16、 to all the employees in DISCOVERY INTERNATIONAL FZE. 4. 员工聘用政策Employee recruitment policy 4.1 职级制度Job grade systemXX职级制度共有9个级别, 具体如下:Lightening has 9 grades in the job grade system, which are as follows: 90级- 高级管理层90 grade - Senior management 80 级80 grade 70 级 - 管理层/专家70 grade - Management/experts

17、60 级60 grade 50 级50 grade 40 级 - 主管层/专业人士40 grade - Supervisor/professionals 30 级30 grade 20 级 - 基层管理人员、技工、文员20 grade - Junior management, technicians and staffs 10级 - 普通员工10 grade - Normal Worker 4.2 工作时间Working time标准工作时间(即每天工作10小时、每周工作60小时)如下:The standard working time (10 hours per day and 60 hou

18、rs per week) is as follows: 星期一至星期六作息时间:Work and rest time from Monday to Saturday: 直接生产人员:早班 : 8:0020:00 中班 : 20:008:00 非直接生产人员Non-direct production personnel:早班 : 8:0020:00特殊情况下根据实际需要,公司会作出特殊安排,具体则按公司发布的时间执行In case of special circumstances, the company will make special arrangement based on actual

19、 demand, and the details of which shall be implemented according to the timetable issued by the company. 公司对某些特定岗位实行不定时工作制,经劳动部门批准且受限于尼日利亚适用法律法规的规定,该等员工的工作时间安排可不同于上述标准工作时间。The company will implement flexible working hour system on certain special positions, as approved by the labor department and th

20、e applicable law and regulation of , the working hours arrangement of such employees may differ from the foresaid standard working hours. 4.3 合同期及试用期Contract period and probation period员工在上班的第一天办妥一切报到手续后,由人力资源部门代表公司与其签订劳动合同。除非法律另有规定,所有的合同均为固定期限合同。合同期限一般为1年,也可以由公司和员工自行约定其他期限。After employees settle al

21、l the report-to-duty procedures on the first day of working, the human resource department will sign labor contract with them on behalf of the company. Unless otherwise regulated by law, all the contracts shall be fixed-term contracts. The period of contract is normally 1 years, or other periods agr

22、eed between the company and the employees. 劳动合同到期时,经公司和员工协商一致,可续签合同。When labor contracts expires, it may be renewed after the company and employees reach an agreement through negotiation. 任何首次受雇于公司的员工都应在其劳动合同期限开始之日起的不超过3个月期间为试用期(直接工人试用期可为3个月)。试用期结束后,除非公司认为员工不符合录用条件,员工将继续为公司工作。Any employee employed b

23、y the company shall have a probation period no more than 3 months after the beginning date of his/her labor contract.(Direct labor probation period can be 3 months), After the probation period expires, unless the company believes that the employee doesnt meet the recruitment condition, the employee

24、will continue to work for the company. 公司在试用期内或结束之时可对员工的工作表现进行评估。员工不符合录用条件的情况包括但不限于:During or after the probation period, the company may evaluate the work performance of employees. The circumstances that employees dont meet recruitment conditions include but not limited to: 员工提供或要求第三方为其提供虚假的个人信息或文件

25、或与雇佣有关其他信息或文件。Employees provide or require any third party to provide false personal information or document or other information or document relating to employment. 员工未能通过公司所指定的医院的健康体检。Employees fail to pass the health examination at the hospital designated by the company. 员工对其前雇主负有未了结的债务,且公司认为该等债务

26、可能会对员工在公司的工作带来不利的影响。Employees have unsettled debt with former employer, and the company believes that such debt will bring negative influence to the employees work in the company. 员工对其前雇主负有竞业限制义务。Employees have competitive restriction obligation to their former employers. 员工不能胜任公司的工作任务。Employees are

27、 not capable of work tasks in the company. 员工未能通过公司的工作表现评估。Employees fail to pass the work performance assessment in the company. 员工的身体条件不符合其工作岗位的岗位要求(例如特殊岗位的要求)。Employees physical conditions dont meet the position requirements of their work positions (such as requirements for special positions). 4.

28、4 培训、升职和调动Training, promotion and transfer根据员工的能力和工作表现,公司将自行决定向适合的员工提供平等的培训及升职机会。公司有权要求接受公司出资的专项或专业技术培训的员工与公司签订一份服务期协议。Based on the ability and work performance of employees, the company will decide at its discretion to provide proper employees with the equal training and promoting opportunities. Th

29、e company will be entitled to signing a service period agreement with the employees accepting the specific or professional training paid by the company. 根据业务需要,公司可将员工调往XX的其他岗位或其他关联公司工作。Based on business demand, the company may transfer employees to other positions or other affiliated companies of Li

30、ghtning. 如果员工希望调动工作,应向其直接主管提出书面申请,直接主管将协同人力资源部共同考虑员工的申请。如果公司认为员工所申请的调动不具有可行性,则该等申请将不会被批准,其直接主管或人力资源部应尽量在合理的时间内将此结果告知员工。If employees wish to transfer work, they shall submit written application to their direct director, who will assist the human resource department in considering the employees applic

