分规定，从合同起始到合同终止期间船员工资应按月支付并不得晚于下月20号。B. Seafarers shall conduct themselves in an orderly, faithful, honest and shall a
30、t all times be diligent in their respective duties and obedient to the lawful commands of the Master, or of any person who shall lawfully succeed him, and their superior officers, in everything relating to the vessel, its stores and cargo, whether on board, in boats or on shore. Inconsideration of t
31、his service, to be duly performed the Master agrees to pay the undersigned seafarers the wages expressed herein and/or set forth in supplemental provisions and/or agreements.B. 海员应保持忠实、诚信的态度和有序、冷静的处事方式，在任何时候都应该认真履行各自的职责，不论在船上或是在岸上，都应服从船长或任何依法继任者和上级海员关于船舶、储藏和货物等方面的合法指挥。作为海员充分履行此义务的报酬，船长同意按照本合同规定和/或补充
32、条文规定和/或协议支付海员工资。C. Wages shall commence no later than on the day specified and agreed to in these Articles or at a time of presence on board for the purpose of commencing work whichever first occurs and shall terminate on the day of discharge.C. 工资自合同规定和约定的日期或开始上船工作的日期起（以最早的日期为准）至将海员解雇或合同终止之日。D. If
33、the Master and a seafarer agree a portion of such seafarers earnings may be allotted to such seafarers spouse, children, grandparents, brothers or sisters, or to a bank account in the same of the seafarer.D.如果船长和海员同意，海员的部分收入可分配给该海员的配偶、子女、孙子女、父母、祖父母、兄弟姐妹或存至该海员名下的银行账户。SECTIONG 7. HHOURS OF WORK OR RES
34、T第七部分 工作或休息时间A. All seafarers shall be provided with a rest period of not less than:A. 应提供给所有海员下列最短休息时间：i.Daily-a minimum of 10 hours of rest in any 24-hour period;每天：在任何24小时时段内不得少于10小时；ii.Weekly-77 hours in any 7 day period. 每周：在任何7天时间内不得少于77小时。B. The hours of rest may be divided into no more than
35、two period, one of which shall be at least six hours in length, and the interval between consecutive periods of rest shall not exceed 14 hours. A short break of less than 30 minutes will not be considered as a period of rest.B.休息时间最多可分为两段，其中一段至少要6小时，且相连的两段休息时间的间隔不得超过14小时。短暂的少于30分钟的休息时间不被认为是一段休息时间。C.
36、 Musters ,fire-fighting, lifeboat, security and oil-spill drill, safety & security exercises drill will be arranged in a manner that minimizes the disturbance of rest periods and does not include fatigue.C. 应急集合、消防、弃船、保安、益油等演习应以对休息时间的影响最小和不会造成疲劳的方式进行。D.The Master shall ensure that adequate compensat
37、ory rest period is provided if the normal period of rest is disturbed for call-outs to work, such as when a machinery space is unattended, during the normal hours of rest. Any compensatory rest provided shall be consistent with minimum rest hour requirements in any 24-hour period.D. 如果正常的休息时间被紧急的工作打

Records of seafarers daily hours of work or daily hours of rest are maintained in the format in English and Chinese, to allow monitoring of compliance with provisions under the above paragraphs 6

The seafarers are given a copy of the records pertaining to them which are endorsed by the master, or a person authorized by the master, and by the seafarers.F. 海员每天的休息/工作时间应用英文记录，并要符合经修改的国际劳工组织关于制定海员船上工作安排及海员工作或休息时间记录格式的指导，保持记录以便监督是否符合上述6.1-6.4的规定。海员应得到一份由船长或船长授权人员以及海员本人签字认可的日工作时间

The master of the ship have the right to require a seafarer to perform any hours of work necessary for the immediate safety of the ship, person on board or cargo, or for the purpose of giving assistance to other ships or persons in distress at sea。Accordingly，the master may suspend t
42、he schedule of hours of rest and require a seafarer to perform any hours of work necessary until the normal situation has been restored. As soon as practicable after the normal situation has restored, any seafarers who have performed work in a schedule rest period with an adequate period of rest by
43、the master.G. 船长有权出于船舶、船上人员或货物的紧急安全需要，或出于帮助海上遇险的其他船舶或人员的目的而要求一名海员在任何时间进行工作。为此，船长可中止休息时间安排，要求一名海员从事必要工作，直至情况恢复正常。一旦情况恢复正常，船长应尽快地确保所有在计划安排的休息时间内从事工作的海员获得足够的休息时间。H. In order to ensure a continued safe operation of the ship in exceptional conditions, certain exceptions from the normal requirements for t
44、he rest periods are allowed provided that the rest period is not less than 70 hours in any 7 day period and on certain conditions, namely:H. 为确保在例外情况下船舶的持续安全操作，允许所规定的休息时间有例外，但在任何7天内的休息时间不得少于70小时，且：Such exceptional arrangements shall not be extended for more than two consecutive weeks;上述例外的安排不得超过连续两个

In computing overtime, a fraction of the first hour worked shall be considered as one full hour. After the first hour overtime, any work performed which is less than thirty（30）minutes shall be considered as half an hour and more than thirty（30）minutes shall be considered one full hour.A. 船员所从事的按前述规定所确定的8小时以外的工作应按加班进行补偿，加班补贴可以分为开放式、固定式、保障式。在计算加班时间应按以下方式进行：第
