1、现场管理安全协议书(专业双语版)一、 HSE管理协议书HSE MANAGEMENT AGREEMENT为加强*工程服务安全、环境与健康管理，明确甲乙双方当事人权利和义务，根据中华人民共和国劳动法、中华人民共和国安全生产法中华人民共和国矿山安全法、中华人民共和国民法典、建设工程安全生产管理条例、中华人民共和国环境保护法、中华人民共和国职业病防治法等法律、法规及HSE相关规定，结合CSPC实际情况，甲乙双方经平等协商，意见一致，自愿签订本合同，并共同遵守本协议所列条款。To enhance HSE management of * co.ltd.,define the right and oblig

3、nment protection of peoples republic of china、occupational prevention and cure law peoples republic of china,combine CSPC physical situation, first contractor and second contractor have equal consultation, meeting of minds, willing to sign this contract, and obey all terms of this agreement together
4、.1. 甲方权利Right of first side1.1 有权要求乙方建立健全HSE管理组织机构，严格执行HSE管理相关法规、标准，遵守甲方HSE管理规章制度。Have right to require second contractor to build completed management organization, strictly execute HSE management statute, standard, and obey HSE management bylaw of first contractor.1.2 有权对乙方HSE管理业绩、资质、技术水平，特别是对安全保证
5、条件进行审查，对乙方针对作业项目制定施工方案 (包含HSE章节)进行审查并备案。Have right to checkup achievement, aptitude, technical level of HSE management, especially to checkup the safety guarantee qualification, checkup and put on record for second contractor processing the construction scheme(include HSE part) of project.1.2.1. 审查内
6、容包括：Checkup contents include:a) 乙方营业执照、安全资格证书及经营范围应符合要求；Second contractors business license, safety qualification and management scope should accord with the requisitions.b) 乙方施工管理能力和队伍素质应满足工程安全需要；Construction management ability of second contractor and diathesis should satisfy the safety constructi
7、on requirements.c) 乙方HSE管理机构健全，管理制度严谨、完善；Second contractors HSE management organization is sanity, and management rules are preciseness and completed.d) 乙方作业人员经过作业前HSE教育培训，并建立考核、考试制度，存档备案。Personnel of second contractor need pass the HSE training before working, and build access, examination system,
8、keep in archives and put on records.1.2.2. 确认程序及办理入厂程序：Affirm procedure of site entry transaction a) 先由甲方审核施工资质，然后由甲方HSE管理部主管组织对乙方HSE资质进行审查。审查主要内容包括：First contractor need to checkup the construction qualifications first, superintend of HSE management department organize checkup to second contractors
9、 qualification, include:承包商主要负责人、项目负责人和专职安全管理人员必须经过建设行政主管部门或其它有关部门考核合格后方可任职；After main principal of contractor, project principal and full-time safety management team must pass the construction admin. Head or other some related departments assess, they can hold a post.承包商安全负责人必须持有地方政府安全生产监督管理部门颁发厂长（
10、经理）职业卫生管理资格证书或者安全主任资格证书；HSE principal of contractor must have manager professional sanitation management qualification certificateorsafety director qualification certificate that safety management department of local government award.b) 由甲方HSE管理部组织或指定单位对乙方人员进行入厂HSE教育培训。HSE management organization or
11、 designated department of first contractor take the HSE training of site-entry to second contractor.c) 由甲方法定代表人或委托代理人与乙方签订本协议书。Member as of right or commissioning deputy sign this agreement with second contractor.d) 办理临时出入证：承包商从业人员必须携带有效身份证和其他相关证件交甲方办理。Making temporary entry card: personnel in activ
12、e service of contractor must take valid ic and other certificate to first contractor.1.3 甲方有权要求乙方维护好相关甲方安全生产设施、设备和器材。First contractor has right to require second contractor to do the maintenance of safety production establishment and equipments of first contractor.1.4 甲方有权对乙方施工作业现场安全作业情况进行监督检查，乙方违章指
13、挥、违章作业、违反劳动纪律，甲方有权责令其停止作业，停止作业造成损失由乙方承担。First contractor has right to supervise the site safety situation of second contractor, if second contractor violative command and work, offend labor discipline, first contractor has right to ask for stopping work, the losing expense is paid by second contract
