1、劳动合同范本中英文1Contractpartners合同双方CompanyFluggerCoatings(Shanghai)Co.Ltd.,(hereinafterreferredtoas“TheCompany)awhollyforeignownedenterpriseorganizedandexistingunderthelawsoftheP.R.C.,withitslegaladdressatRoom1806,TomsonInternationalTradeBuilding,No.1JiLongRoad,WaigaoqiaoFreeTradeZone,Shanghai,represente
2、dinthiscontractbyMr.HenrikLarsen甲方业。法定地址:。在本合同中以先生为公司代表Employee_(hereinafterreferredtoas“TheEmployee),IDNumber:乙方_(下面称作“乙方)身份证号码:2Employment雇佣关系2.1TheCompanyherebyoffersformalemploymenttotheEmployee,andtheEmployeeherebyagreestobeemployedbytheCompany,withtheworkareaoftechnicalsupport,inaccordancewith
3、thetermsandconditionssetforthinthisContract,theJobDescriptionandtheRemunerationSchemeannexedtothisContractandtheEmployeeHandbook.AcleanreleasefromtheEmployeespreviousemployerisrequired;otherwisetheCompanyholdstherighttorevokethisoffer.按照本合同及其附属的工作描绘与报酬表以及公司员工手册中所列的条款和要求,甲方正式雇佣乙方,乙方同意接受雇佣。乙方的工作范围属于技术
4、服务相关的各种事务。乙方必须与前雇主完全脱离雇佣关系,否则甲方有权撤回要约。3Durationandprobationperiod合同期和试用期3.1ThisContract,signedbytheCompanyandtheEmployee,shallcontinuefrom,foraperiodofyears(hereinafterreferredtoas“TheTerm),unlesstheContractisearlierterminatedinaccordancewithitsprovisions.本合同由甲方和乙方共同签订。除非其因合同相关条款的规定而提早终止,合同有效期下面称为“合
5、同期将从年月日起持续至年月日,为期年。3.2TheEmployeeshallberequiredtoundergoaperiodofprobationof3months.(EmployeeswhorenewcontractsareexceptionsifagreedtobytheCompany).乙方应当履行为期三个月的试用期。乙方经甲方同意续签合同的情况除外3.3TheCompanymaydismisstheEmployeeatanytimeduring,orattheendof,theprobationaryperiodiftheCompanyconsidersthattheEmploye
6、esperformancecannotsatisfytherecruitmentconditionsorthestandardsinthejobdescriptionduringtheprobationaryperiod.IftheCompanyconsidersthattheEmployeesperformancehasbeensatisfactoryduringtheprobationaryperiod,theEmployeeshallbecomearegularemployeeoftheCompanyinaccordancewiththetermsofthisContract,andth
7、eprobationperiodwillbewithinthecontractterm.在试用期中的任何时间或试用期末,甲方假如以为乙方的表现没有到达雇佣的条件或工作描绘的标准,能够随时辞退乙方。假如甲方对乙方在试用期间的表现满意,则根据合同条款乙方将成为甲方的正式员工,并将试用期计入合同期内。3.4ExecutionofthisLaborContractshallterminateatitsexpiration.Atleast30dayspriortothescheduledexpirationoftheTerm,theCompanyshalloffertheEmployeearenewal
8、oftheContractiftheCompanyintendstorenewtheContract.IftheCompanyofferstorenewtheContract,theEmployeeshallacceptorrefusetherenewalpriortotheexpirationoftheTerm.IntheeventthattheEmployeefailstorespondpriortotheexpirationoftheTerm,theEmployeeshallbedeemedtohaverefusedtorenewtheContract.inoratheshalltheo
