9、visor and the designer to conduct the joint drawing review and technical disclosure prior to the commencement date.应当及时协调处理施工场地周围地下管线和邻近建筑物、构筑物 (包括文物保护建筑)、古树名木的保护工作，并承担有关费用。7.1.13 Shall coordinate and handle without delay the protection of underground pipelines and adjacent buildings, structures (in
10、cluding cultural relics protected buildings) and ancient or famous trees, in addition to bear the relevant expenses.为避免正常施工时产生的噪音、震动、光线等因素导致周围的 居民和公众对工程进展造成影响，发包人应当及时采取合理措施对施工 场地周围的居民和公众进行协调并在必要时支付补偿金。7.1.14 For the purpose of avoidance of noise, vibration, light and other factors arising from or ou
11、t of normal construction causing the surrounding residents and the public to affect the progress of the Works, the Employer shall take reasonable measures without delay to coordinate and, if necessary, pay compensation to the residents and the public around the construction site.1.1.1 在承包人按照合同实施完成本工
12、程达到实际竣工的标准，并办 理本工程相关竣工验收手续后，发包人应当接收承包人交付的工程及现 场。7.1.15 The Employer shall take delivery of the Works and the Site from the Contractor upon completion of the Works by the Contractor to the standard of practical completion in accordance with the Contract and handling the relevant procedures of complet
13、ion and acceptance thereof.7.1.16 为了工程的顺利实施，在承包人请求协助并承担相应费用的前 提下，发包人应当给承包人以协助，但不免除承包人的责任。7.1.17 For the purpose of smooth execution of the Works, the Employer shall give assistance to the Contractor which, if only requests such assistance and bears the appropriate costs, however shall not relieve it
14、 of his responsibility.7.1.18 为确保本工程的顺利实施，应当保持发包人代表及相关管理人 员、监理人的稳定性。7.1.19 For the purpose of ensuring the smooth execution of the Works, the stability of the Employers representative, the relevant management personnel and supervisors should be maintained.7.1.20 其他义务见合同条款专用部分。7.1.21 Other obligation
15、s refer to the particular conditions of the Contract7.2发包人代表7.2 The Employers Representative发包人代表721 The Employers Representative在本合同履行期间，发包人应当任命一名代表常驻现场，以代表发包人 行使和履行本合同约定的发包人的所有权利和义务。发包人代表的姓名 见”合同条款专用部分。承包人提交给发包人代表的任何请示、函件或报审资料等，均视为已有 效的提交给了发包人。The Employer shall, during the performance of this con
16、tract, make appointment of a residential representative on the site to exercise and perform its all rights and obligations hereunder on behalf of the Employer. The name of the Employers representative is given in the the particular conditions of the Contract.Any requisition, correspondence or inform
17、ation submitted by the Contractor to the Employers Representative for approval, etc., shall be deemed to have been validly submitted to the Employer.发包人代表所做出的任何通知、指示、同意、批准、证书及决定等,均 视为由发包人所做出。承包人应当遵循发包人代表的指令。发包人有权随时变更或撤销关于发包人代表的委派。任何此类的变更或 撤销均应当以书面形式通知承包人及其他相关单位,并在到达承包人及 其他相关单位时生效。Any notices, instru
18、ctions, consents, approvals, certificates and decisions issued by the Employers Representative shall be deemed to have been given by the Employer.The Contractor shall follow the instructions of the Employers Representative.The Employer shall, at any time, be entitled to change or revoke the appointm
19、ent of its representative. Any such change or revocation thereof shall be notified in writing to the Contractor and other relevant parties and shall take effect upon receipt thereof by the Contractor and other relevant parties.7.2.1 发包人代表的权力委托Power Authorization of the Employers representative 发包人代表
20、可在需要时，将权限范围内的权力和职责委托给他的助理执 行，并可随时撤销任何此类委托。发包人代表的权力委托或撤销均应当采取书面形式，并在到达承包人时 生效。发包人代表助理按照上述委托内容做出的任何决定、指令、检查、审核、 检验、同意、批准或类似行为，应当视同是发包人代表做出的。The Employer7 s representative may delegate the execution of the powers and duties within his authority to his assistants as and when required, and may revoke any
21、 such delegation at any time.Any delegation or revocation of authority by the Employers representative shall be in writing and shall take effect upon receipt thereof by the Contractor.Any decision, instruction, inspection, review, examination, consent, approval or similar act made by the assistant t
22、o the Employers representative in accordance with the above delegation shall be deemed to be made by the Employers Representative.8.承包人 8. Contractors承包人义务 8.1 Obligations of the Contractor承包人应当按照合同文件约定全面履行合同义务，并承担相应的费用。 其义务包括但不限于：The Contractor shall fully perform its contract obligations in accord
23、ance with the contract documents and bear the corresponding costs. Its obligations include, but are not limited to:8.11 在履行合同过程中应当遵守任何适用的法律、法规、规章和规范 性文件。8.1.1 Any applicable laws, rules, regulations and normative documents shall be complied with in the performance of the Contract.8.1.2 应当严格按照合同进行工程实
24、施、竣工和修补质量缺陷。8.1.3 Works shall be carried out, completed and quality defects repaired in strict accordance with the contract应当对本工程的工程质量负全面责任，但属于非承包人原因造成 的本工程缺陷和质量事故的责任除外。承包人按照设计文件进行施工时，如果依据自身专业知识和经验而判断 将会产生质量缺陷，则有义务将情况及时向监理人报告。8.1.4 Shall take full responsibilities for the quality of the Works, excep
25、t for defects and quality incidents in the Works which are the reasons unaccountable to the Contractor.The Contractor shall, when carrying out the work in accordance with the design documents, be obliged to inform, without any delay, the Supervisor of any defects in quality which he judges on the ba