14、or.1.5 发生事故后，甲方有权根据有关规定组织、参与事故调查，甲方有权对事故进行统计上报。After accidents haPPEns, first contractor has right to organize and join in the accident investigation according to some related regulation, first contractor has right to do statistic and report to leader.2. 甲方义务First contractors obligation2.1 贯彻执行国家和地方
15、有关法律、法规和标准，贯彻执行CSPC有关安全、环境与健康管理规章制度。Carry out central and local law, statute and standard thoroughly, and CSPC HSE management bylaw.2.2 向乙方明确施工作业区范围、危险源及HSE管理要求。Define the area, hazard source and HSE management demands of construction area to second contractor.a) A)由甲方工程主管部门对乙方进行工程项目交底，组织开展工作危害分析（JH
16、A），根据现场风险责成乙方制订安全防范措施，编制施工方案(含HSE章节)。Pmd of first contractor need to tell project detail to second contractor, develop JHA, ask second contractor to work out safety measure according to site hazard and construction scheme include HSE part).b) 由甲方工程主管部门组织乙方进行现场工程交底和HSE管理要求交底，介绍管理要求、操作条件、环境及安全要求。Pmd o
17、f first contractor tell project detail and HSE management requirments to second contractor, introduce management requirements, operation situation, environment and safety demands.2.3 向乙方提供工程合同中规定安全、环保作业条件。Supply HSE working condition of project contract to second contractor.a) 涉及周边生产施工工程由甲方工程所在单位将设备
18、、管线中可燃、有毒介质及物料置换合格，加堵盲板，悬挂警示标志。其他情况由单元项目经理组织交底。Project involved in surrounding production and construction, equipment, ignition venomousness medium of pipes, and material replacement, add blind, hang caution signal. Other situations need hand over to unit project manager.b) 由甲方组织有关单位开具乙方施工所需各种作业票(包括
19、：施工作业票、用火票、临时用电票、受限空间作业票、射线探伤票、占挖道路票、用水票、用汽票等)，满足乙方施工作业安全要求。First contractor organize some related units to do PTW(include: construction PTW, fire PTW, temporary electric PTW, confine space PTW, ndt PTW, excavation PTW, water PTW, gas PTW，etc.), satisfy second contractors construction safety require
20、ments.c) 由甲方相关主管部门审批乙方加班申请。First contractor approves to application of second contractor.2.4 发生事故后积极组织或配合CSPC抢险，防止事故扩大，并按照国家及地方和CSPC有关规定进行报告。If accidents happen, first contractor need to deal with emergency actively, prevent accidents from enlarging, and do report according to national and local rul
21、es of CSPC.2.5 根据工程服务项目要求应尽义务。According to project service require obligation.3. 乙方权利 Second contractors obligation3.1 乙方有权对甲方安全工作提出合理化建议和改进意见。Second contractor has right to raise reasonable suggestion and improve opinions of first contractors safety work.3.2 对甲方违章指挥、强令乙方冒险作业，有权拒绝执行；对由此产生打击报复，有权向有关部
22、门举报。If first contractor commands violatively, strictly order second contractor to do hazard works, second contractor has right to reject; for retaliation bringing from such things, second contractor has right to report to related department.3.3 有权要求甲方提供符合安全施工作业工艺条件和环境。Second contractor has right to
23、require first contractor to supply suitable technical condition and environment.3.4 发生严重危及生命安全不可抗拒紧急情况时，乙方有权采取必要避险措施。When emergency situation haPPEned, second contractor has right to take necessary measures to avoid hazard.3.5 有权对甲方原因造成乙方人员伤亡和财产损失进行索赔。Second contractor has right to ask first contrac
24、tor to compensate due to personnel casualty and property loss.4. 乙方义务 Second contractors obligation4.1 乙方应当具备国家规定注册资本、专业技术人员、技术装备和安全生产等条件，依法取得相应等级资质证书，并在其资质等级许可范围内承揽工程。Second contractor should have registration capital, specialist, technical equipment and safety production, etc., and obtain relevant
25、 qualification, and get the projects within qualification allowed scope. 4.2 乙方必须遵守执行国家和地方有关安全、环境与职业健康法律法规和标准，遵守执行*、CSPC有关安全、环境与健康规章制度，严禁违章指挥和违章作业。Second contractor must obey and execute legislation and bylaw of local HSE and national HSE, and obey and execute HSE bylaw of tianxin and CSPC. Strictly
26、 prohibit wrong direction and working.4.3 乙方必须建立健全安全组织机构，完善内部HSE管理保证体系，建立全员安全生产责任制；严格执行甲方相关规章制度，办理各种作业票，落实施工期间安全保证措施，对未办理作业票证造成一切后果负责。Second contractor must establish right safety organization, perfect inner HSE management system, build crews safety production liability system; strictly execute firs
27、t contractors relevant bylaw, deal with all kinds of PTW, carry out safety measures, are responsible for all sequels of no PTW. 4.4 施工单位应当建立健全安全生产教育培训制度，制定安全生产规章制度和操作规程，对作业人员进行作业前HSE教育培训，使其具备相应HSE意识和技能，特种作业人员应具备相应资格证书。Construction unit should build right safety education system, set down safety prod
28、uction bylaw and operation regulations, take training for task persons before working, and make it has relevant HSE consciousness and skills, special working people should have relevant qualification. 4.5 乙方应按规定保证安全生产条件所需资金投入，安全技术措施费应全部用于安全生产投入，做到专款专用；乙方应为施工区域配备足够安全装备和消防器材，为施工人员配备足够符合规定防护用品，不得使用不符合国
29、家、行业标准和甲方规定原材料、设备、装置、防护用品、器材、安全检测仪器等。Second contractor should ensure delivered capital of safety conditions according to regulations, safety technical measure fee should be used on production, special funds should be used specially; second contractor should prepare enough safety equipments and fire
30、equipment for construction area, prepare enough protection things for construction person, do not use something opposite national and trade standard, such as, raw materials, equipments, protection things, instruments, safety inspection instruments 4.6 乙方施工项目负责人须由取得相应执业资格人员担任，对建设项目安全施工负责，指定专人负责现场HSE监
31、督工作，认真开展安全检查，发现作业过程中不安全行为和隐患，应采取有效措施积极处理；并做好检查记录报甲方备案。Second contractors project principal must has relevant professional qualification, be responsible for safe working, define special person to do HSE inspection work, develop safety check, find unsafe action and hidden trouble during working, shoul
32、d take effective measure to deal with the problem; and take inspection report to ask second contractor to record.4.7 乙方对危及安全生产关键作业应提出切实可行方案和安全保证措施，经甲方HSE管理部等相关部门审核同意后，方可实施。Second contractor should advance feasible proposal and safety measure for endangering safety production, after first contractor
33、HSE management department must approve it, they can be used.4.8 乙方要严格按甲方批准指定作业区域内进行施工作业，保护好施工区域内甲方和CSPC任何设备、设施；施工人员不得擅自在区域外施工或逗留，不得碰动无关仪表、电器开关和按钮等，否则由此造成一切后果有乙方承担。Second contractor should do construction strictly in working area that first contractor define, protect all equipment, establishment in c
34、onstruction area of first contractor; construction person cannot work and stay out of area, cannot touch instrument, wirings switch and button etc., otherwise second contractor need to take on the sequel. 4.9 当发生事故时，乙方应按相关程序积极抢险，避免事故进一步扩大，主要负责调查处理乙方责任轻微事故，其余事故处理按照事故管理程序进行，同时处理有关善后事宜(包括甲方责任造成乙方人员伤亡事故
35、善后处理)，事故报告及处理结果报甲方HSE管理部。when accidents happen, second contractor should rush to deal with emergency, prevent accidents from enlarging, mainly inspect and deal with slight accidents of second contractor, the rest need to be dealt with according to accidents control procedure, meanwhile deal with pro
36、blems arising from accidents(including accidents handling due to first contractor), accidents report and results report to HSE management department of first contractor. 4.10 实行承包商区域负责制，进入施工现场施工作业人员必须统穿戴符合国家标准安全帽、安全带等劳动防护用品、穿着符合CSPC规定要求防护服，同一承包商从业人员安全帽和防护服必须统一，而且经过HSE管理部审核同意。Carry out system of cont
37、ractor area control, construction person entering site must wear PPE, same contractor working peoples PPE must be same, and must be approved by HSE management department.4.11 在新项目开工之前须取得HSE管理部门HSE开工许可证。Before new project start up must get the HSE startup PTW.4.12 乙方应遵照建设工程安全生产管理条例要求，为施工现场从事危险作业人员办理工
38、伤保险。Second contractor should comply with construction project safety production management statute, transact injury insurance for people doing hazard job.4.13 乙方应按甲方要求参加有关安全、环境与健康宣传教育活动或会议，完成甲方布置其它HSE工作任务。Second contractor should join HSE education function or meeting of first contractor, finish oth
39、er HSE task which first contractor assign. 5. 违约责任及处理 Fell back and handle按民法典规定，在施工合同书必须有安全条款，应明确施工单位对施工作业中发生事故、发生违章责任，承包商应在项目开工前与项目管理部签订安全、环境与健康（HSE）管理协议书，并交纳HSE风险抵押金（一般按照工程款3缴纳），作为违章与事故考核抵押；甲方按照责任条款，对乙方违章和事故收取违约金，工程项目安全完成后，将余额退还承包商。安全、环境与健康（HSE）管理协议书与施工合同具有同等法律效力。According to regulations of contr
40、act law, construction contract must have safety regulations, should specific the responsibility of construction unit, when accidents and peccancy haPPEned, contractor should sign HSE management agreement with pmd before project startup, and need to pay HSE hazard deposit (normally according to 3% of
41、 project fund), as deposit of assessment ; first contractor obey responsibility rules to fine the money from second contractor, after project finished, first contractor will return money to contractor. HSE management agreement and construction contract have coordinative legislative effectiveness.5.1
42、 违约处理：Fell back handle甲乙双方违反本合同要求，未造成事故时，依据合同约定对违约者进行处理，包括支付违约金、停工整改、赔偿损失、罚款、清除出厂等。When first contractor and second contractor offend this contract, but not causing accidents, according to contract to deal with problem, including pay fell back money, shutdown, compensate loss, penalty, clear away et
43、c.5.2 事故抢险：Rush to deal with accidents发生事故时，甲、乙双方均有抢险、救灾义务，所发生费用由责任方承担。When accidents haPPEned, first contractor and second contractor have obligation of dealing with problems, responsibility side pay the expense.5.3 事故调查：Accidents investigation发生事故，按照事故管理制度组织事故调查，确认责任；事故调查和处理应按照国家、地方相关法律法规和甲方及CSPC有
44、关规定进行。What have haPPEned is surveyed according to accidents control organization and confirm responsibility; accidents servey and handling should process according to local relevant law and rules of first contractor and CSPC.5.4 甲方事故责任：First contractor accident responsibility甲方违约、违章造成事故，甲方承担相应责任，并按规
45、定追究有关人员责任及上报。First contractor should take on accidents due to first contractor and report to leadership. 5.5 乙方事故责任：Second contractor accident responsibility乙方违约、违章造成事故，乙方承担相应责任，并按规定追究有关人员责任并报告甲方：Second contractor should take on accidents due to second contractor and report to leadership.5.5.1 发生轻微事
46、故，给甲方造成损失或不良影响，按事故责任度和所造成直接经济损失等值赔偿并视情节考核10005000元。If light accidents haPPEned, make first contractor lost or bad effect, compensate 1000-5000RMB according to direct economy loss.5.5.2 发生公司级一般事故，给甲方造成损失或不良影响，按事故责任度和所造成直接经济损失等值赔偿，并视情况进行考核100010000元：If companys accidents haPPEned, make first contracto
47、r lost or bad effect, compensate 1000-5000RMB according to direct economy loss.a) 造成设备、仪表损坏，按所造成直接经济损失等值赔偿，视情节考核100010000元。Making equipment and instrument be damaged, compensate 1000-5000RMB according to direct economy loss.b) 造成装置局部瞬间停电、停水、停汽、停风、停仪表和设备，没造成直接经济损失，视情节考核100010000元。Making part of equip