31、ations. If the company believes that the transfer applied by employees are is not feasible, then such applications wont be approved, their direct directors or human resource department shall inform such employees about the result in reasonably short period. 4.5 劳动关系的终止和解除 Termination and cancellatio

32、n of labor relation4.5.1 有下列情形之一的,在中国法律允许的情况下,公司可立即单方解除劳动合同:For any of the following circumstances, the company may unilaterally cancel the labor contract allowed by Chinese law: 员工在试用期内被证明不符合录用条件(包括但不限于本手册第4.3部分所列的条件);Employees are proven to be not meeting the recruitment conditions during probatio

33、n period (including but not limited to the conditions listed in article 4.3 of this manual); 员工严重违反了公司的规章制度(包括但不限于本手册)。该等行为的实例如下所列,但下述实例并非意在穷尽所有的可能:Employees have seriously violated the companys regulations and systems (including but not limited to this manual). Such behaviors have examples are list

34、ed as followed, but which examples are not exhausting all the possibilities: n 偷窃公司或其他员工的产品、财物(如金钱、产品、原材料、工具等);Steel product, property (such as money, product, raw material, tool, etc) of the company or other employees; n 欺诈行为,包括但不限于:Fraudulent conduct, including but not limited to: u 欺骗公司和/或同事,伪造文件

35、或记录(如申请病假的医院证明,身份证、学历及专业资格证明及其他个人信息);Cheat on the company and/or colleagues by forging documents or records (such as hospital certificate for applying sick leave, ID certificate, diploma, professional qualification certificate and other individual information); u 贪污公司财物(如利用假发票);Embezzling of company

36、 property (such as using fake invoice); u 伪造数据、报表或材料(如假销售纪录、假签名等);或Forge data, statement or material (such as false sales record, false signature); or u 未经允许私取公司财产、礼品及礼券等。Take company property, gift or gift certificate without permission. n 在非吸烟区吸烟,可能或已经导致危险后果或污染产品/材料;Smoke in non-smoking area, whic

37、h may or already cause dangerous consequence or contaminate products/materials; n 故意破坏公司或其他员工财产;Purposefully damage the properties of the company or other employees; n 在公司内外无理取闹、聚众闹事、打架斗殴,影响办公室秩序、工作秩序和社会秩序;Make trouble out of nothing, gather a crowd and make disturbances, have group fighting, affect

38、 office order, work order and social order inside or outside the company; n 口头或书面、直接或间接威胁、骚扰、辱骂其他同事或对其他同事进行人身攻击,或以任何形式干扰他人工作;Directly or indirectly threat, harass or insult other colleagues in oral or written form, or make personal attack on other colleagues, or disturb the others work in any form;

39、n 向非意图接收信息的第三人泄漏公司的业务、策略、销售量等机密信息;Disclose the companys operation, strategy, sales volume and other confidential information to any third party without intention to receive information; n 发表有损公司、产品或雇员形象的言论,或做出有损公司形象的其他行为;Express any speech that damage the image of the company, products or employees,

40、 or make other conduct that damage the companys image; n 违反公司相关规定,接受任何与公司有业务关系的机构(含潜在客户)或人士之礼品或金钱及其它任何形式的个人资助;Violate the concerned regulation by accepting gift, money and any other form of personal gain from any institution (including potential customer) or individuals having business relation with

41、 the company; n 违反公司的相关规定(定义及链接见本手册第4.8部分),包括但不限于:Violate the concerned regulation (for definition and links, please refer to article 4.8 of this manual), including but not limited to: u 单独或与其他公司或个人一起从事贿赂或其他腐败的行为;或Independently or collide with other company or individual to engage in bribery or othe

42、r corruption activities; or u 未经公司事先批准,为其他实体或个人工作。Work for other entity or individual without permission from the company in advance. n 违反公司制度和程序(定义及链接见本手册第4.9部分)(包括但不限于纪律规范)的任何规定;Violate the concerned system and procedure in the company (for definition and links, please refer to article 4.9 of this

43、 manual), including but not limited to any regulation in the discipline code; n 受到公司顾客或客户的投诉,且使得公司遭受经济上和声誉上的损失;Receive complaint from company customer or client, and cause the company to subject to economic or reputational loss; n 违反公司相关保密协议(如适用);Violate the concerned “Confidentiality Agreement of t

44、he company (if applicable); n 未经许可或超越授权范围以公司的名义对外签署文件或使用公司印鉴;Sign contract or use company seal in name of the company without permission or beyond the scope of authorization; n 未向公司事先披露并取得公司的书面许可,参与实施任何与公司的利益相冲突或可能会冲突的行为。在下列情况下,员工的个人利益与公司的利益相冲突、或可能冲突、或可被理解为相冲突:Engage in any behavior that may conflic

45、t with the company interest or may cause conflict without disclosing to the company and obtain written permission from the company in advance. Under the following circumstances, the employees personal interest and the companys interest have conflict, or may have conflict, or can be interpreted as having conflict: u 与其他实体或个人建立雇佣关系或事实雇佣关系;Establish employment relation or substantial employment relation with other entity or individual; u 向公司的竞争对手(由公司认定)提供服务或以其他方式提供协助;Provide competitor of the company (determined by the company) with service or provi
