2、址:九龙坡区二郎科技新城火炬大道96 号;联系电话:法定代表人:周某;职务:董事长代理人:颜律师;特别授权事实和理由:2003 年 4 月 10 日起,原告开始在被告处上班并建立劳动关系。2013 年 1月 28 日,被告未经原告同意单方要求原告休假,侵犯原告的劳动权利。在劳动关系存续期间,被告未依法为原告缴纳社会保险,同时,被告未向原告支付各类加班工资。2013年 1 月 29 日,原告向被告提出了解除劳动合同申请。诉讼请求:1、判决双方劳动关系解除。2、判决被告向原告支付经济补偿金若干元。3、判决被告向原告赔偿6 个月失业保险金若干元。4、判决被告向原告支付2003 年 1 月 28 日2

10、 ZO9Z8I7X6Q2文档编码:CT6D10Y9L8A1 HQ3H1M10R9P4 ZO9Z8I7X6Q2文档编码:CT6D10Y9L8A1 HQ3H1M10R9P4 ZO9Z8I7X6Q2程序主要有“庭前准备”、“宣布开庭”、“法庭调查”、“法庭辩论”和“合议庭评议和宣告判决”这几部分组成。据说为了贯彻“不间断审理原则”,就需要有充分准备的审前程序。这其中就包括对“争点”的整理、准确排除“非争点”事项和充分收集、固定证据材料等事项;但在此次的庭审中,我注意到这些事项都是在“法庭调查”和“法庭辩论”这两部分中进行的,该工作占用了绝大部分时间,呈现出“间断审理”的现状。特别是对于“举证质证”环
11、节而言,其过程实在无聊,以致庭审过程冗长臃肿,背离了集中审理的原则。另外,对于“法庭辩论”环节而言,即便不要求像欧美国家的庭审一样有雄辩之风,但也不能那样死气沉沉的吧,完全没有“辩论”的感觉;你看那两个律师,简直是愧对“律师”二字啊,即便是最基本的表达清楚都没有做到。辩论过程完全就像是在说悄悄话似的,温和得恰似一小夜曲。还有,双方的言辞唯一称得上是“辩论”的也许就是“同意”或是“反对”了吧,质证辩论基本没有陈述理由,只是单纯的同意和反对。再者就是,作为一个法律工作者,观点基本没有法律条文的支撑,更别提说体现“法言法语”的严谨了。他们的表现完全颠覆了我心中对一个律师完美形象的刻画。还有让人搞不懂
12、的就是,为什么法官面前要竖立一面高大的电脑显示屏,整个审判过程,法官就是处于“未见其人,只闻其声”的状态中。法官的普通话也很烂,夹杂着浓重的地方口音,不知道他们平日是否也操着一口标准的“川普”进行司法审判的呢!这林林总总的现象,要如何让我感受到法官的威严庄重感呢?还有就是,我坚持着直到法庭辩论环节的结束,满心期待着合议庭评议之后给出一个公平公正的判决,以解答我心中那般多的疑惑(就那样的质证和辩论,法官是如何甄别证据、断定事实和适用法律的)。谁知道,我的期望再次被中国特色的司法制度给“和谐”了,“调解制度”突兀而至。据悉,在2013 年的民诉法修改过程中,调解制度得到的大范围的扩张,取得了决定性
13、胜利。调解包含了“诉前调解”、“庭前调解”、“判前调解”这些种类,甚至还有“执行和解”这一程序,充斥了整个诉讼的始终。追求“和谐”的政治政策在司法上指手画脚,我对此表示不能理解。还有既然是调解结案,那么诉讼费还要不要收取呢?总之,我有种像是被“欧美法律电影”欺骗的感觉!(二)实体问题分析:事实认定、证据审查及法律适用1、劳动关系建立时间原告方因手持的一份劳动用工合同坚持说劳动关系建立时间在2003 年;而被告方则以公司是在 2004年才成立的坚称不可能和原告在2003年就签订了劳动用工合同。但在双方举证质证环节中,可以看到其中的缘由:原告在2003 年签订的劳动用工合同是与另一个公司签订的,即

