2、同协议法、山东省劳动合同协议 条例,甲乙双方经平等协商同意,自愿签订本合同协议,共同遵守本合同协议所列条款. 4、eriod from to.2、工作内容 Work Contents第2条协议乙方同意根据协议甲方工作需要,担任指定的 岗位(工种)工作,以及其他由协议甲方指定的兼职工作和临时工作.工作地点为:XX市XX区XXXXX 路1号.Party B is willing to work as according Party A5s requirements andother part-time and temporary work required by Party A. Work place: No.1 Wild Road, Development Zone, Rizhao.第3条协议乙方必须按照协

5、议甲方的合法要求才安时完成规定的工作数量,达到规定的质量标准.Party B should fulfill all the work in time and by quality standard according to Party A5s legal requirements.3、劳动保护、劳动条件、工作时间和休假 Work Protection, Condition, Time and Leaves 第4条协议甲方安排协议乙方执行8小时/日工作制,协议甲方依法保证协议乙方的休息权利,协议乙方在劳动合同协议履行期间依法享受法定节假日以及探亲假、婚丧假、 产假、带薪年假等休假权利.协议甲方安

6、排协议乙方每日工作时间不超过8小时,每周工作5天,平均每周不超 过40小时,协议甲方保证协议乙方每周休息2天,因特殊原因需要延长工作时间的, 在保障协议乙方身体健康的条件下,甲乙双方友好协商执行,原则上每月不超过24 小吐There are 8 working hours per Day. Party A promises rest time to Party B according to the laws. Party B has the right to enjoy the legal vacation, home leave, marriage and mourning leave, m

7、aternity leave and legal paid vacation, etc.Party A arranges Party B to work maximum 8 hours per day and 5 days every week, and the average work hours per week should be not more than 40 hours. Party A gives Party B 2 days vacation every week. Because of special reasons Party B needs to work over-ho

8、urs on the basis of normal health condition, after agreement of two parties. Basically it should not be more than 24 hours every month.第五条协议甲方安排协议乙方加班的,应安排协议乙方同等时间补休或依法支付加班工资;加点的,协议甲方应付加点工资.If party A requires party B to do overtime work, Party A should give the equal time leave in some other time o

9、r give overtime payment according to law; if party B needs to work in extension hours, Party A should pay for the extension hours. 第六条协议甲方为协议乙方提供必要的劳动条件和劳动工具,建立健全的生产工艺流程, 制定操作规程、工作规范和劳动安全卫生规章及其标准.Party A should provide the necessary work conditions and tools, build up complete production process and

10、 make operation regulations, rules and safety system and standards.第7条协议甲方负责对协议乙方进行政治思想、职业道德、业务技术、劳动安全卫生及有关规章规章的教育和培训.Party A should arrange to give the necessary training for Party B about political thoughts, professional morality, operation skills and operation safety and regulations.4、劳动报酬 Work p

11、ayment第8条协议乙方应按照协议甲方的要求完成相应的工作,协议甲方应根据按劳分配、效率优先、兼顾公平的原则,按照国家规定和协议甲方依法制定的工资分配办法等规章 规章按月以货币形式支付协议乙方的工资,每月7日前公司为干部及员工支付上月 工资(遇节假日则顺延).协议甲方支付协议乙方的试用期工资标准为:元/月,试用期过后为 元/月,工资额度必须对第3者保密,甲乙双方都应严格遵守.Party B fulfills the work according to the requirements of Party A. Party A should give the payment in cash ev

Every month before 7th, Party A should pay Party Bs salary of last month(if there is holiday, the paid date will be postponed). Party Bs probati

Both parties must keep the salary as a confidential matter to third party.第9条由于协议甲方生产任务不足,使协议乙方待岗的,协议甲方保证协议乙方的月生活费不低于日照市最低生活保障.If Party A doesnt have enough work task and Party B have no work to do, Party A should gives Party B the

14、 living allowance which should not be less than Rizhao Minimum living guarantee.5、保险福利待遇 Insurance and welfare第10条甲乙双方应按国家和山东省社会保险的有关规定交纳职工养老、失业和大病医疗统筹及其他社会保险费用.协议乙方应缴纳的部分按照法律法规应有协议甲方 代扣代缴的,由协议甲方从协议乙方工资中代为扣缴.协议甲方应为协议乙方填写职工养老保险手册.双方解除、终止劳动合同协议 后,职工养老保险手册按有关规定转移.Party A and Party B should pay endowmen

15、t insurance, unemployment insurance and serious illness insurance and other social insurance as national and province regulations about insurance. The Part which should be paid by Party B should be withheld from salary by Party A.Party A should fill in Employee Endowment Insurance Handbook for Party

After the termination of the contract, Employee Endowment Insurance Handbook should be handed over according to relevant regulations.第101条协议乙方患病或非因工负伤,其工资按照国家已经制定相关规定执行.If Party B gets ill or gets hurt not because of work, then his/her salary should be calculated according to relevant national r

