6、e Two Requirement of Foundation Reinforcement（1）地基加固范围按基础平面图的基础范围进行设计和施工，施工图纸及说明书一经审定，不得随意更改，要求加固后复合地基承载力标准值为250kpa。Design and construction of reinforced foundation area shall be subject to the same of foundation plan, Construction drawings and specification which have been examined and approved sha

Subject to project budget the amount of pile is cubic meters and cost of budget projectis Yuan RMB per cubic meter.土方工程按照下列第六条（4）款规定的计价方式结算。工程结算以实际发生的并经业主、工程监理和发包方签证确认的工程量及发包方与业主签订的工程施工合同的有关规定进行结算，工程结算造价经业主审定确认为准。发包方按经审定确认的工程结算造价的11%收取承包方的施工管理费及一切应缴税费。施工管理费及应缴纳的一切税费由发包方从
15、工程款中扣除。Earth work shall be settled subject to the pricing which stipulated in (4) Article Six hereinafter.The settlement of construction shall be subject to the quantities which is an actual work and affirmed by the signatures of owner, supervision and employer in addition to relevant provisions of

The fees of construction management and all due taxies shall be charged by employer on the basis of 11% of project cost which have been under examination and affirmed. The fees of construction management and all due taxies shall be deducted from the payment of co

24、lus 1：0.28 sloping coefficient in addition to the signed confirmation for other actual matters and elevation on site. （2）探孔：孔距1米，孔深2.5米，梅花型布点，每孔 元。按实际探孔数进行结算。Holes exploration: The diameter of hole is 1 meter and the depth of hole 2.5 meter. The work quantity is calculated on the cubage of pile body.七：变更及工程费的调整 Article Seven Alternation and Cost Adjustment1、本工程进行中，发包人对工程内容与技术要求提出变更时，承担变更导致承包人的经济支出和损失，由此延误的工期顺延。Provi

32、ee.4、开工前，发包人应自负费用办理开工许可证以及完成工作场地使用、青苗、树木赔偿、坟地迁移、房屋构筑物拆迁、障碍物清除等必要程序，使工地现场具备正常工作进行的有关条件；发包人应向承包人提供工作现场地下已有埋藏物（如电力、电讯电缆、各种管道、人防设施、洞室等）的资料及其具体位置分布图，若因地下埋藏物不清，致使承包人在现场工作中发生人身伤害或造成经济损失时，由发包人承担民事责任；在有毒、有害环境中作业时，发包人应按有关规定，提供相应的防护措施，并承担有关的费用；以书面形式向承包人提供水准点和坐标控制点；并负责现场桩位放点。发包人应解决承包人工作现场的平整、道路通行、用水用电、泥浆排放，并承担费
33、用。Employer should, prior to commencement of work, at his expense, acquire Licence for Commencement, go through all necessary procedures on the site use, compensation for seeding and trees, tomb migration, demolition of building / structures and obstacles elimination, so as to enable the site with re
34、levant conditions of normal work；Employer should provide contractor with the data and distribution drawing of specific location related to underground facilities / structures including the cables of electricity and telecommunication, various pipes, air defense facilities as well as caverns, etc. , f
35、or which employer should take responsibility of compensation for contractors personal injury or economic loss which occur on site, if, arising from unclear or unknown to the underground events.Provided that carrying out project in toxic and hazardous environment, employer should under relevant regul
36、ations, at his own expense, provide contract with corresponding protect measurements and issue in written form the location of benchmark, coordinates point and pile location.Employer should at his own expense make preparation of site leveling, road access, water / electricity and discharge of mud fo
37、r contractor.5、发包人应对工作现场周围建筑物、构筑物、古树名木和地下管道、各种线路的保护负责，承包人提出书面具体保护要求（措施），并承担费用。Employer should be responsible for the protection of building, structure, old and rare trees, as well as various underground pipes / lines around project site. Contractor submit on its own expense, the specific requirement
38、 of protection measures in written.6、发包人应保护承包人的投标书、报告书、文件、设计成果、专利技术、特殊工艺和合理化建议的使用权和所有权不受侵犯，未经承包人同意，发包人不得复制泄露或向第三人转让或用于本合同外的项目，如发生以上情况，发包人应负法律责任，承包人有权索赔。Employer should indemnify and protect contractors rights of use and ownership of tender, reports, documents, design results, patented technology, sp
39、ecial techniques and rationalization proposals from infringement， without prior written consent of contractor, employer shall not copy, divulge or transfer any and all above documentation to the third party or use to other project beyond this project, if, the occurrence of such infringements, contra
40、ctor is entitle to claim for compensation.九：承包人责任 Article Nine Responsibility of Contractor1、派出工程技术人员按任务委托书要求进行现场踏勘，确定工作手段、工程量，编制工程预算。Dispatch engineering and technical personnel to make site survey and make determination of construction measure, work quantity in addition to preparation of project b
41、udget.2、委派_为该项工程项目的负责人，全权负责该工程的现场协调，技术、施工管理等各项工作。_ shall be designated as the person in charge of this project and with full authority to take responsibility of the coordination of site, technology, construction management and various works.3、开工前，提出施工组织设计，并根据施工组织设计，搞好技术交底，做好各项施工准备工作。On pre-commencem

43、elivery project achievements subject to the schedules hereof to which bear the liability of quality.十：违约责任 Article Ten Liability of Breach1、由于发包人提供的资料错误、不准确，造成工期延误或返工时，除工期顺延外，发包人应向承包人支付停工费或返工费，造成质量、安全事故时，由发包人承担法律责任和经济责任。Provided that errors or inaccuracies of the data / documentation submitted by em
44、ployer give rise to delay or rework, except work time extension employer shall make payment of suspension or rework to contractor, if, any accident occurrence of quality or safety therewith, the liabilities of legal and economy thereof shall be born by employer.2、在合同履行期间，发包人要求终止或解除合同，承包人未开始工作的，不退还发包
45、人已付的定金；已进行工作的，完成的工作量在50以内时，发包人应支付承包人工程费的50的费用；完成的工作量超过50时，发包人应支付承包人工程费的100的费用。Provided that employer require termination or rescind this contract during the period of performance, if, prior to commencement of project, contractor shall not refund deposit which have been paid by employer; if, contract
46、ors completed quantity less 50% of total the same, employer shall effect payment of 50% work cost; if, completed quantity over 50% of total quantity, employer shall pay 100% of project cost.3、发包人不按时支付工程费（进度款），承包人有权停工，工期顺延，发包人还应承担滞纳金。Should employer fail to effect the payment of construction cost (vi
47、z. progress payment), contractor is entitle to do correspondingly suspension and extension period in addition to claim employer for penalty of delay payment.4、由于承包人原因延误工期，每延误一天承担工程费千分之一计算的违约金。发包人不得因此而拒付工程款。Should delay of work period for contractors reason, contractor should bear breach penalty on the basis of 1 ( ONE IN A THOUSAND ) of project cost per each day, and contractor shall not refuse to effect payment of construction cost to contractor therefore. 5、 由于承包人的原因造成工程质量达不到合同要求时，承包人除负责采取补救措施外，应免收补救措施的工程费。补救后仍不能达到合同要求时，承包人承担违约责 任，并根据因此造成的损失程度向发包人支付赔偿金，赔偿金额最高不超过返工项目的收费。因地层变化或人力不可抗拒等非承包人