26、sis of his professional knowledge and experience.8.1.5 应当为完成本工程而设置合理可行的现场组织机构，并委派具备 相应岗位资格的管理人员。除非与发包人书面协商一致，承包人不得更换或撤回主要管理人员。8.1.6 Shall establish the reasonable and practicable site department for the completion of the Works and appoint the management personnel with appropriate job qualifications,
27、 which should not be replaced or withdrew except to written agreement with the Employer.8.1.7 依法确定和使用具有相应资质的劳务企业，及时足额支付劳务费 用。8.1.8 To identify and employ the labor enterprises with the appropriate qualifications in accordance with the law and pay labor costs in full and on time.8.1.9 合同下特殊工种的操作人员应当受
28、过专门的培训并已取得有关 管理机构规定的岗位证书。8.1.10 The operators of special trades hereunder shall have received special training and hold the job certificate as prescribed by the relevant regulatory authority.8.1.11 当按照合同文件约定的工作内容和施工进度要求，编制施工组 织设计，并对整个现场的施工组织和施工方案的适用性、完备性和安全 可靠性全面负责。8.1.12 The construction organizati
29、on design shall be prepared in accordance with the work content and construction schedule requirements specified in the contract documents and shall be fully responsible for the suitability, completeness and safety and reliability of the construction organization and construction program for the who
30、le site.13.4进度报告Progress report13.4.1 除非合同文件另有约定，承包人应当在合同履行期间，按照监 理人要求的时间间隔和内容，及时提交工程的进度报告与进度图片，记 录工程的每日进展或阶段进展，其相应费用已包含在合同价款中。13.4.2 Unless otherwise specified in the Contract documents, the Contractor shall, at such intervals and in such detail as the Supervisor may require during the performance
31、hereof, submit the progress reports and progress pictures of the Works, record the daily progress or progress in stages of the Works, the corresponding costs of which have been included in the Contract Price.13.4.3 进度报告的格式和内容应当获得监理人的同意，内容可包括： (1)每一阶段的工程进展情况的照片与详细说明； (2)反映工程进展情况的任何必要的图表；(3 )主要材料和工程设备

38、in accordance with the schedule and the measures being taken (or intended to be taken) to eliminate such factors.(7) Other requirements refer to the particular conditions of the Contract.14 .合同工期 14. Contract duration除非合同文件另有约定，合同工期中已包括政府规定的不可进行 夜间或节假日施工因素等对工期的影响。14.1 Unless otherwise specified in t
39、he Contract documents, the duration of the Contract includes the effect on the duration of the Contract such as prohibition specified by the Government for working in night or holiday.14.2 鉴于本工程划分不同区段，各区段的工期见合同条款专用部分。14.3 In consideration of the different sections of the Works, the duration of each
40、section refer to the particular conditions of the Contract.15 .开工及延期开工Commencement of work and extension of work15.1 进场开工Entry of site and commencement of work发包人应当委托监理人在确定的开工日期7天前以书面形式向承包人 发出开工通知，承包人应当按照监理人发出的开工通知中确定的时间开 工。发包人应当在该时间以前完成第项和第项约定的义务。 The Employer shall, seven days prior to the date fi
41、xed for commencement of work, entrust the Supervisor to issue the commence notice in writing to the Contractor which shall commence work at the time fixed in the commence notice issued by the Supervisor. The Contractor shall, prior to the said time, complete the obligations specified in articles 7.1
42、.7 and 7.1.9.包人提供所需图纸，应当依据实际延误情况延长合同工期并为承包人追 加由此而发生的额外费用。Provided that the progress of the Works has been or will be affected by the Employers failure to provide the Contractor with drawings on time, the Contractor may notify the supervisor and the Employer in writing of the specific details of the
43、missing drawings, the effect on the progress of the Works and the latest time by which the drawings should be provided. Where the Employer still fails to provide the Contractor with the required drawings, the contract period shall be extended and additional costs incurred by the Contractor as a resu
44、lt of the actual delay. 6.3由承包人设计的永久工程的图纸Drawings of the permanent works designed by the Contractor6.3.1 如果合同文件中约定部分永久工程由承包人负责设计，承包人应 当具有相应的设计资质或委托具有相应设计资质的单位进行设计，并对 工程设计的质量负责。承包人同时应当将相关图纸、规范、计算书及其 他资料报监理人，并经监理人报发包人、设计人或相关图纸审批单位批 准。6.3.2 Where the design of part of the permanent works, as agreement
45、of the Contract Documents, is the liability of the Contractor, the Contractor shall have the appropriate design qualification or commission a unit with the appropriate design qualification to carry out the design and shall take the responsibility for the quality of the design of the works. The Contr
46、actor shall at the same time submit relevant drawings, specifications, calculations and other information to the supervisor through which submit the Employer, the Designer or the relevant drawing approval unit for approval.6.3.3 承包人还应当依据竣工资料的相关要求将详细的使用维修手册以 及竣工图纸等报监理人。6.3.4 The Contractor shall also
47、 submit to the supervisor the detailed use and maintenance manual and as-built drawings in accordance with the relevant requirements for as-built information.6.4 加工图、大样图、安装图及协调配合图Machining drawings, general drawings, installation drawings and coordination drawings6.4.1 按照工程技术规范的相关要求需要制作加工图、大样图、安装图、
48、协调配合图等图纸的，承包人应当制作，并在开始施工前报监理人审批, 在获得监理人批准后按图施工。此类批准并不能解除承包人根据本合同 约定应当承担的责任。Provided that the drawings such as machining drawings, general drawings, installation drawings, coordination and coordination drawings are required to be prepared in accordance with the relevant requirements of the technical