17、egulations.第102条 协议乙方患职业病或因工负伤的工资和医疗保险待遇按照国家和山东省有关规定 执行.If Party B gets occupational disease or gets hurt because of work, his salary and medical insurance should be calculated as relevant national and province regulations.6、劳动纪律 Work Disciplines第103条协议乙方应遵守协议甲方依法制定的规章规章,严格遵守劳动安全卫生、生产工艺、操作规程和工作规范,以及

18、劳动合同协议附件及职工保密合同协议书,爱护协议 甲方的财产,遵守职业道德;积极参加协议甲方组织的培训,提高思想觉悟和职业技 能.Party B should follow Party As disciplines and rules, following close to the line of operation safety requirements, process, operation rules and regulations, Appendix to Labor Contract and Employee Secret-Keeping Agreement. Party B shou

19、ld protect companys property, follow professional morality; Party B should be active to attend the training organized by Party A to increase professional skills.第104条 协议乙方违反劳动纪律,协议甲方可依据本单位规章规章,给予纪律处分,直至解除本 合同协议.If Party B violates disciplines or regulations, Party A could give the penalty according

20、to the companys regulation or rules, or even to end the contract.7、劳动合同协议的变更、解除、终止、续订Change, terminate, end or renew the contract 第105条 订立本合同协议所依据的法律、行政法规、规章发生变化,本合同协议应变更相 关内容.If the relevant laws, regulations or rules have changed, this contract will be changed accordingly as well.第106条订立本合同协议所依据的客

21、观情况发生重大变化,致使本合同协议无法履行的,经甲乙双方协商同意,可以变更本合同协议相关内容.If the objective circumstance has changed a lot, which makes it not possible to continue this contract; after agreement of the two parties, the contract could be modified accordingly.第107条协议乙方有下列情形之1的,协议甲方可以解除本合同协议:Party A could end the contract with Pa

22、rty B, If Party B:1、在试用期间,被证明不符合录用条件的;It is proved during the probation period that Party B is not qualified for the work and employment;2、严重违反劳动纪律或协议甲方规章规章的;Materially violate Party A5s rules and regulations;下列行为属于严重违反协议甲方劳动纪律或规章规章的行为:Those following actions belong to materially Violation:(1)在工作期间饮

23、酒的;Drinking during the work time;(2)连续旷工超过15天或1年内累计旷工超过30天的;Absent from work continue for 15 days or more than 30 days total for one year.(3)协议乙方是驾驶员的,因其自身原因,其营运服务的证、照被吊扣或失效 15天(含)以上的或发生行车事故次要责任(含)以上的;If Party B is driver, because of his mistake, the car or car license is caught by police or go out

24、of valid period for more than 15 days (including), or in accident Party B take more than subordinate responsibility (including).(4)在工作场所打架斗殴、妨碍干扰正常工作秩序及违犯社会治安管控条例 的;Fight on working place, disturb normal working system, and violate society safety management regulation.(5)协议乙方以欺诈、胁迫的手段,使协议甲方在违背真实意思的情

25、况下订立 或者变更合同协议的;Party B sign or change the contract with party A without the willing theParty A by cheating or threating.(6)在劳动关系存续期间,与其他用人单位(或个人)建立劳动关系或发生劳 务关系的;During the contract Period, Party B does work for any other third employment Party.(7)在工作期间搞其他产业或第2职业的,在工作时间内做与工作无关的事 情;During work time, P

26、arty B does other work or secondary job, or any other work which is not related to his duty.(8)协议乙方在招聘录用时所填个人履历和档案等有关内容不真实,提供虚假 信息的.包括但不限于:离职证明、身份证明、户籍证明、学历证明、体 检证明等是虚假或伪造的;应聘前患有精神病、传染性疾病及其他严重 影响工作的疾病而在应聘时未声明Party B gives the false information when filling in the Company Entrance Form, including but

27、 not limited to, Dimission Prove, ID prove, Residence Prove, Education Prove, Physical Checking Prove; have serious mental disorder, infected illness or other illness which affects his work.3、严重失职、营私舞弊,对协议甲方利益造成重大损害的(包括但不限于 因个人故意或过失,1次给协议甲方造成3000元以上损失或连续12个月 内累计造成5000元损失的);Commits serious derelictio

28、n of duty or practices graft, causing substantial damage to the Party A (including but not limited to the loss of 3000Yuan by one time or total 5000Yuan within continue 12 months caused by Party Bs deliberately or fault);4、被依法追究刑事责任的.Has his criminal liability pursued in accordance with the law.第108

29、条下列情形之1,协议甲方可以解除本合同协议,但应提前310日以书面形式通知协议乙方:If one of the following situations applies, Party A could terminate the contract, but has to inform Party B 30 days in advance by written:1、协议乙方患病或非因工负伤,医疗期满后,不能从事原工作也不能从事由协 议甲方另行安排的工作的;After the recovering period of medical care for an illness or non-work-r

