4、Republic of ChinaDecember 30, 2022Article 15 If a reservist is separated from reserve service, his or her reserve rank shall be retained and preceded with retired.第十五条预备役人员 退出预备役的，其预备役军 衔予以保留，在其军衔前冠 以“退役”。Article 16 A reservist who violates military discipline may be demoted in reserve rank in accor
5、dance with the relevant provisions issued by the Central Military Commission.第十六条对违反军队 纪律的预备役人员，按照中 央军事委员会的有关规定， 可以降低其预备役军衔等 级。Where the status of a reservist is canceled in accordance with the provisions of this Law, his or her reserve rank shall be canceled accordingly; if a reservist who has comm
6、itted a crime before or after separation from reserve service is sentenced to deprivation of political rights or to a criminal penalty of not lighter than fixed-term imprisonment, he or she shall forfeit his or her reserve rank.依照本法规定取消预备役人 员身份的，相应取消其预备 役军衔；预备役人员犯罪或 者退出预备役后犯罪，被依 法判处剥夺政治权利或者有 期徒刑以上刑罚
7、的，应当剥 夺其预备役军衔。The authority to approve the cancellation or forfeiture of reserve ranks shall be the same as the authority to approve the appointment to corresponding reserve ranks.批准取消或者剥夺预备役军 衔的权限，与批准授予相应 预备役军衔的权限相同。Chapter III Selection and Replenishment第三章选拔补充Article 17 A reservist shall meet the
8、 following conditions:第十七条预备役人员IO应当符合下列条件:(1) Being loyal to the motherland and the CPC, supporting the socialist system, loving the people, and loving national defense and the armed forces.（一）忠于祖国，忠于中国 共产党，拥护社会主义制 度，热爱人民，热爱国防和 军队；(2) Complying with the Constitution and laws, and having good politic
9、al qualities and moral conduct.（二）遵守宪法和法律，具 有良好的政治素质和道德品 行；(3) Attaining 18 years of age.（三）年满十八周岁;(4) Being physically and psychologically sound to perform duty.（四）具有履行职责的身体 条件和心理素质；(5) Having the education attainment and work ability required by office.（五）具备岗位要求的文化 程度和工作能力；(6) Other conditions spe
10、cified by laws and regulations.（六）法律、法规规定的其 他条件。Article 18 Reservists shall be mainly selected and replenished from veterans, specialized technical talents, and specialized skilled talents who meet the conditions for reserve service and have registered for reserve service.第十八条预备役人员 主要从符合服预备役条件、 经过预备
11、役登记的退役军人 和专业技术人才、专业技能 人才中选拔补充。Reserve service registration shall be governed by the relevant provisions of the Military Service Law of the Peoples Republic of China.预备役登记依照中华人民 共和国兵役法有关规定执 行。ii第十九条预备役人员 的选拔补充计划由中央军事 委员会确定。中央军事委员 会机关有关部门会同有关中 央国家机关，指导部队和县 级以上地方人民政府兵役机 关实施。Article 19 Reservist selecti
12、on and replenishment plans shall be determined by the Central Military Commission. The relevant departments of the Central Military Commission shall, in conjunction with relevant central state authorities, guide the units and the military service authorities of the local peoples governments at or ab
13、ove the county level in implementing such plans.第二十条部队应当按 照规定的标准条件，会同县 级以上地方人民政府兵役机 关遴选确定预备役人员。Article 20 Units shall, in accordance with the prescribed standards and conditions, select and determine reservists in conjunction with the military service authorities of the local peoples governments at
14、or above the county level.预备役人员服预备役的时间 白批准服预备役之日起算。The time for a reservist to perform reserve service shall commence to run from the date of approval for performance of reserve service.第二H条县级以上 地方人民政府兵役机关应当 向部队及时、准确地提供本 行政区域公民预备役登记信 息，组织预备役人员选拔补 充对象的政治考核、体格检 查等工作，办理相关入役手 续。Article 21 The military s
15、ervice authorities of the local peoples governments at or above the county level shall promptly and accurately provide units with information on the reserve service registration of citizens in their respective administrative regions, organize the work such as the political assessment and checkups of
16、 the candidates for the selection and replenishment of reservists, and follow relevant procedures for membership in the units.12Article 22 Government agencies, social groups, enterprises, public institutions, township and town peoples governments, and sub-district offices shall arrange for and recom
17、mend qualified persons of their entities or within their administrative regions to participate in the selection and replenishment of reservists, based on the needs of units and the arrangements of the military service authorities of the peoples governments of counties, autonomous counties, cities no
18、t divided into districts, and municipal districts.第二十二条机关、团 体、企业事业组织和乡镇人 民政府、街道办事处，应当 根据部队需要和县、自治 县、不设区的市、市辖区人 民政府兵役机关的安排，组 织推荐本单位、本行政区域 符合条件的人员参加预备役 人员选拔补充。The recommended persons shall participate in the selection and replenishment of reservists in accordance with provisions.被推荐人员应当按照规定参 加预备役人员选拔补
19、充。Article 23 Units shall appoint selected and replenishment reservists in reserve ranks and to duty positions in accordance with provisions.第二十三条部队应当 按照规定，对选拔补充的预 备役人员授予预备役军衔、 任用岗位职务。Chapter IV Education, Training, Promotion, and 第四章 教育训练和晋升任Appointment用Article 24 The education and training ofreserv

