13、理论为指导策略,系统地阐述、分析、指导了“自下而上”的国际商务英语合同的汉译方法,创造性地探讨了“自上而下”的国际商务英语合同的汉译策略。全文包括下列六章:第一章是引言。概述了当前英文合同汉译的状况,存在的不足及造成这些不足的原因,并阐述了本文研究的宗旨和意义。第二章概述了合同文本的特点,介绍了合同的定义和分类,揭示了英文国际商务合同的一般特征及功用,目的在于提高译者对国际商务英语合同具体内容的认识,为翻译实践做好准备。第三章系统分析和比较了中英文商务合同文体异同点在词汇、句法及语篇三个层次上的具体体现。相同点:词汇层包括运用大量古语词、正式(法律)词汇及专业术语。句法层包括:单词类型一频繁使

14、用名词、动词及一些固定的连词、副词,很少或不用代词;句子类型一以陈述句和条件句为主,无疑问、祈使语气。语篇层则表现为词汇重复、平行结构和极少使用代词作衔接手段。不同点:词汇层:英文商务合同中常出现同(近)义词的并列使用,而中文商务合同无此特点。句法层:单词类型一英文商务合同中名词居多, 且有大量介词、冠词;而中文商务合同以动词为主;词组类型一英文商务合同中频繁使用名词结构,且多后置修饰成分,而中文商务合同以动词词组为主,多前置修饰语。第四章对德国功能主义进行了概述,并对合同翻译实践的理论指导进行了可行性分析,概述了德国功能翻译学派提出的功能主义的开始及发展过程,本学派主要代表人物的理论及其对翻

15、译领域所作出的贡献,分析了德国功能主义对于指导国际商务合同翻译在理论层面的不足和缺陷。第五章分析了以德国功能主义为理论指导的的国际商务英语合同翻译策略。从具体的翻译实践,并以国际商务英语合同的语言特征的参照,分析论证了在德国功能主义理论的理论指导下,应该给予译者在合同翻译行为中一定的决策自由;论证了译文质量的高低的翻译的标准之一不仅仅是译文的忠实性,更重要的是灵活运用各种翻译策略达到功能上的对等。在英汉合同表达形式一样的时候,可以采用传统的直译的翻译策略;在因为保留英语合同语言形式而可能会造成难以实现汉译文本功能的时候,一定要考虑汉语读者的认知和语言上的习惯,要敢于运用已有的增译、减译、转译和

16、省译等策略;根据英语合同语言的特点(如古语词、复杂长句、平行结构等)则可创造性地采用公式化翻译、分译、合译、套译等翻译策略,以实现国际商务合同汉译文本的实际效果,大大提高合同翻译的质量。第六章是结论部分。总结全文,指出研究的局限性,提出进行相关研究的建议。关键词:功能主义;翻译策略;翻译行为;合同语言; ABSTRACTIn view of the unsatisfactory translation of international business contracts nowadays, this paper breaks away from the traditional study m

17、ethod of contract translation which merely focuses on the linguistic features of contracts, and adopts the framework of German functionalism in the research on business contract translation. By adopting the top-down approach first advocated by Christian Nord as the dominant principle, the author int

18、ends to find out translation strategies which are able to realize the translation skopos and text functions of contracts at macro level. Then, under the guidance of functionalism, the author makes study of contract translation methods in the bottom-up process in dealing with the linguistic features

19、of contract at the micro level to make the translation version precise and accurate. The paper is composed of five chapters.Chapter one is to introduce the present situation of the E-C international business contract translation, analyzing the causes of the unsatisfactory contract translation and em

20、phasizing the necessity of the current research.Chapter two introduces the definitions and classification of contract and reveals general features and the functions of the international business English contracts. The author points out that the first step is a full understanding of a contract when d

21、o contract translation.Chapter three makes a detailed comparison between English and Chinese business contracts as to similarities and differences at three levels. Similarities: 1 ) at the lexical level: frequent use of archaic words, formal or legal words and unique terminologies; 2) at the syntact

22、ic level: preference for verbs and nouns, a limited number of conjunctions, adjectives and adverbs, rare use of pronouns; dominance of declarative sentences and conditional clauses, with no interrogative and imperative sentences; 3) at the textual level: repetition of words and rare use of pronouns

23、as cohesive devices and frequent use of parallel structures in terms of layout. Differences一1 ) at the lexical level: English business contracts often employ the parallel synonyms while Chinese versions never allow such a feature; 2) at the grammatical level: English business contracts prefer nouns,

24、 prepositions and articles, while fewer prepositions in Chinese versions. In addition, English business contracts prefer nominal groups and post-modifiers while in Chinese business contracts verb phrases and pre-modifiers are more frequently used.Chapter Four is the literature review of the developm

25、ent of functionalism, the representative scholars of functionalism and their contributions to the translation theory. The author further analyzes the theoretical feasibility of applying functionalism to the E-C international business contract translation.Chapter Five is the study on the strategies f

26、or the E-C international business contract translation under the guideline of functionalism. If we want to realize the communicative skopos of the TT , the starting point is to select strategies according to functionalism, different translation strategies should be adopted to treat different factors

27、. If the retained structure of the English contract is incompatible with that of the target language and unacceptable to the target text receivers, we should adopt flexible translation methods such as shift, conversion, omission, amplification, etc. As for translation of the modal verb “shall”, omis

28、sion, combination or formula translation methods are chosen depending on its meaning in different situations. For archaism translation, formula translation is the most applicable strategy. For lengthy sentences division and combination is usually preferred. Omission or amplification is adopted respe

29、ctively after classifying two kinds of parallel usage of synonyms.Chapter Six is the conclusion of the thesis. In the recent decades, stud

39、ies on contract translation usually adopt the bottom-up approach, which mainly focuses on the language features and views translation as a code-switching process. The special language features of legal documents (including business contracts) differ with those of other language varieties, such as sc

40、ience language, literature language, etc., in style and in structure. How to translate such a special text variety has drawn scholars special attention recently with Chinas entrance to the WTO. It marks a new era of Chinas globalization process and thereafter brings forth an urgent need of the succe

41、ssful translation of contract documents to make a step forward to the international markets. However, it is regretful that the quality of the current E-C contract translation isnt so satisfactory. Translation errors or mistakes occur in the E-C contract translation because of following reasons:First

42、ly, the target text cant keep fidelity to the source text (thereinafter shorted as the TT and the ST).According to him, contract documents are documents carrying legal effects and should fall into the category of the Black Letter Law (refers to the basic standard elements for a particular field of l

43、aw, which are generally known and free from doubt or dispute).In his opinion, fidelity is the foremost translation criteria of contract translation. He advocates the literal translation strategy as the preferable contract translation strategy to keep the linguistic structures and the semantic meanin

44、g of the TT equivalent to those of the ST.Secondly, contract language features are complicated and distant form Chinese receivers as well as the contract translator. He calls for translators to pay special attention to contract language features at the lexical, syntactic and textual levels, for example, to identify clearly the relationship of multi-level attributives to avoid translation mistakes.Last but not least, some contract translato