9、fto乙方有权享受法定节假日、年假和其他不时生效的相关法律及甲方工作规章所规定的带薪假期。有关合同生效日起假期的条款请参照本合同所附的报酬表。5Remuneration劳动报酬5.1ThemonthlysalaryoftheEmployeeduringhis/herprobationaryperiodshallbeassetforthintheRemunerationScheme.Afterthesatisfactorycompletionoftheprobationaryperiod,theCompanywillconductanassessmentoftheEmployeestechnic
10、allevel,workattitudeandefficiencyetc.ThereaftertheCompanymaychangethewageoftheEmployeefromtimetotimebasedontheperformanceoftheEmployee.乙方在试用期内的月薪将在报酬表中列明。假如乙方在试用期的表现令甲方满意,甲方将对其技术水平、工作态度、效率水平等进行评估。此后,甲方可根据乙方的表现适时对其工资进行调整。5.2ItisstipulatedthatduringperiodoflegalholidaysandMarriageorBereavementLeavesan
11、dlegalparticipationinsocialactivities,theCompanyshallpaythewage.乙方在法定休假日和婚丧假期间以及依法参加社会活动期间,甲方依法支付工资。5.3AsforothersubsidyandallowanceoftheEmployee,theCompanyshallconduceThe7Workconditionandlaborprotection劳动条件与劳动保护7.1TheCompanyshallstrictlyobserverulesandstandardsofP.R.Conoccupationalsafetyandhygienea
12、ndregulationsonworkinghours,restandholidaysystemaswellasspecialprotectionsonfemaleemployees;andprovideoccupationalsafetyandhealthconditionsconformingtorelevantprovisionofP.R.CandnecessaryarticlestoensuretheEmployeewillbesafeandhealthyduringprocessofproductionorwork.IftheEmployeeistobeengagedinworkwi
13、thoccupationalhazards,regularmedicalcheckshouldbeprovided.甲方严格执行国家劳动安全卫生规程和标准、工作时间和休息、休假制度及女职工特殊保护规定,为乙方提供符合国家规定的劳动安全卫生条件和必要的劳动保护用品,保障乙方在工作生产经过的安全和健康。如安排乙方从事职业危害的作业,需对乙方定期进行健康检查。7.2TheEmployeemuststrictlyabidebyrulesofsafeoperationsduringworkingprocess,andhastherighttorefusepeccantcommand.乙方在生产经过中必须
14、严格遵守安全操作规程,并有权拒绝违章指挥。8Labordiscipline劳动纪律thetheotherneverusetheassetsoftheCompanyforthepurposeexceptfortheEmployeeswork.乙方应当保护甲方资产,不得将甲方的资产用于工作以外的其他目的。8.7AnyviolationoftheabovementionedarticlesshallconstituteaseriousviolationofdisciplinesandcausetheterminationofthisContractbytheCompanyinaccordancewi
15、thArticle9.1.2and9.1.3ofthisContract.假如乙方违犯了以上任何一条都将视为严重违纪,甲方将以此根据本合同9.1.2条和9.1.3条之规定终止合同。9TerminationofContractbytheCompany甲方单方面解除合同9.1TheCompanymaydismisstheEmployeeatanytimewithoutfurthernoticeiftheEmployee:乙方有下列情形之一的,甲方能够不发出通知而随时直接辞退乙方:9.1.1Isproventobeincompetentfortheemployingrequirementduring
16、his/herperiodofprobation;在试用期内被证实不符合录用条件的;9.1.2SeriouslybreachlabordisciplinesorregulationsasstipulatedbytheCompany;严重违背劳动纪律或甲方依法制定的规章制度的;ofor9.2.4theCompanyneedstoreducethenumberofitspersonnelinordertoavoidseriouseconomicproblemsorasaresultoftheoccurrenceofmajorproductionoroperationalproblems,andha
17、sconsultedwiththeCompanystradeunionortheEmployee.为避免严重的经济问题或作为甲方生产、运行上出现重大问题的结果,甲方经与工会或乙方本人协商后需要裁员的;9.3IftheCompanydismissestheEmployeepursuanttoArticle9.2,theCompanyshallpaycompensationtotheEmployeeinaccordancewithapplicablelaw.假如甲方按照9.2条辞退乙方,甲方将根据相关法律向乙方支付补偿金。9.4TheCompanycannottakeArticle9.2asbas