22、ositions.第二十五条预备役人 员在被授予和晋升预备役军 衔、任用岗位职务前，应当 根据需要接受相应的教育训 练。Article 26 Reservists shall participate in military training in accordance with provisions and meet the training requirements specified in the military training program.第二十六条预备役人 员应当按照规定参加军事训 练，达到军事训练大纲规定 的训练要求。The time for annual military

Units shall organize the implementation of assessment work in accordance with provisions, and assessment results shall be used as the basis for their promotion in reserve ranks, appointments to duty positions, compensation adjust

29、ons of a unit in accordance with provisions.15A reserve conscript who has performed reserve service for a specified number of years may, upon approval, be elected as a reserve noncommissioned officer as needed by the armed forces, of his or her own volition.预备役兵服预备役满规定年 限，根据军队需要和本人自 愿，经批准可以选改为预备 役军士
30、。The authority to approve the appointment of reservists to duty positions shall be specified by the Central Military Commission.预备役人员任用岗位职务的 批准权限由中央军事委员会 规定。Chapter V Daily Management第五章日常管理Article 30 A reservist shall report to his or her unit in a timely manner on changes in the entity with which
31、he or she works, relocation, cross- border travel, serious illness, physical disability, and other important matters and changes in contact information.第三十条预备役人员 有单位变更、迁居、出国 （境）、患严重疾病、身体 残疾等重要事项以及联系方 式发生变化的，应当及时向 部队报告。Where a reservist falls under thecircumstances specified in the preceding paragrap
32、h, or is in serious violation of discipline or law, absent, or deceased, the entity with which the reservist works, and the township or town peoples government, or the sub-district office shall report in a timely manner to the military service authority of the peoples government of the county, auton

36、tion in a timely manner.第三十二条预备役人 员参加军事训练、担负战备 勤务、执行非战争军事行动 任务等的召集，由部队通知 本人，并通报其所在单位和 预备役登记地县、自治县、 不设区的市、市辖区人民政 府兵役机关。Article 32 Where a reservist is called to participate in military training, perform duties of combat readiness, or execute missions in nonwar military operations, among others, his o
37、r her unit shall notify the reservist, and give notification to the entity with which he or she works and the military service authority of the peoples government of the county, autonomous county, city not divided into districts, or municipal district where he or she is registered for reserve servic
38、e.召集预备役人员担负战备勤 务、执行非战争军事行动任 务，应当经战区级以上军事 机关批准。A call for reservists to perform duties of combat readiness, or execute missions in non-war military operations shall be subject to the approval of the military authorities at or above the theater command level.17The entities with which reservists work a
39、nd the military service authorities of the peoples governments of the counties, autonomous counties, cities not divided into districts, and municipal districts of reserve service registration shall assist in calling reservists.预备役人员所在单位和预备 役登记地县、自治县、不设 区的市、市辖区人民政府兵 役机关，应当协助召集预备 役人员。Reservists shall
40、report at the designated place according to the time specified in the call.预备役人员应当按照召集规 定时间到指定地点报到。Article 33 A reservist who participates in military training, performs duties of combat readiness, and executes missions in non-war military operations, among others, shall be managed by his or her uni
41、t in accordance with the relevant regulations of the armed forces.第三十三条预备役人 员参加军事训练、担负战备 勤务、执行非战争军事行动 任务等期间，由部队按照军 队有关规定管理。Article 34 A reservist shall wear the uniform for reserve service and clothing with reserve service insignia in accordance with the relevant regulations of the armed forces.第三十四
42、条预备役人 员按照军队有关规定穿着预 备役制式服装、佩带预备役 标志服饰。No entity or individual may illegally produce, buy, or sell the uniform for reserve service and clothing with reserve service insignia.任何单位和个人不得非法生 产、买卖预备役制式服装和 预备役标志服饰。Article 35 A reservist shall comply with the provisions on the combat readiness work of the ar
43、med forces, and be prepared for missions.第三十五条预备役人 员应当落实军队战备工作有 关规定，做好执行任务的准18备。第六章征 召Chapter VI Call-up第三十六条在国家发 布动员令或者国务院、中央 军事委员会依法采取必要的 国防动员措施后，部队应当 根据上级的命令，迅速向被 征召的预备役人员下达征召 通知，并通报其预备役登记 地县、自治县、不设区的 市、市辖区人民政府兵役机 关和所在单位。第三十六条在国家发 布动员令或者国务院、中央 军事委员会依法采取必要的 国防动员措施后，部队应当 根据上级的命令，迅速向被 征召的预备役人员下达征召 通
44、知，并通报其预备役登记 地县、自治县、不设区的 市、市辖区人民政府兵役机 关和所在单位。Article 36 After the state issues a mobilization order or the State Council and the Central Military Commission take necessary national defense mobilization measures in accordance with the law, units shall, under orders from their superiors, issue a call-u
45、p notice to reservists to be called up, and notify the military service authorities of the peoples governments of counties, autonomous counties, cities not divided into districts, and municipal districts of reserve service registration and the entities with which the reservists work.预备役人员接到征召通知 后，必须
46、按照要求在规定时 间到指定地点报到。国家发 布动员令后，尚未接到征召 通知的预备役人员，未经部 队和预备役登记地兵役机关 批准，不得离开预备役登记 地；已经离开的，应当立即 返回或者原地待命。After receiving the call-up notice, the reservists must report at the designated place within the specified time as required. After the state issues a mobilization order, a reservist who has not yet recei
