3、he Regulation on Ground water Management, as adopted at the 149th executive meeting of the State Council on September 15, 2021, is hereby issued, and shall come into force on December 1,2021.Premier: Li KeqiangOctober 21, 2021Regulation on Groundwater ManagementChapter I General ProvisionsArticle 1

4、For the purposes of strengthening groundwater management, preventing and controlling ground water overexploitation and pollution, guaranteeing the quality and sustainable utilization of ground water, and promoting theprior to the commencement of construction, submit the project construction plan and

5、 the planned measures for preventing adverse impact on ground water to the water administrative department with the administrative power for recordation. The excavation depth and drainage scale shall be determined and issued by the peoples government of the province, autonomous region or municipalit

6、y directly under the Central Government.Article 27 Except under any of the following circumstances, the exploitation of groundwater that is difficult to be regenerated is prohibited:(1) Water withdrawal for emergent water supply.(2) Water for residents* life in an area without alternative water sour

7、ces.(3) Water withdrawal in small amount for ground water monitoring, exploration and experiment.Where oundwater has been exploited, except under the circumstances set forth in the preceding paragraph, the local peoples government at or above the county level shall take measures to prohibit or restr

8、ict the exploitation thereof and gradually realize the comprehensive prohibition of exploitation, and the withdrawal of ground water for use shall be stopped immediately after the elimination of the circumstance set forth in the preceding paragraph.Article 28 The local peoples government at or above

9、 the county level shall strengthen the protection of recharge of ground water sources, and replenish ground water by making full use of natural conditions and effectively conserve ground water sources.In urban and rural development, overall planning shall be made for the needs of conservation and re

10、charge of ground water sources, and according to the requirements for the construction of a sponge city, sponge-type buildings, roads, squares, parks, and green spaces, among others, shall be promoted, and the rainwater and flood collection and utilization system that integrates retention, infiltrat

11、ion, storage and drainage, among others, shall be gradually improved. 13、地等,逐步 完善滞渗蓄排等相结合的雨洪水 收集利用系统。河流、湖泊整治 应当兼顾地下水水源涵养,加强 水体自然形态保护和修复。10ground water sources, and the protection and restoration of natural forms of water bodies shall be strengthened.The peoples government of a city shall take effective measures in light of its local conditions to promote water-saving hou

14、sehold water appliances, encourage the use of reclaimed water, and enhance the water use eflficiency.城市人民政府应当因地制宜采取 有效措施,推广节水型生活用水 器具,鼓励使用再生水,提高用 水效率。Article 29 The local peoples government at or above the county level shall, according to the conditions and needs of ground water sources, construct b

15、ackup groundwater sources for emergency response and make emergency response plans to ensure the normal use of such sources when needed.第二十九条县级以上地方 人民政府应当根据地下水水源条 件和需要,建设应急备用饮用水 水源,制定应急预案,确保需要 时正常使用。After the emergent use of backup ground water so urces for emergency response, water withdrawal shall

16、 be stopped immediately.应急备用地下水水源结束应急使 用后,应当立即停止取水。Article 30 The water administrative department of the local peoples government at or above the county level shall, in conjunction with other relevant departments of the peoples government at the same level, make a plan for the protection of importan

17、t spring areas, specify the protection scope and measures, and report to the peoples government at the same level for approval and implementation.第三十条有关县级以上地 方人民政府水行政主管部门会同 本级人民政府有关部门编制重要 泉域保护方案,明确保护范围、 保护措施,报本级人民政府批准 后实施。Measures shall be taken to restore dried spring areas that have important hist

18、orical, cultural and ecological value, where conditions permit.对已经干涸但具有重要历史文化 和生态价值的泉域,具备条件 的,应当采取措施予以恢复。Chapter IV Overexploitation Treatment第四章超采治理Article 31 The water administrative department of the State Council shall, in conjunction with the department of natural resources of the State Council

19、, organize the demarcation of ground water overexploitation areas nationwide according to the survey and evaluation results of ground water conditions, and announce them to the public in accordance with the law.第三十一条国务院水行政 主管部门应当会同国务院自然资 源主管部门根据地下水状况调查 评价成果,组织划定全国地下水 超采区,并依法向社会公布。11第三十二条省、自治区、 直辖市人民

20、政府水行政主管部门 应当会同本级人民政府自然资源 等主管部门,统筹考虑地下水超 采区划定、地下水利用情况以及 地质环境条件等因素,组织划定 本行政区域内地下水禁止开采 区、限制开采区,经省、自治 区、直辖市人民政府批准后公 布,并报国务院水行政主管部门 备案。地下水禁止开采区、限制开采区 划定后,确需调整的,应当按照 原划定程序进行调整。第三十三条有以下情形之 一的,应当划为地下水禁止开采 区:(一)已发生严重的地面沉降、 地裂缝、海(咸)水入侵、植被 退化等地质灾害或者生态损害的 区域;(二)地下水超采区内公共供水 管网覆盖或者通过替代水源已经 解决供水需求的区域;(三)法律、法规规定禁止开

21、采 地下水的其他区域。第三十四条有以下情形之 一的,应当划为地下水限制开采 区:Article 32 The water administrative department of the peoples government of a province, an autonomous region or a municipality directly under the Central Government shall, in conjunction with the natural resources and other competent departments of the peoples

22、 government at the same level, take into coirprehensive consideration the demarcation of ground water overexploitation areas, ground water utilization, geological environmental conditions, and other foe tors, organize the demarcation of areas where ground water exploitation is prohibited or restrict

