1、农村土地承包合同书甲方:(以下简称甲方)乙方:(以下简称乙方)根据合同法及土地管理法、农村土地承包法的有关规定,本着公开、公平、诚信、平等、自愿的原则。乙方通过土地承包方式取得甲方农村耕地亩的承包经营权,经双方共同商定,以兹共同遵守,达成如下协议特立此合同:一、甲方将位于村民委员会(组)所有的,以北、以南、以东、以西毗邻的农村耕地亩发包给乙方使用。土地方位为:东起,西至,南至纸,北至。二、乙方承包后,承包使用期二十年不变,即从 XX 年 XX 月 XX 日起至 XX年 XX 月 XX 日终止。三、乙方所承包的亩土地 使用权及其地上附着物总承包款为人民币(大写)元整、(小写)元整,付款方式为:。
2、第一年在合同签订 15 日内一次性缴付,以后的每年在合同签订日15 日内将下一年的租赁费缴付给甲方。四、乙方承包土地后应积极发展,在耕地上种植林木、果树、花卉、种草、养殖或搞多种经营;经有关部门批准可以从事非农业生产,利用承包范围内的粘土、沙石等建造固定设施。五、乙方对所承包的土地有独立的经营管理权,但不得转包。六、甲方要尊重乙方所承包土地的生产经营自主权,保护其合法权益不受侵犯,对所承包土地成果全部归乙方所有。七、乙方在所承包的土地在合同履行期内除乙方交纳承包款外,乙方不负责其他任何名目的费用。八、乙方将土地承包后,甲方有权监督、检查、督促其合理利用,发现问题及时书面通知乙方。九、甲方保证该
3、承包土地界线、四至与他人无任何争议。如因此发生纠纷,由甲方负责协调处理,如由此给乙方造成经济损失,由甲方负责全额赔偿。十、甲乙双方必须信守合同。如甲方违约导致解除此合同,须付给乙方违约金人民币元整、退还乙方承包土地所付的全部价款,同时对乙方的投入和成果合理作价,作价款一次性付给乙方;如乙方违约导致解除此合同,甲方不予退还乙方的承包款。十一、如在承包期限内遇国家建设或进行其它开发建设需征用土地时,应首先从征地款中保障向乙方支付实际经济损失和未履行年限的预期利益损失。十二、如甲方重复发包该地块或擅自断水、断电、断路,致使乙方无法经营时,乙方有权解除本合同,其违约责任由甲方全权承担。文档编码:CS7

11、,本合同继续履行。十五、合同期满后,如乙方愿意继续承包经营,双方续签合同;如乙方不再承包经营,甲方对乙方的成果、经济投入合理作价归甲方,作价款一次性付给乙方,不得拖欠。否则,此合同期限顺延至甲方将全部价款付清乙方后合同自行终止。十六、甲乙双方如因作价款发生分歧,协商不成,须委托甲乙双方共同认可的中介机构进行评估作价,其结果对双方均有约束力。十七、此合同发生纠纷由当地法院裁决。十八、本合同经甲乙双方签章后生效.十九、本合同如有未尽事宜,可由甲乙双方共同协商签订补充协议,补充协议作为本合同的附件,具有同等法律效益。二十、本合同一式四份,甲乙双方各一份、镇政府和土地承包管理机构各一份。甲方(盖章):
