1、 关于房屋买卖的合同范文模板(中英文版) 房屋买卖居间合同 BROKERAGE CONTRACT OF REAL PROPERTY PURCHASE 甲 方(卖方): Party A (Seller): 乙 方(买方): Party B (Buyer): 丙 方(居间方): Party C (Agent): 信用的原则,共同托付丙方代理并见证甲乙双方之间的买卖行为,经甲、乙、丙三方协商一 致,共同订立本合同,以兹各方共同遵守。 Pursuant to relevant laws and regulations of the Peoples Republic of China and relev

2、ant rules of Beijing Municipality, Party A and Party B entrust Party C to act as their agent for the sales between Party A and Party B and bear testimony to the afore-said transaction in principle of voluntary, fairness and honesty. Through friendly negotiation, Party A, Party B and Party C hereby a

3、gree to enter into this Agreement and abide by it jointly. 第一条 房产成交Sales purchase of the property 甲方自愿将自有的房屋产权有偿转让给乙方。该房产符合北京市建立治理委员会制定的房屋 上市标准,甲方出售该房屋时亦同时将该房屋已分摊的土地使用面积和土地使用期限转让给 乙方。房屋详细状况如下: Party A agrees to sell the property to Party B. The property is qualified for sale in the market in accorda

4、nce with the regulation of Beijing Municipal Construction Committee. Together with the sales of the property, the allocated land area for the property and the usable term of the land is transferred to Party B jointly. The property is described as: 1、甲方依法取得的房屋产权证号为: ; Serial no. of the title certific

6、件二); Together with the title of the property, facilities and interior decorations to be transferred are as described in Appendix (1); 5、甲方保证已照实陈述该房产权属状况、装饰状况和相关关系,乙方对甲方上述转让房产 的详细状况充分了解,自愿买受该房产; Party A shall guarantee that it has completely disclosed the facts about the property, including but not l

7、imited to the title, decoration and relevant information; Party B has fully understood the facts and agrees to buy the property voluntarily. 6、房屋共有人及共有人意见:Co-owners of the property and intention for the sale 房屋共有人:指对房屋共同享有全部权的两个或两个以上自然人、法人或其他组织的共有 人。 property together. 其次条 成交价格及付款方式Sales price and t

This deposit will be released only when the title transfer from Party A to Party B is completed and the property handover has been concluded, and the deposit will be released together with the remaining payment to Party A. To do this, Party A and Party B need to si

12、gn a separate Escrow Agreement with Century21 Beijing Region. 剩余款项的支付:Payment method of the remaining amount 监管账户即视同乙方已履行向甲方给付定金和房款的义务。 Party A and Party B hereby agree that, for the afore-said method (b), once the escrow fund is deposited in the escrow account of Century21 Beijing Region, it is dee

13、med that Party B has performed its payment obligation of deposit and the sales price. 2、银行贷款Mortgage (1)乙方应在签订本合同当日,预先支付总房款的 %,作为保证双方履行合同的定金; (2)乙方应在签订本合同 日内,另行支付 款),一并作为首付款(首付款金额根据贷款银行的贷款条件不得低于房屋总价款的 %)。 Within _ days after signing of this Agreement, Party B shall make up the rest part of the down

This deposit will be released only when the title transfer from Party A to Par

16、ty B is completed and the property handover has been concluded, and the deposit will be released together with the remaining payment to Party A. To do this, Party A and Party B need to sign a separate Escrow Agreement with Century21 Beijing Region. 同时,甲、乙双方在此严肃确认:前述由21世纪不动产北京区域分部进展的资金监管款项, 一经进入资金监管账

17、户即视同乙方已履行向甲方给付定金和首付房款的义务。 Party A and Party B hereby agree that, for the afore-said method (b), once the escrow fund is deposited in the escrow account of Century21 Beijing Region, it is deemed that Party B has performed its payment obligation of deposit and the down payment. 乙方采纳银行贷款的方式支付剩余房款,由21世纪

18、不动产北京区域分部供应统一的金融按 揭效劳,乙方须与21世纪不动产北京区域分部另行订立贷款托付协议。 If Party B makes the remaining payment with bank mortgage, Party B shall sign a separate Entrusted Payment Authorization with Century 21 Beijing Region for its mortgage services. 1) 经办理贷款的银行审批,乙方符合贷款条件的,贷款银行依据乙方签署的托付付款授 权书将款项一次性划至甲方在同行开设的专用结算帐户。 If

19、Party B satisfies the criteria of getting the mortgage loan through the examination of the lending 2) 方式解决: In case Party B does not satisfy the criteria of getting the loan through the examination of the lending bank, Party B will choose _of the following methods as the solution: A. 自银行做出不予批贷的打算起日内

Party B shall bear all the expenses occurred during this period. 三、关于税费相关规定 Taxes and fees 1、本合同履行期间内,甲、乙双方自行按国家及地方相关规定自行缴纳各项税、费,丙方 帮助甲乙双方进展相关税费确实认及计算工作。税费分担经甲乙双方协商,打算根据如下方 式进展分担: A. Party A and Part

22、y B shall pay all the taxes and fees respectively in accordance with relevant regulations of the state and local governments. Party C shall assist Party A and Party B to calculate relevant taxes and fees. Through negotiation, Party A and Party B agree to bear the taxes and fees as follows: 双方对前述税费未商

23、定、商定不明或遇政策调整的.,双方应在权属过户之日前 日内协商 并达成全都,否则,按国家相关法律规定缴纳; For any taxes or fees unspecified, unclear, or changed with the policy, Party A and Party B shall reach a consensusdays before the title transfer, or Party A and Party B shall make the payment in accordance with the government regulation. 在上述房屋交付

24、前未支付的物业治理费、水、电、燃气、通信费等其他费用,由甲方担当, 房屋交付之后发生的前述费用,由乙方担当; Fees including but not limited to property management fee, utility fees for water, electricity, gas, telephone and others before the handover of the property is concluded shall be born by Party A. And the fees after shall be born by Party B. 2、上

25、述税费可在丙方向应付费方预收后代为缴纳,相关部门所开具的完税凭证、行政事业 性收据、工本费发票等单据,待代理事项完成后,由丙方交付给付费的一方。 Party A and Party B may entrust Party C to pay the aforesaid taxes and fees and Party C shall transfer the payment proof, receipts and invoices issued by relevant government to the parties that make the payment. 第三条 居间酬劳的金额及支付方

26、式Commission and terms of payment 因甲乙双方基于丙方的媒介效劳而订立房屋买卖合同,丙方有权收取相应的居间酬劳,因此甲乙双方在订立房屋买卖合同时,商定选择以下第种方式支付丙方的居间酬劳: accordance with 1、居间酬劳由一方支付,即 方应于本合同签订当日根据房屋总价款的,即人民 币元向丙方支付居间酬劳; Born by one party.
