1、国有企业改制职工安置方案参考样本一、制定职工安置方案的指导思想、原则和主要政策依据改制前企业名称、所有制性质,年月日经国有资产监督管理委员会/授权部门以号文件(附后)批准改制为国有控股企业/非国有控股企业(国有持股比例,职工持股比例),改制后拟定企业名称、所有制性质。(一)制定职工安置方案的指导思想和原则。其中原则部分应明确计算经济补偿金等职工安置费用和理顺劳动关系的基准日(经济补偿金等职工安置费用的计算,以有关部门批准企业改制方案之日为基准日;国家或省另有规定的,从其规定)。(二)政策依据。根据改制的具体情况,依据相关的法律法规和政策,主要有:?中华人民共和国劳动法?、国务院?工伤保险条例?

20、解除劳动合同的,除经济补偿金外还应发给不低于六个月工资的医疗补助费,患重病和绝症的还应增加医疗补助费,患重病的增加部分不低于医疗补助费的百分之五十,患绝症的增加部分不低于医疗补助费的百分之百。本企业的平均工资为元,实行此办法解除劳动关系并分流到社会的职工人,总工龄为年,经济补偿金平均月工资为元,经济补偿金总额为万元,医疗补助费为万元;解除劳动关系并安置到改制后非国有法人控股企业的职工人,总工龄为年,经济补偿金平均月工资为元,经济补偿金总额为万元,医疗补助费为万元。(2)对距法定退休年龄不足5 年的职工,经原企业与职工双方协商一致,解除劳动关系时可将经济补偿金转为一次性缴纳养老保险费、医疗保险费
