1、河南省交通执法人员应知应会知识点 一、当前，最新的治超政策有哪些？答：一是 或交通的执法人员均可在固定检测站引导车辆。二是 部门单独处分或扣分，交通部门负责称重检测并监督消除违法状态，不得重复处分。三是流动治超必须、交通联合执法，交通执法人员不单独上路检查超限超载货运车辆。四是交通部门的治超重心在源头监管。五是要配备和使用执法记录仪，实现执法全过程记录。六是在装载源头和非现场执法等处分时必须实施罚缴别离等。二、“一超四罚”的概念是什么？答：部门和交通部门在执法中发现超限超载车辆，除依法责令卸载并处分记分外，应将有关信息抄送运管部门，由运管部门依法对货运车辆和驾驶人、运输企业实施处分。并由交通运
2、输执法机构依法对货运场所经营者实施处分。三、信息抄告的主要内容是什么？答：违法超限运输案件处理完毕后，必须在7个工作日完成信息抄告。主要内容一是车辆的号牌号码、车型、车辆所属企业、道路运输证号信息；二是驾驶人的姓名、驾驶人从业资格证编号、驾驶人所属企业信息；三是货运源头单位、货物装载单信息；四是行政处分决定书信息；五是与案件相关的其他资料信息。四、信用体系约束的程序有哪些？答：一是交通运输执法机构作出行政处分决定7个工作日内，将信息在本级网站公示，并通过系统逐级上报，在省厅信用平台予以公示并同步至信用河南；二是按照交通运输部界定的10种行为，每季度报送严峻违法失信行为责任主体，逐级审核，由交通
3、运输部汇总公示，并联合国家发改委、中国人民银行等36个部门实施联合惩戒。五、固定超限检测站联合执法有哪些规定？答：经省政府批准实行驻站联合执法的固定超限检测站，由交通部门负责称重检测并监督消除违法行为，部门单独实施处分和记分。未实施驻站联合执法的，由交通部门负责称重检测和监督消除违法行为，并通知 部门，部门要及时到站实施处分和记分。要在站前设置货车检测通道和交通标志，并设置电子抓拍系统。车流量大的，还要设置预检设施。对货车逃避检测的，部门要依法处分。六、超限检测点应具备哪些条件？答:超限检测点是开展流动联合执法时实施现场检查处分的重要场所，应符合功能定位、选址、标志标线、外观、场地、称重设备等
4、六个方面的具体要求，方便对超限超载车辆及时就近开展检测认定和违法问题整改，并由省级人民政府批准设置。七、执法“六公示”的内容有哪些？答：交通运输执法机构应将执法主体、执法依据、执法程序、执法监督、执法结果、当事人权利等相关信息进行全面公示。八、哪几种特殊车辆暂不作处理？答：1.车货外廓尺寸超限，暂不进行检查。2.危险化学品运输车辆违法超限超载的，由 机关依法处分。3.运输鲜活农产品车辆违法超限超载运输的，暂不实施处分。4.载运标准集装箱挂车列车和低平板半挂车等特殊车辆，近期以查车货总质量超限为主，暂不检查外廓尺寸。九、联合执法纪律“十不准”包括哪些？答：不准制定和执行与全国统一超限超载认定标准
5、不一致的地方标准；不准无执法资格人员实施行政处分、行政强制措施等执法行为；不准超出法律法规规章规定的范围实施行政检查和行政处分；不准制定和执行罚款收缴合并的制度；不准利用职务便利，以各种形式收受当事人及其托付人财物；不准对同一违法行为进行重复罚款；不准对违法超限超载车辆只罚款不卸载；不准违规收取超限检测费、停车保管费、通行费等费用；不准超期扣留违法超限超载车辆不作处理；不准在公路超限检测站（点）以外现场处分车辆超限超载违法行为，原则上所有对货车超限超载违法行为的现场检查处分一律引导至公路超限检测站（点）进行。十、如何做好执法监督和执法服务工作？答：健全执法监督制度体系，畅通社会监督渠道，充分发