30、elated injury, Party B can engage neither in his original work nor in other work arranged for him by Party A.2、协议乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;Party B is incompetent and remains incompetent after training or adjustment of his position.3、双方不能依据本合同协议第107条规定就变更合同协议达成合同协议的.Two parties can not reach the

31、 agreement to modify the contract as contract Item 17.第109条协议甲方濒临破产进行法定整顿期间或者生产经营发生严重困难,经向工会或 者全体职工说明情况,听取工作或者职工的意见,并向劳动行政部门报告后,可 以解除本合同协议.During restructuring period pursuant to the Enterprise Bankruptcy Law or Serious difficulties in production and/or business operations, after Party A has explain

32、ed the situations to its Labor Union or to all of his employees, and has considered the opinions of the Labor Union or the employees and has subsequently reported to the labor administration department, Party A may terminate the contract.第210条协议乙方有下列情形之1的,协议甲方不得依据本合同协议第108条、第109条终止、解除合同协议:Party A ma

33、y not terminate an employment contract pursuant to Article18 or Article 19 hereof if Party B:1、患病或非因工负伤、在规定的医疗期内的;Has contracted an 川ness or sustained a non-work-related injury, and the recovering period of medical care therefore has not expired;2、女职工在孕期、产期、哺乳期内的;Is a female employee in her pregnanc

34、y, maternity or breast feeding period 3、在本单位连续工作满105年,且距法定退休年龄不足5年的;Has been working for the Employer continuously for not less than 15 years and is less than 5 years to his legal retirement age4、法律法规规定的其他情形.Other situations pursuant to Laws or regulations.第2101条协议乙方患职业病或因工负伤,医疗终结,经市、区、县劳动鉴定委员会确认完 全

35、或部分丧失能力的,按劳动合同协议法有关规定办理,不得依据本合同协议 第108条、第109条解除劳动合同协议.Party B Has been confirmed as having complete lost or partially lost his ability to work due to an occupational disease contracted or a work-related injury sustained with the Employer, after diagnosed by City, Zone, County Labor authentication Co

36、mmittee ,Party A should not terminate the contract as Article18,19, but should follow relevant regulations.第2102条 协议乙方解除本合同协议,应当提前310日以书面形式通知协议甲方.If Party B wants to terminate the contract, he/she should inform Party A by written 30 days in advance.第2103条 有下列情形之1的,协议乙方可以随时通知协议甲方解除本合同协议:Party B may t

37、erminate the contract in any time under the one of the following situations:1、在试用期内的;During the probation period2、协议甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;Party A forces or threats Party B to work or illegally restrict freedom of Party B.3、协议甲方不能按照本合同协议规定支付劳动报酬或者提供劳动条件的. Party A can not pay or provide work cond

38、itions as Contract.第2104条本合同协议期限届满,甲乙双方经协商同意,可以续订劳动合同协议.After the termination of the contract, Party A and Party B could renew the contract after discussion and agreement.第2105条订立无固定期限劳动合同协议的,协议乙方离休、退休、退职及死亡或本合同协议约定的解除条件出现,本合同协议终止.If the contract is open-ended contract, when Party B has leaved, reti

39、red,died or other factors which would end the contract as we mentioned in the contract, this contract can terminate.第2106条协议乙方承诺已知悉了协议甲方的各项规章规章,并保证在任职期间认真学习协议甲方制定的各项规章规章.Party B should promise that he has know all the rules and regulations of Party A and promise to learn all the rules and regulation

40、s during work period.8、劳动争议处理 Disputation settlement第2107条因履行本合同协议发生的劳动争议,当事人可以向本单位劳动争议调解委员会申请调解;调解不成,当事人1方要求仲裁的,应当自劳动争议发生之后向劳 动争议仲裁委员会申请仲裁.当事人1方也可以直接向劳动争议仲裁委员会 申请仲裁.对裁决不服的,可以向人民法院提起诉讼.If there is any labor disputation during the performance of the contract, the party could apply for the settlement

41、to company intermediation department. If it still can not been settled and one party wants arbitration, then he should apply for arbitration to Labor Arbitration Committee after the disputation. The party also could ask for the arbitration directly. If one party is not agreed to the arbitration, he

42、could go to the court.9、其他 Others第2108条本合同协议未尽事宜或与今后国家、山东省有关规定相悖的,按有关规定执行.Those items which have not mentioned in this contract or go against with future national and province regulations would be performed as relevant regulations.第2109条本合同协议1式两份,甲、乙双方各执1份.This contract has two copies, one for each party.协议甲方Party A(盖章stamp) 法定代表人Member as of right 或委托代理人(签章)or Authorized person(signature)协议乙方Party B(签章stamp)签订日期Date:
