7、tal purposes:If the rental purpose is for residence, thenumber of inhabitant is, and should not exceedingpersons.(二)如租赁用途为居住的,甲方应自与乙方订立本合同之日起 7 7 日内日内,到房屋所在地的社区房屋所在地的社区来京人员和出租房屋服务站来京人员和出租房屋服务站办理房屋出租登记手续。对多人居住的,乙方应将居住人员情况告知甲方,甲方应建立居住人员登记簿,并按规定报送服务站。本合同变更或者终止的,甲方应自合同变更或者终止之日起 5 5 日内日内,到房屋所在地的社区来京人员和出租

8、房屋服务站社区来京人员和出租房屋服务站办理登记变更、注销手续。在本合同有效期内,居住人员发生变更的,乙方应当自变更之日起 2 2 日内日内告知服务站,办理变更登记手续。居住人员中有外地来京人员的,甲方应提供相关证明,督促和协助乙方到当地公安派出所办理暂住证;居住人员中有境外人员的, (甲方甲方 / /乙方乙方)应自订立本合同之时起 2424 小时内小时内到当地公安派出所办理住宿登记手续。租赁用途为非居住的,甲方应自订立房屋租赁合同之日起 3030 日日内,到房屋所在地的房屋行政房屋所在地的房屋行政管理部门管理部门办理房屋租赁合同备案手续。If the rental purposes is fo

9、r residence, from the date when this Contract has beenset up, within 7 days, Party A should go to the Community Service Station for Foreignerand House Lease (hereinafter refers to as the “station”) to have the house lease contractregistered. If the inhabitant is more than one person, Party B must in

10、form the situationof inhabitants to Party A. On the other hand, Party A must establish a register forinhabitants, and send it to the Station complying with regulation. If this contract hasbeen amended or terminated, party A should go to the Station to change or logout theregistration within 5 days.

11、In the period of validity, provided the inhabitants have changed,from the date of change, within 2 days, Party B must inform the Service Station and changethe registration.Party A should supply the related information about himself and/or the house if thereis foreigner from other provinces within th

12、e inhabitant, to assist and supervise PartyB to handle the Temporary Residential Permit at Local Police Station. And Party B shouldgo to Local police station to handle the Lodging Registration within 24 hours if thereis any person from other countries, from the time when this contract has been set u

13、p.If the rental purpose is not residence, from the date when this contract has been setup, within 30 days, Party A should go to the department of Local House Administration tohandle the Lease Contract Registration filing procedure.第三条第三条租赁期限租赁期限 Article 3:Lease Term(一) 房屋租赁期自年月日至年月日, 共计年精选优质文档-倾情为你奉

22、If the Party B had paid the fees related proof, Party A should returnedcorresponding fees to Party B.第六条第六条居间服务居间服务 Article 6: Intermediary services(一)丙方应当认真负责地为甲乙双方订立房屋租赁合同提供机会或媒介服务,如实报告有关订立房屋租赁合同的事项,并协助甲乙双方办理物业交验。(a) Party C should provide the opportunity or the medium service to both partiesconsc

26、intenance and repair(一) 甲方应保证房屋的建筑结构和设备设施符合建筑、 消防、 治安、 卫生等方面的安全条件,不得危及人身安全;承租人保证遵守国家、北京市的法律法规规定以及房屋所在小区的物业管理规约。(a) Party A should ensure that the construction and facilities of rental house isconformed to relevant laws and regulations. Party B could not do any unlawful or illegalactivities which are

27、 not allowed according to the State laws, the government regulationsand the local byelaw. In the period of rents, both parties should keep the house, thefacilities and goods attached to the house in safe and suitable.(二)租赁期内,甲乙双方应共同保障房屋及其附属物品、设备设施处于适用和安全的状态:(b)In the period of rents, both parties sh