21、0Y9L8A1 HQ3H1M10R9P4 ZO9Z8I7X6Q2文档编码:CT6D10Y9L8A1 HQ3H1M10R9P4 ZO9Z8I7X6Q2在法庭审理过程中,我等没有得到确切的结论。2、被告是否依法为原告缴纳社会保险及原告是否具有享受失业保险金的主体资格根据中华人民共和国社会保险法第四十五条的规定,失业人员应当符合下列条件才可以从失业保险基金中领取失业保险金:“失业前用人单位和本人已经缴纳失业保险费满一年的;非本人意愿中断就业的;已经进行失业登记,并有求职要求的。”所以要求是非自愿失业和用人单位参加了失业保险才行。这里首先的争议点是,被告是否有依法告缴纳社会保险。据原告陈述,被告是从
22、2008 年以后才为原告缴纳,并没有一开始就为其缴纳。个人认为对此证据不足,应要求补充证据以证明被告在08 年以前是否有参加失业保险;另外,对于原告是否有资格享受失业保险金的问题,原告说自己之所以向被告提出解除劳动关系的申请,是因为被告未经原告同意单方面要求其休假。休假是暂时的还是长久性的,是带薪的还是没有薪金的,这些我们都不得而知,要判断原告的离职是何方的过错还并不明晰。另外原告离职后并没有取得单位为其出具的终止或者解除劳动关系的证明,也没有到指定的公共就业服务部机构办理失业登记,其方多少也有些过错。如果简单地因为被告方让原告休假就将所有过错都归责于被告方似有不妥,还需要更多的证据对双方的观
23、点佐证。3、被告应否为原告缴纳加班工资关于加班工资的计算规则是,在每日 8 小时计算基础上,工作日里超出的按1.5 倍计算,周末加班按2 倍计算,法定节假日按3 倍计算。对于这个问题的探讨,在学理上的难点主要在于“举证责任”和“诉讼时效”问题。首先是举证责任问题。实务中多半是由受雇人员承担的举证责任,但受雇人员明显处于劣势地位。就本案中来说,原告加班时间的计算是由打卡记录为准还是以原告部门内的签到表为准?若以打卡记录为准,原告如何可以得到该记录;若让被告方出示该证据,又不免有让人怀疑其真实性的可能。其次是诉讼时效问题。原告在双方用工合同存续期间一直有加班现象存在,对加班工资的诉讼请求是只支持其
24、近两年的还是支持所有的呢?个人认为,被告方若一直没有依法支付原告的加班费,该行为属于一个连续性的侵权行为,直到双方解除劳动关系后,侵权行为才得以结束,所以诉讼时效应该是从劳动关系解除时起算。最后是关于原告工资制的具体情形问题。受雇人员适用的是计件工资制,还或是标准 8 小时工资制,还是综合工资制呢?不同的工资制就意味着不同的工资计算方法。但对此问题双方争执不一,法庭辩论也没有得出个确切的结果,我也就点到即止。4、经济补偿金年限的起止时间及被告是否应当加付80的经济补偿金文档编码:CT6D10Y9L8A1 HQ3H1M10R9P4 ZO9Z8I7X6Q2文档编码:CT6D10Y9L8A1 HQ3

32、劳动条件的;(三)克扣或者无故拖欠劳动者工资的;(四)拒不支付劳动者延长工作时间工资报酬的;(五)低于当地最低工资标准支付劳动者工资的。”对于前面所探讨的问题而言,如果被告方确系恶意叫停原告工作,安排其进行所谓的“休假”,并存在拖欠原告的加班工资的,那么此项诉求是可以的得到支持的,只是量上的区别而已。原告在开庭伊始改变了诉讼请求,将加班工资的诉求降低了,而增加了经济补偿金的请求额度。我想原告方也是基于对经济补偿金诉求的证据更充分,而对于加班费的计算有所抛高的缘故才作此变动的吧。对于原告和其代理律师而言,这不失为一种正确的诉讼技巧。(三)答疑解惑环节在休庭之后,在师生的热情挽留下,九龙坡区的法官