18、istoterminatetheContract,ifoneofthefollowingcasesoccurstotheEmployee:乙方有下列情形之一的,甲方不得根据本合同9.2条解除合同:9.4.1theEmployeesuffersfromoccupationaldiseaseorisinjuredfromwork,andloseshislaborcapacityorpartofthelaborcapacity,thefactofwhichisapprovedbytherelevantgovernmentorganization;乙方患职业病或因工负伤,经相关政府机构确认丧失或部分丧
19、失劳动能力的;time在乙方试用期内;10.3.2iftheCompanyfailstopayremunerationorprovideworkingconditionsinaccordancewiththetermsofthisContract;甲方没有根据合同规定向乙方支付报酬或提供工作环境的10.3.3othercasesgovernedbyapplicablelawsorregulationsofP.R.C.中华人民共和国的相关法律或法规列明的其他情形。11Confidentiality保密11.1TheEmployeeagreestomaintaintheconfidentialit
20、yofthisLaborContractandallinformationwhichmaybedisclosedtotheEmployeeconcerningmanufacturingandmanagementprocessesandtechnology,marketingorfinancialinformationoftheCompanyoranybusinessentityaffiliatedwiththeCompany,informationrelatingtotheproducts,procedures,businessandservicesoftheCompany,inthestri
21、ctestconfidenceandagreesnottodisclose,directlyorindirectly,inanymanner,anysuchinformationtoanypersoninsideoroutsidetheCompanywithoutthepriorwrittenconsentoftheCompanyorforanypurposeotherthantheEmployeesperformanceofhis/herdutiesandobligationsunderthisContract.TheEmployeespecificallyagreesthatthisobl
22、igationwillsurvivetheterminationoftheContract.theboth“Inventions),suchInventionsshallbetheexclusivepropertyoftheCompany,andtheEmployeeshallpromptlydisclosetheInventionstotheCompany,andshalltakeallnecessarysteps,includingtheexecutionofdocuments,tovesttitleandownershipoftheInventionsintheCompany.Notwi
23、thstandingtheforegoing,theEmployeeshallhavetherighttoretainownershipofallpatentsobtainedonanyInventionsmadebytheEmployeeduringhis/hernon-workinghours,andwithoutuseoforreferencetotheCompanysfacilities,informationormaterials.在合同期内,乙方假如在工作经过中创造了任何与生产工艺、产品或配方设计有关的发明下面称为“发明,则这些发明应归甲方独有。乙方应当迅速把发明透露给甲方并采取必
24、要步骤包括文件制作使甲方获得专利的所有权。除如前所述外,乙方对其在非工作时间不借助甲方设备或参考甲方信息材料所创造的任何发明,均拥有全部专利所有权。13Training培训13.1ItisthepolicyoftheCompanytoprovidecontinuouson-the-sitetraining.TheCompanymayalsorequiretheEmployeetoundertakeanoff-sitetrainingprogramiftheCompanyconsidersitappropriate.甲方有向乙方提供在职培训的政策。假如甲方以为适宜也会要求乙方接受离任培训计划。H
25、andbookoftheCompanyandotherrulesandmaterialsissuedbytheCompanyshallformpartofthetermsandconditionsoftheContract.本合同所附的工作描绘和报酬表以及员工手册和甲方发布其他的准则和文件均构成本合同的部分条款和要求。16.2IfthisContractatanytimeconflictswithanyapplicablelawandregulations,theCompanywillcomplywithallapplicableChineselawandshallpromptlyamendtheContractaccordingly.任何情况下假如本合同与相关法律、法规有冲突的,甲方应当遵循相关的中国法律并迅速对合同做出相应修改。