28、ould keep the house, the good and facilitiesattached to the house in applicable and safe:1、对于房屋及其附属物品、设备设施因自然属性或合理使用而导致的损耗,乙方应及时通知甲方修复。甲方应在接到乙方通知后的 7 日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。因维修房屋影响乙方使用的,应相应减少租金或延长租赁期限。aParty B should notice Party A about any damage of the houses due to poor quality,natural te

29、ar and wear or calamities. Party A should be responsible for repairing in 7 daysand bear the expenses. Provided Party A has not repaired on schedule, Party B could repairinstead of Part A. Party A should bear the expenses which should be undertaken by himself.Once the repairing has made an impact on

30、 the usual life, Party A should reduce rental orextend the period of rent correspondingly.2、因乙方保管不当或不合理使用,致使房屋及其附属物品、设备设施发生损坏或故障的,乙方应负责维修或承担赔偿责任。bThe damage of the premises or the fittings that is within the control of the partyB should be borne by party B.第八条第八条转租转租Article 8: Transfer or Sublet除甲乙双

32、除合同解除 Article 9: Dissolution of Contract(一)经甲乙双方协商一致,可以解除本合同。(a) The contract can be rescind based on the agreement(二)因不可抗力导致本合同无法继续履行的,本合同自行解除。(b) If Force Majeure cause to terminating the contract, the contract is rescinded.(三)甲方有下列情形之一的,乙方有权单方解除合同:(c) If Party A has one of the following behaviors

33、, Party B has the right to rescindthis Contract unilaterally.1、迟延交付房屋达 7 日的。a Within 7 days, Party A has not turn over the house.2、交付的房屋严重不符合合同约定或影响乙方安全、健康的。b The house does not conform to the contract seriously or affects the safety and healthyof Party B.3、不承担约定的维修义务,致使乙方无法正常使用房屋的。c Because Party A

34、 has not repaired house, Party B could not use house normally.4、。d(四)乙方有下列情形之一的,甲方有权单方解除合同,收回房屋:(d) If Party B has one of the following behaviors, Party A has the right to rescindthe Contract unilaterally and take back the house.1、不按照约定支付租金达日的。a If Party B delays rental payment in the excess of _day

37、ally.8、。h(五)其他法定的合同解除情形。(e) Other legal situations of contract rescission.第十条第十条违约责任违约责任 Article10: Responsibility for breach of the Contract(一)甲方有第九条第三款约定的情形之一的,应按月租金的 200 %向乙方支付违约金;乙方有第八条第四款约定的情形之一的,应按月租金的 200 %向甲方支付违约金,甲方并可要求乙方将房屋恢复原状或赔偿相应损失。(a) Either of Parties behaviors results in the terminat

38、ion of the contract beforeits expiration, the penalty for breach should be 200% of monthly rental . Party A has theright to take back the premises and take actions against party Bs breach.(二)租赁期内,甲方需提前收回房屋的,或乙方需提前退租的,应提前 30 日通知对方,并按月租金的200%向对方支付违约金;甲方还应退还相应的租金。(b) In the period of rent, either Party

39、 A shall take back the house ahead, or PartyB shall return the house before the contract expiration, he should informed the other partyahead of 30 days. Tort-feasor agrees that the penalty for breach of contract shall be 200%of monthly rental. At the same time, Party A should return the surplus rent

40、.(三)因甲方未按约定履行维修义务造成乙方人身、财产损失的,甲方应承担赔偿责任。(c) Party A has not repaired the house in time according to the contract, so PartyBs security has been damaged. Party A should undertake the liability of compensation.(四)甲方未按约定时间交付房屋或者乙方不按约定支付租金但未达到解除合同条件的,以及乙方未按约定时间返还房屋的,应按日租金的 200%标准支付违约金。(d) Having not resc

41、inded the Contract, but tort-feasor agree that the penalty for breachof Contract shall be 200% of daily rental surpasses one day.a Party A shall not turn over the houses on schedule to Party B for use.b Party B shall not pay the rental on schedule according to the provisions of theContract.c Party B
