10、权归甲方所有,甲方享有所购房屋占有、使用、收益及处分的权利,乙方无权行使上述权利,亦不得对所购房屋进行侵占、破坏、转卖、出租、抵押及赠与等。2、若因甲方借用乙方名义购置房屋之行为影响到乙方后期购房,或截至到年月日之前,甲方同意及时将所购房屋从乙方名下剥离,将所购房屋产权变更至甲方或甲方指定的他人名下。3、甲方如需转让所购房屋,乙方应当协助甲方办理更名手续。如因房屋质量问题及房屋买卖合同问题而导致诉讼,乙方同意配合甲方办理相关诉讼程序,相关费用及期间乙方产的交通费、误工费等一切费用由甲方承担。4、所购房屋由甲方实际占有和使用,甲方对所购房屋进行的装修及在所购房屋内添置的所有家具、家电及物品享有所

18、办至乙方名下,产权证及契税等原件由甲方持有和保管,甲方有权随时将产权变更至本人名下或甲方指定的其他人名下,或转让、出租所购房屋,乙方应当在接到甲方通知后十五个工作日内协助甲方办理相关手续。第三条 甲乙双方权利义务1、所购房屋登记在乙方名下期间,甲方欲对所购房屋设置抵押或担保时需经乙方同意。2、所购房屋登记在乙方名下期间,乙方有权要求甲方支付与所购房屋有关的各项税费及款项。3、乙方需保证乙方利害关系人(包括但不限于父母、子女及配偶)不会主张所购房屋的所有权利,更不得将所购房屋作为遗产发生继承关系。4、乙方负责将本协议购房相关事宜告知相关利害关系人。5、乙方保证,除非根据有关法律、法规的规定应向有

26、G2U32019 借名购房协议书(实用版)第 5页(共 6 页)8、办理与所购房屋相关的各项手续时,乙方可予以协助。9、甲方应按本协议之约定,定期足额将当期房贷本息支付于乙方,便于乙方偿还贷款。10、甲乙双方均不得私自将所购房屋用于抵押贷款或做出其他可能影响到另一方权益的行为。11、所购房屋的日后维护、自然损毁灭失均有甲方负责,与乙方无关。12、甲方需于年月日之前,将所购房屋从乙方名下剥离,将所购房屋产权变更至甲方或甲方指定的他人名下,并偿还清乙方名下所有有关该购房屋按揭贷款本息。第四条 报酬及违约责任1、甲方承诺待乙方日后与他人订婚、登记结婚或购买新房时分别给予乙方一定的金额作为甲方借用乙方

27、名义购房及乙方配合甲方办理相应手续的补偿,金额分别为:订婚时补偿人民币壹万元;婚姻登记时补偿人民币壹万元;购置新房时补偿人民币贰万元。除上述情形外,乙方不得再向甲方主张其他形式的补偿。2、乙方应当恪守诚信,所购房屋登记在其名下时不得侵害甲方的利益,如果乙方及乙方近亲属对所购房屋进行毁损、侵占、转卖、抵押、赠与等作出违反本协议约定的行为以及被法院强制执行所购房屋,乙方应当按房屋市场价格给予甲方赔偿及承担对甲方所造成的所有损失。3、如乙方未按本协议之约定履行义务,甲方有权停止履行本协文档编码:CX8N5Q6J2R10 HT1K4J3S4R6 ZX7C6E9G2U3文档编码:CX8N5Q6J2R10