23、ed within its administrative region, which shall be issued with the approval of the peoples government of the province, autonomous region or municipality directly under the Central Government, and be reported to the water administrative department of the State Council for recordation.Where it is rea

24、lly necessary to make adjustments after the demarcation of areas where groundwater exploitation is prohibited or restricted, adjustments shall be made according to the original demarcation procedures.Article 33 Under any of the following circumstances, an area shall be demarcated as an area where gr

25、oundwater exploitation is prohibited:(1) An area where any geological disaster or ecological damage, such as severe ground subsidence, ground fissure, sea (saline) water intrusion, or vegetation degradation, has occurred.(2) An area within a ground water overexploitation area that is covered by publ

26、ic water supply networks or of which water needs have been met by alternative water sources.(3) Any other area where ground water exploitation is prohibited by any law or regulation.Article 34 An area felling under any of the following circumstance shall be demarcated as an area subject to restricte

27、d groundwater exploitation.12An area where the amount of ground water exploitation is close to the allowable exploitation.(1) An area where groundwater exploitation may lead to any geological disaster or ecological damage.(2) Any other area where groundwater exploitation is restricted as prescribed

28、by any law or regulation.Article 35 Ground water shall not be drawn in an area where ground water exploitation is prohibited, except under any of the following circumstances:(1) Temporary withdrawal (discharge) of water for emergency response so as to guarantee the construction or work safety of an

29、underground work.(2) Temporary withdrawal of water for emergency response so as to eliminate the damage endangering public security or public interest.(3) Water withdrawal in small amounts for ground water monitoring, exploration and experiment.Except for the circumstances prescribed in the precedin

30、g paragraph, any additional groundwater withdrawal in an area where ground water exploitation is restricted is prohibited, and the ground water withdrawal shall be gradually reduced; and ground water withdrawal shall be stopped immediately after the circumstance prescribed in the preceding paragraph

31、 is eliminated.Article 36 The water administrative department of the peoples government of a province, an autonomous region or a municipality directly under the Central Government shall, in conjunction with other relevant departments of the peoples government at the same level, make a plan for the c

32、omprehensive treatment of groundwater overexploitation within its administrative region, and with the approval of the peoples government of the province, autonomous region, or municipality directly under the Central Government, report it to the water administrative department of the State Council fo

38、持力度。Article 38 The water administrative department of the local peoples government at or above the county level shall, in conjunction with the department of natural resources of the peoples government at the same level, strengthen the monitoring and prevention of sea (saline) water intrusion. For ar

39、eas where sea (saline) water has already intruded, comprehensive treatment measures shall be taken.第三十八条有关县级以上 地方人民政府水行政主管部门应 当会同本级人民政府自然资源主 管部门加强对海(咸)水入侵的 监测和预防。已经出现海(咸) 水入侵的地区,应当采取综合治 理措施。Chapter V Pollution Prevention and Control第五章污染防治Article 39 The department of ecology and environment of the S

40、tate Council shall, in conjunction with the departments of water administrative affairs, natural resources and other competent departments of the State Council, direct the demarcation of key areas fbr ground water pollution prevention and control nationwide. The department of ecology and environment

41、 of the peoples government of a province, an第三十九条国务院生态环 境主管部门应当会同国务院水行 政、自然资源等主管部门,指导 全国地下水污染防治重点区划定 工作。省、自治区、直辖市人民 政府生态环境主管部门应当会同14本级人民政府水行政、自然资源 等主管部门,根据本行政区域内 地下水污染防治需要,划定地下 水污染防治重点区。第四十条禁止以下污染或 者可能污染地下水的行为:(一)利用渗井、渗坑、裂隙、 溶洞以及私设暗管等逃避监管的 方式排放水污染物;(二)利用岩层孔隙、裂隙、溶 洞、废弃矿坑等贮存石化原料及 产品、农药、危险废物、城镇污 水处理设施产

42、生的污泥和处理后 的污泥或者其他有毒有害物质;(三)利用无防渗漏措施的沟 渠、坑塘等输送或者贮存含有毒 污染物的废水、含病原体的污水 和其他废弃物;(四)法律、法规禁止的其他污 染或者可能污染地下水的行为。第四十一条企业事业单位 和其他生产经营者应当采取以下 措施,防止地下水污染:(-)兴建地下工程设施或者进 行地下勘探、采矿等活动,依法 编制的环境影响评价文件中,应 当包括地下水污染防治的内容, 并采取防护性措施;(二)化学品生产企业以及工业autonomous region or a municipality directly under the Central Government sh

44、 prevention and control within its administrative region.Article 40 The following acts that pollute or may pollute groundwater are prohibited:(1) Discharging water pollutants by means of evading regulation, such as seepage wells, seepage pits, crevices, karst caves and unauthorized installation of u

45、nderground pipes.(2) Using pores, crevices, karst caves, or abandoned mine pits, among others, to store petrochemical raw materials and products, pesticides, hazardous wastes, sludge generated by urban sewage treatment iacilities and post-treatment sludge, or other toxic and hazardous substances.(3)

46、 Using any ditch, pit or pool, among others, without antiseepage measures to transmit or store waste water containing toxic pollutants, sewage containing pathogen or other wastes.(4) Any other conduct that pollutes or may pollute ground water as prohibited by any law or regulation.Article 41 Enterpr

47、ises, public institutions and other manufacturers and businesses shall take the following measures to prevent groundwater pollution:(1) For the construction of underground engineering focilities or underground exploration, mining and other activities, environmental impact assessment documents prepar
