10、iness License, it must pay related Party Bs social and medical insurance and will deduct Party Bs own social and medical insurance premium and individual income tax from Party Bs salary to pay to the Chinese government.10. 甲方调整乙方工作岗位的，根据乙方能力及其相关职位，双方协商一致后调整乙方劳动报酬。 Party Bs labor remuneration will be
11、 adjusted as per Party Bs competence and job requirements on the basis of consensus in case Party A adjust Party Bs job.11. 甲方将每年对乙方的工作成绩、表现，以及劳动报酬进行评估.Party A will review Party Bs work performance and salary on an annual basis.五、社会保险和福利待遇12. 甲方根据国家有关规定为乙方缴纳北京市城镇社会保险（养老、医疗、失业、工伤），个人缴纳部分由甲方从乙方工资中代扣代缴
12、。甲乙双方解除、终止劳动合同时，甲方按有关规定为乙方办理社会保险相关手续。According to the States related rules, Party A will pay Beijing social insurance in urban area (i.e. pension insurance, unemployment insurance, Occupational Injury and medical insurance) for Party B. And Party A will deduct Party Bs part from his or her salary. W
13、hen the labor contract is terminated by both parties, Party A will handle the related procedures for Party Bs social insurance according to the related regulations.13. 乙方非因工疾病或负伤，在医疗期内工资及其医疗待遇按照本合同16条执行。乙方患职业病或因工负伤后的工资和医疗补助执行按照国家和地方的有关法律法规执行。In case of illnesses or injuries uelated to work, the sala
14、ry during the remedial period as well as medical treatment shall be paid in accordance with Clause 16. The salary and Medicare benefits of Party B in case of occupational diseases or work-related injuries shall be paid in accordance with the relevant national and local laws and regulations.14. 因公出差按
15、公司规定实行差旅费报销与补贴。In case Party B travels on business, Party A will reimburse travelling expenses and give subsidy to Party B in accordance with the company rules.六、假期安排 Annual Leave and Sick Leave15. 带薪年假 雇佣期满一年后，甲方每年为乙方提供十天带薪年假。乙方需根据甲方经营和工作等实际情况，安排年假，尽量将甲方损失最小化。乙方休年假时，必须提前一个月通知甲方，并取得甲方批准，方可休假。Annual
16、Leave Party B shall be entitled to take paid annual leave of ten (10) working days per annum after the first year the employment. Leave may be taken as it is accrued but may only be taken at times agreed to by the company in order that disruption will be minimal. Request for leave must be submitted
17、one (1) month in advance and approved by Party A.16. 病假 如乙方不涉及住院治疗，甲方将每年批准乙方共计15天带薪病假；其中全薪病假五天，三分之二薪金病假五天，以及三分之一薪金病假五天。如乙方病假日期总数超过甲方允许的病假日期总数，超出部分将在乙方带薪年假日期数中扣除；如果乙方病假日期总数超出了甲方允许的病假和带薪年假日期总和，甲方将不会支付乙方超出日期的任何薪金。乙方必须向甲方财务或行政部出具医院的相关病假证明并通知乙方上级部门，如乙方不能提供相关医院病假证明，视为乙方旷工处理，甲方有权不支付乙方旷工期间任何薪金。Party B is en
18、titled to five (5) days sick leave per full calendar year at full pay, next five (5) days sick leave at two-third pay and next five (5) days sick leave at one-third pay, if no hospitalization is incurred. Medical Certificates must be submitted to our Accounts/Admin department upon returning to the o
19、ffice; if not, Party A has right not to pay for Party Bs absence.Party B is required to inform its supervisor and the directors if Party B requires sick leave. All absence beyond Party Bs allocated sick leave is deducted from its vacation time. lf both the sick leave and vacation leaves are used up,
20、 Party B will not be entitled to be paid for its time that Party B is absent from work.七、劳动纪律17. 合同期间，乙方应严格遵守国家的各项法律法规及甲方依法制定的各项规章制度及要求，严格遵守劳动安全卫生、操作规程及工作规范；应爱护甲方财产，遵守职业道德，积极维护公司荣誉和利益。 Within the contract term, Party B shall abide by the States laws and regulations as well as the rules formulated by
21、 Party A according to the laws; follow labor security and hygiene systems, production processes, operating instructions and job specifications; take good care of Party As property; and safeguard the benefits and reputation of the company.18. 乙方违反劳动纪律 ，甲方可依据本公司的规章制度给予纪律处分，直至解除本劳动合同。另外，由于乙方的原因对甲方造成经济损
22、失的，原则上必须按照实际损失金额由乙方向甲方承担损害赔偿责任，数目重大者甲方有权追究其法律责任。In case Party B violates any of the labor disciplines, Party A may punish Party B or even release the contract according to the rules and regulations of the company. Moreover, Party B will be held liable for Party As economic losses on a case-by-case b
23、asis, in the event that Party Bs behavior damages Party As interests. In case of the considerable amount of losses, Party A will retain the right to pursue legal actions against Party B.19. 在本合同履行过程中，甲方根据国家有关规定可以制定新的规章制度，也可以对公司制定的规章制度进行修改，发布的各种规章制度、操作规定、通知、公告等均对乙方有约束力。During the contract performance
24、, Party A may formulate new or revise rules and regulations based on the States related regulations. The rules and regulations, operating provisions, notices and proclamations are binding on Party B.八、劳动合同的履行和变更 Labor Contract Performance & Alternation20. 甲方应按照约定为乙方提供适当的工作场所、劳动条件和工作岗位，并按时向乙方支付劳动
25、报酬。乙方应当认真履行自己的劳动职责，并亲自完成本合同约定的工作任务。Party A shall furnish Party B with proper working place, labor conditions and position, and shall also pay the remuneration to Party B on time, conforming to the provisions herein. Party B shall fulfill his responsibilities herein in due diligence.21. 甲、乙双方协商一致，可以变
26、更本合同内容，并以书面的形式确定。The contract may be revised in written form, after both parties agreement through negotiation.九、劳动合同的解除、终止和续订 Labor Contract Cancellation, Termination & Renewal22. 经甲、乙双方当事人协商一致，本合同可以解除。双方应提前三十日（试用期为提前三日）以书面形式通知对方或以支付一个月工资代替通知，方可解除本协议。The contract may be canceled based on both parties mutual negotiation.
